The Planning Commission approved the minutes as presented. AYES: Koetting, Kramer, Lowrey, and Weigand NOES: None ABSENT: None ABSTAIN: Ellmore, Kleiman, and Zak ACTION: Approved ITEM NO. 2 TRIMAR PROPERTIES ENCROACHMENT (PA2019-064) Site Location: 2404 Cliff Drive SUMMARY: A request to waive City Council Policy L-6 to install private improvements consisting of planter walls to be located within the Cliff Drive public right-of-way. The Planning Commission approved the project as recommended. AYES: Ellmore, Kleiman, Koetting, Kramer, Lowrey, Weigand and Zak NOES: None ABSENT: None ABSTAIN: ACTION: Approved 12-1 Planning Commission Agenda Report for May 23, 2019 May 28, 2019 Page 2 PUBLIC HEARING ITEMS: ITEM NO. 3 GOETZ RESIDENTIAL CONDOMINIUMS AND VARIANCE (PA2018-138) Site Location: 358 Dahlia Place SUMMARY: The applicant requests a coastal development permit (CDP) to demolish an existing single-family residence and to construct a new two -unit residential condominium development. As part of the development, the applicant requests approval of a variance to reduce the required front setback along Bayside Drive from 20 feet to 8 feet and to increase the allowable floor area limit. The Tentative Parcel Map is required to allow each unit to be sold separately as residential condominiums The Planning Commission conducted a public hearing and approved the project as recommended correcting minor typographic errors to the resolution and changing the conditions of approval. AYES: Kleiman, Koetting, Kramer, Lowrey, Weigand and Zak NOES: None ABSENT: None ABSTAIN: Ellmore ACTION: Approved as amended ITEM NO. 4 REED RESIDENCE (PA2019-060) Site Location: 1113 Kings Road SUMMARY: A variance request to allow portions of a new single-family residence to exceed the allowed height limit due to the steep topography of the property. The Planning Commission conducted a public hearing approved the project as recommended. CONSENT ITEMS ITEM NO. 1 MINUTES OF MAY 9, 2019 Recommended Action: Approve and file ITEM NO. 2 TRIMAR PROPERTIES ENCROACHMENT (PA2019-064) Site Location: 2404 Cliff Drive Summary: A request to waive City Council Policy L-6 to install private improvements to be located within the Cliff Drive public right-of-way consisting of planter walls. Recommended Action: Find the project exempt from the California Environmental Quality Act (CEQA) Guidelines pursuant to Section 15303 Class 3 (New Construction or Conversion of Small Structures), because it has no significant effect on the environment; 2. Waive City Council Policy L-6, Encroachments in Public Rights -of -Way, to install noncompliant private improvements consisting of planter walls that encroach into the Cliff Drive public right-of- way, contingent upon all conditions of the Encroachment Permit process being met; and 3. Adopt Resolution No. PC2019-013 waiving City Council Policy L-6 and approving Encroachment Permit No. N2019-0211. VII. PUBLIC HEARING ITEMS Speakers must limit comments to three (3) minutes on all items. Before speaking, please state your name for the record and print your name on the blue forms provided at the podium. ITEM NO. 4 REED RESIDENTIAL VARIANCE (PA2019-060) Site Location: 1113 Kings Road Summary: A variance request to allow portions of a new single-family residence to exceed the allowed height limit due to the steep topography of the property. Recommended Action: 1. Conduct a public hearing; 2. Find this project categorically exempt under Section 15303, of the California Environmental Quality Act ("CEQA") Guidelines - Class 3 (New Construction or Conversion of Small Structures), California Code of Regulations, Title 14, Division 6, Chapter 3, because it has no potential to have a significant effect on the environment; and 3. Adopt Resolution No. PC2019-060 approving Variance No. VA2019-002. VIII. STAFF AND COMMISSIONER ITEMS ITEM NO. 5 MOTION FOR RECONSIDERATION ITEM NO. 6 REPORT BY THE COMMUNITY DEVELOPMENT DIRECTOR OR REQUEST FOR MATTERS WHICH A PLANNING COMMISSION MEMBER WOULD LIKE PLACED ON A FUTURE AGENDA.
