Mayor Gruber read Resolution No. 6443A in its entirety,
and presented said resolution to Mr. 'Pat' Patterson with
the Council's appreciation for the great service he had
rendered in the past, and which he would no doubt render
in the future. Mr. Patterson thanked the Council and
stressed the importance of the continued planning by the
City for the future water supply.
Mayor Gruber requested Police Chief Glavas to come
forward, and Mr. Stuart Wilkinson of the Automobile
Club of Southern California presented to Chief Glavas for
the City of Newport Beach a plaque for a two -year no
pedestrian fatalities award of the American Automobile
i
Association.
Councilman Cook called attention to the presence of Hans
Lorenz in the audience, who has replaced Mr. Patterson
as a member of the Board of Directors of the Coastal
Municipal Water District, and suggested that he be recog-
nized and that he be offered an opportunity to address the
Council on a matter of interest to him.
Mayor Gruber welcomed Mr. Lorenz; Jay Stoddard,
former Councilman and Mayor of Newport Beach; and also
Don Elder, former Councilman and Vice - Mayor, who
were in the audience; and, the Council concurring, invited
Mr. Lorenz to come before the Council, suspending the
regular order of business.
Mr. Hans Lorenz came forward and stated not only was he
speaking for himself, but the President of the Chamber of
Commerce had asked him to also speak in behalf of the
Chamber and the Freeway Committee, and protested an
alleged attempt by City staff to obtain personal data on
the members of the Freeway Committee of the Chamber
of Commerce and an alleged police investigation of an
individual from outside of the City who had interested
himself in the coastal freeway.

Mr. James Berkshire, President of the Newport Harbor
Chamber of Commerce, spoke also and registered com-
plaint of alleged telephone calls made to individual mem-
bers of the Freeway Committee.
A discussion was had.
Mr. Robert Weed, Publisher of the Daily Pilot, and Mr.
Jay Stoddard spoke from the audience.
The matter was resolved, and the regular order of the
Agenda was resumed.
HEARINGS:
1. Mayor Gruber opened the public hearing in connection
with Ordinance No. 1186, being,
AN ORDINANCE OF THE CITY OF NEWPORT
BEACH ESTABLISHING A SETBACK LINE AND
AMENDING DISTRICT MAP NO. 24,
Planning Commission Amendment No. 225, proposing
to amend Districting Map No. 24 in order to reduce
the front yard setback from 27 feet to 10 feet on
Lot 69, Tract 1701 located at 618 Ramona Drive,
Corona del Mar.
Acting Planning Director Charles Zimmerman spoke
from the audience. No one else desired to be heard.
The hearing was closed.
With the unanimous consent of the Council, Mayor
Gruber stated that the further reading of the
ordinance was waived.
Ordinance No. 1186 was adopted.
2. Mayor Gruber opened the public hearing in accord-
ance with Resolution No. 6420, which determined
and declared that weeds and other public nuisances
exist upon certain streets, sidewalks, parkways,
and private property in the City of Newport Beach;
directed the Street Superintendent to post notices to
abate said nuisances; and fixed the time for hearing
all objections or protests and directed abatement
thereof in accordance with Chapter 4 of Article VII
of the Newport Beach Mu Cod

Councilman Shelton made a motion to introduce
Ordinance No. 1188.
Councilman Cook stated for the record that it was his
belief that it was discriminatory for dogs to have to
be inoculated and not cats.
A vote was taken on Councilman Shelton's motion,
and Ordinance No. 1188 was introduced and passed
to second reading on October 10, 1966.
3. Proposed Ordinance No. 1189, being,

BEACH ESTABLISHING A SETBACK LINE AND

2. The following claims for damages were denied and
the City Clerk's referral of the matters to the
insurance carrier was confirmed:
(a) Claim of Thomas J. Moore, a minor, filed by
his father Alvin J. Moore, for personal injuries
sustained on or about June 23, 1966, allegedly
caused by a motor boat within the swimming area
near the east jetty.
(b) Claim for Injuries and Damages to Real Property
of W. G. Barkemeyer and Lora -Jean Barkemeyer
Claimants, vs. City of Newport Beach; filed by
Hagenbaugh, Murphy & Medearis, Attorneys at
Law, alleging said injury and damage were
sustained by the claimants as a result of the
negligence and misfeasance of City plan checker's
failure to observe the non- conformity on plans
for the building and construction of dwelling at
135 North Bay Front, Balboa Island.
3. A letter dated September 15, 1966 from Harold I.
Johnson requesting that the half -block of Villa Way,
west of 29th Street be paved and that "No Parking"
signs be installed on both sides of the street, was
considered.
A motion was made by Councilman Forgit that as it
was the desire of the Council to have subject street
paved, the staff be authorized to go ahead with the
paving by giving the property owners a choice of
(1) the City enforcing the Chapter 27 provisions of the
"Improvement Act of 1911" which provides that if one -
half of a block is improved, the City can enforce the
improvement of the other half and put a lein on the
property for all costs; or (2) the owner may agree to
the paving of the street and pay it in a lump sum to
the City or pay it over a period of three years at an
interest charge of 776, and if the owner agrees'to the
work, the City would contribute all engineering costs
which motion was withdrawn.
The matter was referred to the staff.

8. The Acting City Clerk stated that a communication
had just come in from Jerry Hachez dated September
26, 1966 regarding a citation he had received for
's docking his boat at Delaney Brothers Sea Food dock,
and that she had been requested to read it to the
Council. The Clerk read the letter in full. Mayor
Gruber inquired if the Council wished to consider the
matter at that time. There were no objections. A
discussion was had.

Load Packer necessitated by the closing of the City Dump.
(The new Packer will cost $12, 858. 54, but there is
$1, 934. 93 available in Account #5091 so a net appropri-
ation of $10, 923. 61 is needed).
C -15, being a transfer of $275 from Unappropriated
Contingency Reserve to Budget Appropriation, Planning,
Furniture & Fixtures, for additional furniture for new
Planning Director: 1 book shelf - $145. 00 and 2 file
cabinets - $130.00.
C -16 in the amount of $9, 000, being a decrease in Unap-
propriated Surplus and an increase in Budget Appropri-
ations and Revenue Estimates for construction cost for
Contract No. 1063 - the construction of Harbor Island -
Linda Isle Submarine Water Main, based on the bids
received September 20, 1966 ($3, 135 has been deposited
by The Irvine Company); $9, 000 from Unappropriated
Surplus Water to Budget Appropriation, Water, Land
Improvement, Harbor /Linda Isle Submarine Water Main.
ADDITIONAL BUSINESS:
1. Resolution No. 6450, amending Paragraph 2 of Reso-
lution No. 6172, which provides for parking passes
and establishes fees for the use of the 26th Street
