Electronics Protection System: Mayor Marshall stated that the purpose of holding the EPS adjourned meeting was to determine whether or not, and ff.so.how, to place the question of the proposed Electronics Protection System research and testing on the November ballot. The following communications were presented: (a) letter from Allan Beek stating he believed most of the opposition to EPS stems from distrust of the police and suggesting a committee be appointed to study the situation so that it may be corrected; (b) letter from Francis W. Benson, Colonel, U.'S. M. C. (Ret), stating he felt the taxpayers had a right to ex- press their opinion of EPS and the measure should be placed on the ballot; and (c) letter from Kenneth C. Kingsley requesting that the question of TV surveil- lance be put to a vote of the people. A discussion was had as to whether the Council should consider the question of placing the issue on the November ballot first or if the alternate methods of how it could be accomplished should be determined fir St. City Attorney Tully Seymour presented a proposed resolution and an alternate resolution as the;m.eth- ods the Council could use to call a Special Municipal Election and to consolidate it with the statewide general election in November. Councilman Shelton made a motion that the Council determine not to place on the November ballot the question of whether or not the City of Newport Beach should apply for a grant of federal funds pursuant to the Omnibus Crime Control and Safe Streets Act of 1968. Councilman Rogers made a substitute motion that the Motion x matter of the Electronics Protection System Grant Request be placed on the November ballot. i The following people from the audience participated in a discussion of whether or not the Council should place the matter before the electorate: Jay Stoddard, former mayor; Dee Cook, former councilman; Faye It Edelblute, president of the Women's Division of the Newport Harbor Chamber of Commerce. B. McCaslin, Jr., Manager of the Western Divi- Arinc sion of Arinc Research Corporation, spoke from the audience regarding his request for permission to forward the Electronics Protection System Application for Grant to the California Department of Justice for its consideration and possible use in another city. Councilman McInnis made a motion to: (1) approve the Arinc request to file the Electronics Protection Systern grant application with the State, without Newport Beac endorsement, for the purpose of establishing a pri- ority position for the project; (2) approve action by Arinc to acquire an alternate agency or institution to sponsor the program and to urge them to look closely at the possibility of obtaining a non - profit institution to join them in the venture; (3) relinquish whatever rights in the application the City of Newport Beach ma have under one or more of the following conditions:, (a) acceptance by the State of the application filed by Arinc, for themselves or for another public agency, after the payment of $3, 500 to the City of Newport Beach; or (b) acceptance by the State of the application filed • by Arinc for or in behalf of a non-profit't't"i- tution without payment to the City but with an agreement to supply to Newport Beach copies of all reports and data developed as a result of the application; or (c) payment to the City of $3, 500. City Manager Harvey Hurlburt reported on the beach In erosion situation on the West Newport ocean front and stated that the U. S. Corps of Engineers had awarded a sandhaul contract and sandhauling would commence August 30.
