Mayor McInnis opened the public hearing regarding Tract 8638 Tentative Map of Tract 8638, establishing one lot where six lots now exist so as to permit the conversio of six apartment buildings into a 36 -unit condominium development, located at 1184 -1256 Rutland Road on the east side between Mariners Drive and Bedford Lane in Westcliff, zoned R -3. A letter from Mrs. Hay Langenheim protesting the proposed condominium conversion was presented. Charles Eldridge, Richard Scott, Michael Ragot and Ed Kliem addressed the Council in opposition to the proposed conversion. Robert N. Joehnck, attorney representing Wilshire Equities, addressed the Council. Motion x The hearing was closed. Ayes xxxxxxx Motion x The hearing was reopened. Aye s xxxxxxx In answer to the Council's questions, Mr. Joehnck and Art Burdorf of Wilshire Equities discussed sound- proofing of the buildings. Motion x The hearing was reclosed. Ayes xxxxxxx Motion x Councilman Rogers made a motion to approve the Tentative Map of Tract 8638, subject to the conditions recommended by the Planning Commission. Vice Mayor Dostal stated for the record that he opposed this type of condominium and voted yes only on advice of counsel. Mayor McInnis opened the public hearing regarding Koll Center Planning Commission Amendment No. 430, request to Newport amend the "Koll Center Newport" Planned Community Development Plan to (1) eliminate "Service Station Site 2, " (2) increase the size of "Retail and Service Site 1, " (3) permit health or athletic clubs and pro- fessional or business offices as permitted uses within the retail and service center sites of the Planned Com- munity, and (4) accept an Environmental Document; located in Tract 7953, bounded by MacArthur Boule- vard, Jamboree Road and Campus Drive. . A report was presented from the Public Works Newport • Director regarding the Newport Shores Specific Plan improvement requirements. Shores Specific Plan Dana Smith addressed the Council and supported the staff recommendations. William Hall, property owner of property fronting the Coast Highway between Colton and Orange Streets, addressed the Council and protested the closure of the west side of Colton Street at this time. The construction of improvements on Coast Highway Motion x in West Newport by adjacent developers was waived Ayes x x x xx x x where the following conditions are met by the devel- oper: 1) dedication of a 15 -foot wide easement for alley and landscaping purposes (as shown in the Newport Shores Specific Plan), 2) construction of a 12 -foot wide alley, and 3) construction of a 3 -foot wide landscape strip and a screen wall; with the exception that at this time the 3 -foot wide landscape strip and screen wall be constructed across the easterly half only of Colton Street, and that an agree- ment be executed with William Hall, the above pro- perty owner, to the effect that when the property is remodeled, the screen wall will be constructed across • the westerly half of Colton Street at the developer's expense.
