Minutes of REGULAR MEETING OF THE CITY COUNCIL
Date of Meeting: August 12, 1968

Roll Call:
The reading of the Minutes of the Regular Meeting of
July 22, 1968 was waived, and said Minutes were approved
as written and ordered filed.
HEARINGS:
Mayor Marshall opened the continued public hearing in
accordance with Resolution No, 6804, being a reso-
lution of intention to order the closing up, vacation and
abandonment of a portion of a certain street known as
Seafoam Drive.
A letter from Nancy D. Guilford requesting permission
to state views on subject vacation was presented.
No one desired to be heard on the matter.
The hearing was continued to 7:30 P.M., August 26,
1968.
2. Mayor Marshall opened the public hearing regarding
the appeal of O. V. Riley from the decision of the
Planning Commission granting Variance No. 942 to
Doris Irene Johnson for the extension of the front of
the house and an addition of second floor and pool at
2804 Ocean Boulevard, Corona del Mar, Lot 7 and
portion of Lot 8, Block 34, in an R- 1 Zone.
The appeal letter from O. V. Riley was presented with
the findings of the Planning Commission,
Planning Director Ernest Mayer, Jr. reported on the
findings of the Planning Commission. Robert
Humphrey, attorney representing the appellant, re=
quested that the matter go back to the Planning Com-
mission for further study.
The hearing was closed.
Variance No. 942 was referred back to the Planning
Commission for further consideration with the applicant
and the appellant, with Councilman Rogers' amendment
to refer back without prejudice.

Mayor Marshall opened the public hearing regarding the
appeal of H. M. Zeiger from the decision of the Plan-
ning Commission granting Use Permit 1382 to Don the
Beachcomber, Inc., 3831 to 3939 East Coast Highway,
Lots 28 -67 and portion of Lot 68, for the establishment
and operation of a restaurant on C -1 lots and off - street
parking on adjoining R -1 lot.
The appeal letter from H. M. Zeiger was presented
with the findings of the Planning Commission.
Planning Director Ernest Mayer, Jr. reported on the
findings of the Planning Commission. Traffic Engineer
Bob Jaffe reported on traffic conditions in the area.
Murton Willson, representing Don the Beachcomber,
Inc„ presented proposed plot plans. The following
people spoke in opposition to the granting of the use
permit without certain definite conditions being attached
thereto: H. M. Zeiger; R. W. Scholler; Mr`s. Polly
Rea; John Killefer, President of the Shorecliffs Com-
munity Association; Ed Jacklin, Vice President of the
Shorecliffs Community Association; and Hans Lorenz.
The hearing was closed.
Vice Mayor Parsons made .a motion to refer the matter
back to the Planning Commission for more concrete
recommendations on the traffic and the gully fence.
A discussion was had regarding amending the motion
for Council to establish the conditions. Vice Mayor
Parsons reworded his motion.
The findings of the Planning Commission were sus
tained, and Use Permit 1382 was granted, subject to
the conditions that the fence by the gully be solid
masonry and not less than six feet in height, that a
permit not be granted until a U -turn on Pacific Coast
Highway at Morning Canyon Road has been established
by the State Division of Highways and signallght modi-
fications made to accommodate the U -turn, and that
employee on -site parking be required.

4. Mayor Marshall opened the public hearing in connection
with the proposed Electronics Protection System Appli-
cation for Grant.
A memorandum was presented from the City Attorney
regarding legal aspects of the proposed system. A
letter from Forrest Fullmer requesting to speak at the
hearing was presented.
Patrick Therrien, representing Arinc Research Corpo-
ration, reviewed the background that led up to the
preparation of the Application for Grant and gave a
presentation on the technical aspects of the system.
Police Chief James Glavas summarized the system's
use to his department and pointed out that its functions
•
would be neither more nor less than a greatly expanded
police department.
The following people spoke from the audience in favor
of an electronics protection system in the City of New-
port Beach: Hans Lorenz; William Hanna, former
Arinc engineer; Dr. Nolan Frizzell, member of the
Newport Harbor Chamber of Commerce Legislative
Committee; John Frost; Dwight Gick; George Doubleday;
Jerry Wooter; Les Stefensen; Ralph Gerard, Dean of
UCI Graduate School; Mrs. George Buccola; Jim Petsch
Harold Garnsey, President of the Upper Bay Property
Owners Association; Dan O'Farrell, representing The
Irvine Company; Louis McCaslin, General Manager of
Arinc.
The following people spoke from the audience in oppo-
sition to an electronics protection system in the City of

Newport Beach: Forrest Fullmer, Jay Murley, Robert
Pinkerton, Ralph Benware, John Vaughn, Laurie
Darnall, Mike Peeken, Jill Murphy, Mrs. Hunting,
Audry Smart, Mr. Salvin and Bob Scott.
Mayor Marshall closed the public discussion with the
unanimous consent of the Council.
Councilman Gruber made a motion to approve the

Electronic Protection System Application for Grant as
prepared by Arinc Research Corporation, to authorize
the Mayor to sign and forward the application to the.
U.S. Department of Justice Office of Law Enforcement
Assistance, to the appropriate State planning agency and
to the California State Department of Justice, and that
a Council technical advisory committee be appointed
immediately following the approval of the grant request
and after notification is received by the City of Newport
Beach of such approval.

Chief James Glavas requested permission to release
the EPS material for use by other interested cities,
which request was de19.'yed untla later date.
George Buccola spoke from the audience and requested
that the matter be placed on the ballot in November.
It was the consensus of the Council that if a written
formal request were made, such request would be put
on the August 19 Agenda for Council consideration.
ADDITIONAL BUSINESS:

1. A report from the Coastal Municipal Water District
Study and Advisory Committee regarding Phase II of
the proposed study of potential reservoir sites, trans-

mission lines, preliminary cost estimates, disposition
of costs to the benefiting areas and provision of time
schedules, was presented.
