SPECIAL COUNCIL MEETING

Roll Call.
MINUTES
Mayor McInnis called the meeting to order and announced
the special meeting was being held to consider resolving
the question of acceptable unit density for the Versailles -
On- the - Bluffs development.
The meeting had been called and all Councilmen had been
personally notified pursuant to requirements set forth in
Section 408 of the Newport Beach City Charter.
Mayor McInnis adjourned the meeting to an Executive
Session for the purpose of considering settlement of a
lawsuit filed against the City in connection with the
Versailles project.
The meeting reconvened with all members present except
Councilman Ryckoff and Mayor Pro Tern Rogers.
City Attorney Dennis O'Neil_ read a prepared statement
regarding the history of the project.
Tom Peckenpaugh, attorney for the developers Donald J.
Scholz & Company, approved the compromise as set forth
in the draft Settlement Agreement and Stipulated Judgment
decreasing the density from thirty -four units per acre to
24.3 units per acre.
Leslie Reynolds, President of the West Newport Beach
Improvement Association, requested that no action be
taken until the Environmental Impact Report had been
reviewed and a public hearing had been held.
City Attorney Dennis O'Neil_ read a prepared statement
regarding the Environmental Impact Report.
Dick Clucas addressed the Council on traffic impact and
requested that no decision be made until November 13 so
the public could be advised.
Planning Commissioner Joe Rosener requested defers
to November 13 to allow time to hold the scheduled
meetings with community groups for the purpose of
establishing the desires of the communities regarding
density in their individual localities.
Judy Rosener questioned the urgency of making a decision
that evening.

Francis Horvath, Chairman of the Civic Affairs Com-
mittee of the Newport Harbor -Costa Mesa Board of
Realtors, urged the Council to honor its previous
commitment to the Donald J. Scholz Company.
The offer of Donald J. Scholz and Company to settle
the pending lawsuit, Superior Court Case No. 197119,
subject to the conditions and general terms discussed
that evening with the City Attorney and Attorney Tom

mental Impact Report hearing with a hearing on Use
Permit Application No. 1537 and the Height Limitation
Zone ordinance in relation to Phase II of the Versaille
on the Bluffs project.
