ADJOURNED COUNCIL MEETING
Place: Council Chambers

MINUTES
Present
Roll Call.
CURRENT BUSINESS:
1. City Clerk Laura Lagios submitted her Certificate of
General
Canvass as to the results of votes cast on April 9,
Municipal
1974, in the General Municipal Election, which
Election
Certificate is attached hereto and made a part of
these Minutes.
The City Clerk stated that the total number of votes
cast in the City was 9, 499 and that the following
Councilmen were elected:
District One Howard Rogers
District Three J. Peter Barrett
District Four Milan M. Dostal
District Six Lucille Kuehn
2. Resolution No. 8235, a resolution of the City Council
R -8235
of the City of Newport Beach reciting the fact of the
General Municipal Election held in said City on the
9th day of April, 1974 and declaring the result there-
of and such other matters as are provided by law,
with the City Clerk's Certificate of Canvass attached
thereto as Exhibit A, was presented,

Resolution No. 8235 was adopted.
3. The privilege of the floor was extended to Councilman
Kymla.
Councilman Kymla expressed his appreciation and
thanks to the Council and the staff for their cooper-
ation and performance during his term of office, and
he gave special praise to Mayor McInnis and City
Manager Robert Wynn.
City Attorney Dennis O'Neil stated that due to emer-
gency surgery, the newly elected Councilman from
District 6, Lucille. Kuehn, was unable to be admin-
istered the Oath of Office that evening. Pursuant to
Government Code Section 36503, the successful
candidate's predecessor would continue in office until
the successful candidate was qualified, which included
taking the Oath of Office; therefore, it was in order
for Councilman Croul to remain in office until Lucille
Kuehn could be administered the Oath.
Mayor McInnis, on behalf of the Council, presented a
bronze plaque to Councilman Kymla in appreciation
for his dedicated services to the City of Newport
Beach as Councilman from 1970 to 1974.

MINUTES
Mayor McInnis turned the meeting over to the City Clerk.
4. City Clerk Laura Lagios requested the elected candi-
dates to come forward. She administered the Oath of
Office, as prescribed in the State Constitution, and
delivered to each a Certificate of Election.
Councilmen Howard Rogers, Milan Dostal and J.
Peter Barrett took their seats at the Council table.
NEW BUSINESS:
1. City Clerk Laura Lagios presided as Chairman Pro
Tempore for the selection of Mayor and Mayor Pro
Tempore.
Councilman Barrett made a motion to postpone the
selection of the Mayor and Mayor Pro Tempore until
Lucille Kuehn was qualified and could be present.
City Attorney Dennis O'Neil stated that under the law,
the current Mayor would continue in office until his
successor was elected and qualified.
Councilman Rogers requested an amendment to the
motion to postpone to the next regular Council meeting
on April 22, which amendment was not accepted by
Councilman Barrett.
City Attorney O'Neil replied to a point of order that a
postponement should be to a time certain.
At the request of Councilman Rogers, Councilman
Barrett accepted an amendment to his motion to post-
pone to May 13. '
A vote was taken on Councilman Barrett's amended
motion, and the election of Mayor and Mayor Pro
Tempore was postponed until May 13, 1974 when the
newly elected Councilman, Lucille Kuehn, would be
present and could be administered the Oath of Office.
The City Clerk was directed to defer the administering
of the Oath of Office to Lucille Kuehn until it could be
administered at a Council meeting.
Chairman Lagios turned the meeting back to Mayor
McInnis.
The meeting was adjourned at 5:27 P. M.

CITY CLERK'S CERTIFICATE OF CANVASS
• I, LAURA LAGIOS, City Clerk of the City of Newport Beach,
County of Orange, State of California, duly authorized by
Resolution No. 8227 adopted by the City Council of said City on
the 25th day of March, 1974, do hereby certify that I have
canvassed the returns of the regular general municipal election
held in said City on the 9th day of April, 1974, and find that the
number of votes given at each precinct and the number of votes
given in the City to persons voted for, the respective offices for
which said persons were candidates, and the number of votes for
and against the measures were as listed on the attached.
