Staff requests City Council's approval to award the construction contract to T.E. Roberts, Inc. of Orange, California. RECOMMENDATION: a) Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Class 2 Section 15302(c) (replacement of existing public facilities involving negligible or no expansion of capacity) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential to have a significant effect on the environment; b) Approve the project plans and specifications; c) Award Contract No. 7539-1 to T.E. Roberts, Inc. for the bid amount of $749,933.00 for the Water Transmission Main Valve Replacement project, and authorize the Mayor and City Clerk to execute the contract; and d) Establish a contingency of $75,000 (approximately 10% of total bid) to cover the cost of unforeseen work not included in the original contract. FUNDING REQUIREMENTS: Sufficient funding is available in the current Capital Improvement Program budget for the award of this contract. DISCUSSION: At 10 a.m. on May 2, 2019, City Clerk opened and read the following bids for this project: The Water Transmission Main Valve Replacement project replaces large diameter valves as identified in the Water Master Plan. These are older deteriorated valves located on large diameter transmission mains (16 -inch, 18 -inch & 30 -inch) that were installed in the 1960's and used to isolate sections of the water system for maintenance and operations. These valves have outlived their design life and are now due to be replaced. This year's project will replace ten valves located on Eastbluff Drive and San Joaquin Hills Road. The apparent low bidder for this project, T.E. Roberts, Inc. submitted a bid 6.3 percent below the Engineer's Estimate of $800,000.00. T.E. Roberts submitted all the necessary forms and possesses a Classification "A" California State Contractors License as required by the project specifications. A check of the contractor's references indicates satisfactory completion of similar projects for the City of Newport Beach and other public agencies. T.E. Roberts recently completed the Balboa Island Water Main Replacement — Phase I & Phase 11 project for the City of Newport Beach and received high marks. The proposed project involves removal and disposal of existing 16 -inch, 18 -inch and 30 -inch water transmission main and valves, demolition and disposal of existing valve vaults, construction of 16 -inch, 18 -inch and 30 -inch CML&C transmission main pipe and direct buried valves, fittings and connections to the existing water system, pavement restoration, traffic control and other appurtenant work as required by the contract. 9-2 BIDDER TOTAL BID AMOUNT Low T.E. The contractor will be required to closely coordinate with City staff who will prepare traffic control and detour plans prior to the pre -construction meeting. A detailed schedule is to be prepared by the contractor following contract award, which can be adjusted to address concerns for businesses and residents in the project area. Project phasing has been developed to minimize impacts to the community. For example, most work along San Joaquin Hills Road will be done at night, including the existing valve located within Eastbluff Drive near the Jamboree Road intersection. The remaining five valve locations along Eastbluff Drive will be done during school summer break in order to avoid disruption to the morning drop-off and afternoon pick-up times. Pursuant to the Contract Specifications, Contractor will have 120 consecutive working days to complete the work. Work for this construction contract is scheduled to begin July 8, 2019. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Class 2 Section 15302 (c) (reconstruction of existing public facilities involving negligible or no expansion of capacity) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential to have a significant effect on the environment; The work for this project consists of replacing existing valves, demolishing and removing existing valve vault structures and minimizing the existing footprint of existing public facilities. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). ATTACHMENT: Attachment A — Location Map 9-3
