Ayes x x x x x x x HEARINGS: 1. Mayor Gruber opened the public hearing in connection with the appeal of Dr. David I. Nielsen from the decision of the Planning Commission denying resub- division Application No. 208, requesting permission to divide the existing 66 foot property located at 122 Via Lorca into two lots of equal size, the south- westerly 21 feet of Lot 630, all of Lot 631, and the northeasterly one -half of Lot 632, Tract 907, zoned R -1. Findings of the Planning Commission and vicinity map, a letter dated May 18, 1965 from Dr. David I. Nielsen, and a letter from Lido Island Com- munity Association dated May 20, 1965, were presented. Mr. Lynn Williams, representing:Lido Island Community Association, spoke from the audience and read the communication from said Association dated October 20, 1954 directed to the Planning Commission, indicating that at that time, the Association did not favor the division of larger Lido Isle lots into smaller building sites. Mr. i Williams also indicated that by a vote of 5 to 4, the Board opposed the present proposal of Dr. David I. Nielsen. Mr. John Moriarity of Garden Grove spoke from the audience in regard to the number and sizes of lots on Lido Isle. A motion was made by Councilman Marshall to close Motion x the hearing. Attorney Robert Hurwitz, representing Dr. Nielsen, spoke from the audience. A vote was taken on Councilman Marshall's motion, which Ayes x x x x x x x carried. and the hearing was closed. A motion was made to sustain the findings of the Motion x Planning Commission and deny the resubdivision, Ayes x x x which motion failed adoption. Mayor Gruber opened the public hearing in connection with the appeal of Charles R. Gangi from the decision of the Planning Commission denying application for Variance No. 861, requesting waiver of square footage requirements to permit construction of 40 one - bedroom bachelor units with one covered parking space for each unit, Lots 6 & 7, Tract 5854, zoned R -3, at extension of Hilaria Way, easterly of Flag- ship Road. A letter from Charles R. Gangi dated May 12, 1965 an, findings of the Planning Commission were presented. Mr. Gangi spoke from the audience indicating that he proposed a change in his plans to provide one and .one- half parking spaces for each apartment. The hearing was closed. Ordinance No. 1130, being, AN ORDINANCE OF THE CITY OF NEWPORT BEACH AMENDING SECTION 9105.1 OF ARTICLE IX OF THE NEWPORT BEACH MUNICIPAL CODE RELATING TO PLANNING AND ZONING, relating to helicopters, heliports and helistops; Planning Commission Amendment No. 206, was presented with the findings of the Planning Com- mission. A letter dated June 9, 1965 was presented from the Planning Commission recommending that sidewalks be installed at the ends of the landscaped area in Tract 4225 to the satisfaction of the Public Works Department, and that the required sidewalks parallel to Westcliff Drive be waived for an additional two year period, at which time the matter will again be reviewed to see if developments to the east and south affect pedestrian traffic along Westcliff Drive. The recommendations of the Planning Commission were approved. 2. The Final Map for Tract No. 5877, located between Corona del Mar High School and Big Canyon, East Bluff area, was presented. The recommendations from the Public Works Department and the findings of the Planning Commission had been presented on May 24. Said Final Map was approved subject to the recom- mendations of the Planning Commission and the Public Works Department. Resolution No. 6156 authorizing the execution of an Agreement with The Bluffs, subdivider, for the construction of improvements in Tract No. 5877, was adopted. Resolution No. 6157 accepting a Grant Deed from The Irvine Company and The Bluffs conveying fee title to public street rights -of -way in Tract No. 5877, was adopted. Resolution No. 6158 approving Notice of Addition of Territory for Tract No. 5877 under the declaration of covenants, conditions and restrictions applicable to Tracts Nos. 5463, 5480, and others, and authori Mayor and City Clerk to execute the same on behalf of the City, was adopted. 3. Consideration was given to the acceptance of dedication of Ford Road between MacArthur Boule- vard and Jamboree Road as a public street. (d) Summons and Complaint for Property Damages and Personal Injuries in Orange County Superior Court Action No. 135885, Harvey vs. City of Newport Beach, et al., which were served on the Deputy City Clerk on June 1, 1965. 9. A letter was presented from the Newport Harbor Chamber of Commerce stating that the Newport Harbor Kiwanis Club and the Newport Harbor Optimist Club would like to present four litter con- tainers to the City in connection with the Anti - Litter Pilot Program, and asking that both service clubs have a waiver of liability on these containers. A letter from Sam Downing, Chairman of the Newport Harbor Chamber of Commerce Committee known as C- H- A -R -T, requesting the cooperation of the Council in the preparation of the proposed study to be made by said Committee, was presented. Jack Barnett spoke from the audience. The full cooperation of the Council with C- H -A -R -T was authorized, and it was directed that the City Motion x staff employees who participate may do so insofar as Ayes x x x x x supplying information and data is concerned only. The Mayor was authorized to write a letter on behalf of the Council stating that the Council will be avail - able for any help desired. 11. A petition was presented signed by twenty -four individuals asking the Council to decline the request of Dan A. McCall for a dancing and entertainment license for "Satan's Suite ", located at the corner of 20th Street and Balboa Boulevard, stating that since this is located next to a residential district, the noise level will be greatly disturbing to the neighbor- hood and will lower property values. It was stated that the Planning Commission had denied the application of Dan A. McCall for a Use Permit on June 3, 1965. The City Clerk stated that an appeal had been filed in connection with said application for Use Permit. It was directed that the City Clerk set the hearing Motion on said appeal for July 12, 1965, and that the Ayes communication be placed in the file pending said hearing. 2. The following communications were ordered filed: Motion Aye s (a) Amendment to Application of Southern California Sightseeing Company, Inc, for Certificate of Public Convenience and Necessity and Authority to Establish Fares and to Issue Securities; and Application of Greyhound Lines, Inc. to Acquire Control of Southern California Sightseeing Com- pany, Inc. ; No. 47382, before the Public Utilities Commission. (2) Meeting of June 1, 1965 regarding proposed annexation to the City of Costa Mesa (Paularino No. 9 Annexation), located westerly of Newport Avenue in the vicinity of Paularino, Bear, and Gisler Avenues, stating that the boundaries of the proposed annexatio are not definite and certain, and all docu- ments were referred back to the City for correction and resubmission. (h) Letter to City Clerk from the Mayor's Office, Montreal, Canada, stating that the monthly review, "Montreal '65 ", will be sent each month to the City Officials of Newport Beach. 4. A letter was referred to the City Manager from D. W. Frick, 650 Via Lido Nord, enclosing newspaper clippings regarding schools in Santa Barbara and Los Angeles which were considered unsafe in the event of an earthquake, and asking what is being done about checking on older schools in Newport Harbor area in this regard.
