A letter was presented from the Planning Commission advising that the Commission had approved the Applica- tion for Resubdivision No. 179 which grants permission to combine three lots plus a portion of another lot into one parcel, the property mentioned above. The City Attorne ;ea read portions of a document, ,being a Grant of Easement.. to the owner of the adjoining property, which would have the effect of maintaining. the ten -foot buffer if a building in excess of 35 feet were constructed on the property proposed. to be rezoned. Mr. William Ring stated that .the document had been executed and recorded. Council- man Stoddard asked if this was satisfactory to Mr. Edwards, and Mr. Ring indicated that it was. Mr. F. A. Tyler, 1401 North Bay Front, spoke from the audience opposing the Use Permit as requested by Mr. Christensen and as conditionally granted. by the Planning Commission. Mr. Charles E. Pittinger, re4ltor, 320 Marine Avenue, representing Mr. Gene Christensen, spoke from the audience requesting that the Application .,for Use Permit be granted as applied for and not as con- ditioned by the Planning.Commission. Mr. George Newton, 1407 North Bay Front, opposed the Use Permit. Ralph Hinger, 321 Marine Avenue, spoke in favor of the Christensen Application. Mayor'Hart opened the public hearing regarding Planning Commission Resolution No. 664, recommending amend- ments. to the Land Use element of the Master Plan, per- taining to proposed land use of the Banning annexations numbered 54 and 55. No one desired to speak from the audience. The hearing was closed. Motion x All Ayes Resolution No. 5903, adopting certain amendments to Motion x the Master Land Use Plan (Amendment No. 9), was Roll Call: adopted. Ayes x x X x x ORDINANCE FOR INTRODUCTION: Ordinance No. 1079, being AN ORDINANCE OF THE CITY OF NEWPORT BEACH REPEALING SECTIONS 4221 THROUGH .4226 OF, AND ADDING NEW SECTIONS 4221 THROUGH 4224, TO, THE NEWPORT BEACH MUNICIPAL CODE RELATING TO CURFEW HOURS FOR MINORS, was presented. A discussion was had regarding whether the curfew re- quirement should pertain to military personnel in or out of uniform. The recommendations from the Salary Committee dated January 9, 1964 regarding personnel action, as present- ed on January 13, were considered. Councilman Gruber made a motion to adopt Resolution Motion x No. 5904, adopting a new Schedule "A" and "B" adopted by Resolution No. 5804 relating to classification and compensation, in accordance with the Salary Committee' recommendations. A discussion was had. Councilman Cook requested an amendment to. the motion which would delete considera- 7 tion of Item 7 on the Salary Committee Recommendation Sheet for a General Services, General Foreman at Range 35. Councilman Gruber requested that the amendment to. the motion be voted on first. Councilman Cook made a motion to vote separately on Motion x the recommendations made by the Salary Committee as Ayes x x x to Item 7, General Foreman at Range 35. Said motion Noes x x x failed adoption. Councilman Cook requested that the record show that he is in favor of raising salaries and creating the positions designated in the personnel recommendations as 1, 2, 3, 4, 5, 6, 8, 9 and 10, but that he was opposed to creating a new position of General Foreman at Range 35, for the reason that it is necessary in the interest of economy to save the taxpayers money and that he would therefore vote No on the entire resolution. Councilman Elder shared a similar view. A memorandum from the City Manager dated January 3, 1964, regarding a proposal for a Tentative Neighborhood Plan, was presented. A discussion was had. The Tenta- tive Neighborhood Plan was received and filed and the Motion x 3 City Manager was requested to bring back a further All Ayes report at a later date. RECESS for five minutes was declared by Mayor Hart. The Council reconvened with all members present except Councilmen Lorenz, Gruber and Cook, who joined the meeting within a matter of seconds. A memorandum was presented from the City Manager and Public Works Director dated January 24, 1964, re- ed garding weed abatement. )ate_ -9 =55907 Resolution No.. 5907, determining and declaring that cer tain weeds are growing upon certain streets, sidewalks, parkways and private property in the City of Newport Beach, and that the same are a public nuisance; direct- ing the Street Superintendent to post notices to destroy said weeds as required by law;.fixing the time for hear- , ing all objections or protests and directing the abatemen thereof in accordance with Chapter 4 of Article VII of the Newport Beach Municipal Code; setting the hearing Motion x gg for February 24, 1964, was adopted. A memorandum dated January 23, 1964 from the City sin Manager and Public Works Director regarding catch basin construction in Bayside Drive, Contract No. C -886 isad (Jezowski and Markel), recommending approval of Change Order No. 1 in the amount of $1864, was pre - )86 sented. The following letter received from Helen Hanscom, iscon 13122 South Brookhurst Street, Garden Grove, stating that: "'We are constructing and within a few days of com- pletion, a residence which I own, located at 2500 Anni- versary Lane. I. respectfully request that the City vgc Council approve a contract with the Costa Mesa Sanitatio District for sewerage service, as there is no other means 32 of making the necessary sewer connections ", was pre- sented. Excerpt from the Minutes of the Orange County Board of Supervisors meeting held January 7, 1964,, indicating the cancellation of weed abatement assessments for the City of Newport Beach as requested by the City, and the re- duction of a weed abatement assessment as requested by the City. ADDITIONAL ITEMS: 1. Councilman Stoddard requested additional information regarding the statement in the Minutes of the Parks, Beaches and Recreation Commission that the Chief Land Agent is not going to proceed with condemnation of the underwater lots. The City Manager said he would keep Councilman Stoddard informed. 2.
