11. The Upper Bay Committee submitted a map .entitled
"Land Parcel Exhibit for Upper Newport Bay Land Ex-
change, March,, 1964,. U10.2 -2," (M- 502 -1 -S), depict-
ing the parcels proposed,to be under City control, known
as Parcels 110, 114, 116, 118 ,and 120.
Letters from Dick Richard, Walter Mellott, and W.
Worth Bernard, urging acceptance of the Upper Newport
Bay Land Exchange as presently proposed, were pre-
sented.
A draft of a letter to be directed, to the Board of Super-
visors regarding this matter was read by Mayor Hart.
Councilman Marshall made a motion.that. the letter be

amended,to state that. in connection with the five parcels,
the control, development, administration and use of
these parcels shall be vested exclusively,in the City in
perpetuity. A discussion was had. Councilman Elder
felt. that stronger language requesting City ownership of
the parcels was necessary.
Mr. William Mason, Vice President of The Irvine Com-
pany, read into the record aletter addressed to the
Council dated March 9,. 1964, "setting forth details and
facts on,the new proposed exchange."

3. Other Joint Harbor Committee business .considered by
the Council:
(a), The recommendation.that a policy,be adopted by the
Council for construction of dry storage for boats in
areas that would ordinarily be utilized by piers and
slips, was presented. Mayor Hart appointed.Counci
man Marshall, Chairman, and Councilman Elder to
work with a member of the Planning Commission ,to
.formulate the policy. requested.
(b) The recommendations submitted by the Joint Harbor
Committee that changes in the Harbor Lines Map for
Tract 4224 (D -996 Revision), as accepted by the Join
Harbor Committee, were presented. The Council
concurred in the recommendations.
(c) Consideration was given to Application No. A- 1330 -R.

matter was presented to the Council as a Claim for
Damages on November 12, 1963. The claim was
denied. The allegations in the complaint are that the
plaintiff on August 11, 1963 fell and sustained injuries
.by reason of an unsafe condition of the sidewalk on
Edgewater between Palm and Adams.

damage to claimant's property on November 19 and 2
by reason of storm waters.
(d) Claim of Dolores Mellon for herself and on.behalf of
her minor daughter, Adele Mellon, for alleged .dam-

ment, vs. the City of Newport Beach, et al.
(e) Claim of Mr s. Nathalie Miers for alleged damages
when she stepped on a piece of pipe on.the beach and
injured her foot, on February 9, 1964.
(f)Claim of D. V. Alderman for alleged. loss incurred to
his property at 442 Dahlia on November 20 "When the
drainage, system in the street. in front of the house
could not carry, the overflow and water damaged the
premises,"

and Beach Realty Company, stating she has been
"instructed by the two property.owners (Yaeger and Hitt)
contiguous to the alley, directly, behind 310- 312. -314 East
Bay to request the City Council approve abandonment of
