Mayor Hirth opened the public hearing regarding the appeal of Mary Caruso from the decision of the Plan- ning Commission denying request for a two -year extension of Use Permit No. 918 which allows the operation of a beer parlor establishment within 200 feet of an "R" District, located at 2000 West Balboa Boulevard, at the northwest corner of West Balboa Boulevard and 20th Street. Mayor Hirth opened the public hearing regarding Planning Commission Amendment No. 305, approved by Planning Commission Resolution No. 743, amendin, the Planned Community Land Use Plan and Develop - ment Standards for "Newport Place, " portion of Block 50, Irvine's Subdivision, located northerly of Bristol Street between MacArthur Boulevard and Birch Street, as requested by Emkay Development Co., Inc.; pur- suant to Municipal Code Section 20.51.070. A report was presented from the Community Develop- ment Director. Robert Alleborn, President of Emkay Development Company, spoke from the audience and briefly des- cribed the proposed amendments. A letter from Shell Oil Company objecting to subject ordinance was presented. Virgil McNab, representing the Western Oil and Gas Association, spoke from the audience and recom- mended several amendments to the ordinance. Assistant Community Development Director Jim Hewicker gave a brief staff report. The following people spoke from the audience express ing concern on various aspects of the proposed ordi- nance: Tom Sharp, Don Brown, George Perlin, Paul Royball and Ed Vanderbosh. A letter from Judy Tracy stating that the Citizens to Recycling Recycle Useable Discards (CRUD) would like to make Collectio a presentation to the Council on December 13 was Center presented with a report from the City Manager. Judy Tracy, representing the Citizens to Recycle Useable Discards, spoke from the audience. Mr. Johnson presented suggested designs for the proposed recycling centers. George Zebal spoke in support of the proposed recycling program. Councilman Dostal read in full Resolution No. 7573 R -7573 designating the Newport Beach Citizens Solid Waste Steering Committee as the policy and operating body Motion x of Newport Beach Environmental Quality Control Com dyes xxxxxxx mittee, which resolution was adopted. Motion x It was directed that $434 be appropriated out of the Ayes xxxxxxx Unappropriated Reserve for the items requested by the Citizens Committee in order to get the program started; the staff was directed to give liaison service up to two or three hours a week, at the discretion of the City Manager; and it was directed that a flyer be sent out with the water bill mailings. Z. A report was presented from the Public Works Di- Assessml rector regarding proposed Assessment District No. Dist 54 54 (Newport Heights and Balboa Alley Improvements). In answer to their inquiries, Ginger Page and Hal Glass were informed that the work would be done this summer and that the cost of relocating the water mains would be charged to the Water Fiend. Resolution No. 7576 declaring intention to order R -7576 the construction of certain street improvements in Assessment District No. 54 in the City of New- port Beach; declaring the work and improvement to be of more than local or ordinary public benefit, and describing the district to be benefitted by said work and improvement which shall be as- sessed to pay the costs and expenses thereof; and fixing the time and place for the hearing of objections to said work and improvement for January 24, 1972. Wright with Lido Is] attached letters, bearing signatures of 44 property Tennis owners, protesting the installation of flood lights for Courts tennis courts located at the southwesterly corner of Via Nord and Via Jucar on Lido Island, and requesting that provisions be made for City control of flood lights for tennis courts on R -1 properties. Bill Lusk, representing John Lusk and Company, and Robert Bein, Raub, Bein, Frost and Associates, spoke from the audience. Community Development Director Hogan gave a brief report on the noise standards and El Toro flight patterns over the area. Councilman Parsons made a motion to adopt the Final Map of Tract 7432 and to authorize execution of an agreement for the improvements in the Tract, which motion was withdrawn. Robert Bein, of Raub, Bein, Frost and Associates, requested that street name changes be incorporated in the Final Map. The matter was continued to December 27 for the recommended street name changes to be approved by the Planning Commission and added to the Final Map. 3. A report was presented from the Community Develop- ment Director regarding Tentative Map of Tract No. 7638, subdividing 47.3 acres into 109 lots for develop ment as single - family residential and one Z. 3 acre park site, portion of Blocks 55, 56 and 92, Irvine's Subdivision, located on Big Canyon Drive northerly of San Joaquin Hills Road and westerly of MacArthur Boulevard. The Tentative Map of Tract 7638 was approved, sub- ject to the conditions recommended by the Planning Commission. INDEX Tr 7638 4. ITEMS REMOVED FROM THE CONSENT CALENDAR: 1. A report from the City Manager regarding resolution authorizing execution of an agreement between the City of Newport Beach and Dual Fuel Systems, Inc. , in connection with conversion of a portion of City vehicles to natural gas, was diaried. 2. A letter was presented from the Parks, Beaches and Recreation Commission stating that five vacant lots on Cliff Drive, easterly of the Lutheran Church, are available for public acquisition as a view site in New- port Heights, and the Commission wants to go on record with the City Council identifying this area as one that should receive consideration for acquisition in the future. Councilman Kymla presented a letter from the New- port Heights Improvement Association which requested the City to give consideration to the purchase of sub- ject lots for a park. The matter was referred back to the Parks, Beaches and Recreation Commission for further study to advance, if possible, the acquisition of the lots. 3. The application for a Sound Amplifying Equipment Permit of the First Baptist Church, 2501 Cliff Drive, to use a Hammond Organ speaker just outside the stair door of the church to play appropriate Christmas music December 15 - 22 between 10:00 A.
