HEARINGS: Mayor Ryckoff announced that the Council had agreed to take the first Agenda item, the Griswold hearing, out of order and hold the hearing after the public hearing regarding the Preliminary Budget. 1. Mayor Ryckoff opened the continued public hearing Newport regarding Planning Commission Amendment No. 506, a Center request of The Irvine Company to amend the Planned Corporate Community Development Plan for Corporate Plaza to Plaza permit general changes in the Land Use Map and (2091) Text on property bounded by Newport Center Drive, Farallon Drive, Avocado Avenue and East Coast Highway in the Planned Community, of Corporate Plaza; zoned P -C. Mayor Ryckoff opened the public hearing regarding Jane Parks the appeal of Jane C. Parka, Balboa, from the Appeal decision of the Planning Commission denying (2762) Modification No. 2227, a request to permit the construction of a six -foot slumpstone fence to replace an existing six -foot wooden fence which encroaches to one foot of the rear property line, where the Code requires a five -foot setback when abutting a ten -foot wide alley, at 1608 -10 East Balboa Boulevard between H Street and I Street on Peninsula Point; zoned R -1. Mayor Ryckoff opened the public hearing regarding Traffic Ordinance No. 1765, being, Phasing Plan AN ORDINANCE OF THE CITY OF NEWPORT BEACH 0 -1765 ADDING CHAPTER 15.40 TO THE NEWPORT BEACH (2873) MUNICIPAL CODE ESTABLISHING A TRAFFIC PHASING PLAN TO COORDINATE DEVELOPMENT OF CERTAIN PROJECTS WITH TRANSPORTATION FACILITIES IN NEWPORT BEACH. A letter with a copy of LEAF's amendments to the ordinance was presented. A letter from E. P. Benson was.presented opposing the ordinance. The following people addressed the Council in opposition to the ordinance: Gordon.Young; Glenn Martin; Peter Kremer, President of The Irvine Company; Rudy Barron, President of the Newport • Harbor Area Chamber of Commerce; Tom Morrisey, representing the Ford Aerospace & Communications Corporation, Aeronutronic Division; Lloyd Ross, representing Enterprise Construction regarding Corporate Plaza; and Stephen Gavin, President of Pacific Mutual Life Insurance Company. Budget as prepared.by the City 1978 -79 Manager for the fiscal year 1978 -79, pursuant to (2934) Section 1102 of the Newport Beach City Charter. A report was presented from the City Manager regarding the 1978 -79 Budget Check List. A report from the Friends of OASIS was presented regarding the May 12, 1978 packet addenda. A letter from N. H. Rousselot was presented opposing any reduction in paramedic personnel. Motion x The hearing was continued to Friday, June 16 at Ayes x x x x x x x 6:30 p.m. 6. Mayor Ryckoff opened the continued public hearing Griswold on the appeal of Mr. and Mrs. Donald G. Griswold Appeal from the decision of the Planning Commission (2924) denying Variance No. 1066, a request to permit construction of a single - family dwelling that exceeds the height limit in the 24/28 Foot Height Limitation District, with encroachment into required front yard setback on property at 2333 Pacific Drive, on the southerly side of Pacific Drive, adjacent to Begonia Park in Corona del • Mar, zoned R -1. A report was presented from the Community Develop - ment Department. Gordon Glass, architect representing Mr. and Mrs. Griswold, stated that the appellants were willing to continue the hearing. A report was presented from the Parks, Beaches Surfing and Recreation Commission regarding Ocean Front Regs Surfing. (281) The following people addressed the Council in favor of body surfing only between 40th and 44th Streets: Dick Clucas; Parks, Beaches and Recreatio Commissioners Mike Johnson and Gary Lovell; and Sue Picker. Motion x Councilman McInnis made a motion to postpone the matter to June 26. Motion x Mayor Pro Tem Williams made a substitute motion R -9362 Ayes x x x x x to adopt Resolution No. 9362 designating surfing Noes x x areas and establishing dates and hours when such surfing areas will be used, and rescinding Resolution No. 8844; and to review the matter the second meeting in September, which motion carried. 3. A report was presented from the ad hoc Committee Tract 9676/ on Open Space regarding the six acres of property Sea Island in the West Bay area. Park Keith Greer, representing The Irvine Company stated they were pleased to offer the property and concurred with the choice. • Dan Emory addressed the Council in favor of the location selected. A status report was presented from the Community Building Development Department regarding the development Moratorium of Bayside Square, Westcliff Grove, Bank of (2589) Newport and Civic Plaza projects. A report was presented from the City Attorney regarding vesting. A letter was presented from the Bank of Newport stating they have a vested right to proceed with their development. The following people addressed the Council in connection with the projects they represent: Wally Geer for Bayside Square who presented the Council with the findings of an independent traffic consultant; Dennis Harwood, attorney for the Bank of Newport; and David Neish of The Irvine Company regarding Westcliff Grove presented the Council with a traffic survey: Motion x David Neish was granted an additional five minutes as x x x x x x x for his presentation. 46A tiou x David Neish was granted an additional minute for Ayes is x x x x x x his presentation. Motion x Mayor Ryckoff made a motion that the rights of Civic Plaza were not vested with these findings: a) Civic Plaza Planned Community contains 26.12 acres. b) Approximately 85 per cent of the land within the planned community boundaries has not been developed. c) The only development in existence on the Plaza site relates to public and_quasi- public facilities which are distinguishable from other planned communities in Newport Beach. d) All improvements on the site other than the Art Museum and the library were installed prior to the Civic Plaza Planned Community text. •tion x Councilman Strauss made a substitute motion to postpone the matter of Civic Plaza's vesting to July 10. Peter Kremer addressed the Council and advised that The Irvine Company had accomplished the rough mass grading of the entire site and had paid for all of the roads surrounding the project. A report was presented from the Public Works BI Traffic Department regarding the Balboa Island Traffic Circulatn • Circulation Plan. Plan (2955) A letter from the Balboa Island Improvement Association concerning the circulation plan was presented. A later letter from the Balboa Island Improvement Association was presented requesting that the implementation of the Balboa Island Circulation Plan be delayed until after summer. 70 petitions from the Balboa Island Chamber of Commerce bearing 982 signatures were presented opposing the request for certain improvements. The following people addressed the Council in opposition to the circulation plan: Lewis Akerman, Jr.; Jack Hildreth, who presented seven additional petitions bearing 69 signatures and a sign; John Reeder; and Bob Yardley. Ed Siebel addressed the Council in favor of the circulation plan. The following people addressed the Council with other comments: Bob Millar, who suggested the plan be dropped; and Sue Picker stating that more notice should be given about new projects that are • started. Motion x A motion was made to approve the circulation plan, Ayes x x which motion failed. Noes x x x x x 6. Planning Commission appointments: Planning Comsn Motion x Councilman McInnis made a motion to consider in (530F) addition to the Appointments Committee recommends - tions the names of Helen McLaughlin for the term ending June 30, 1979 and Margot Skilling for the term ending June 30, 1980. Motion x Councilman Strauss made a substitute motion to Ayes x x x x refer the matter back to the Appointments Committee Noes x x x requesting they submit two nominations for each opening, which motion carried. CURRENT BUSINESS: 1. A report was presented from the Public Works Inspiration Department regarding Inspiration Point and Kings Point and Road View Parka, Contract No. 2005. Mayor Ryckoff requested the City Clerk to open and Legal Notices • announce the proposals received by her on or (547F) before the hour of 7:30 p.m. on June 12, 1978 for a contract covering the publication and printing of all legal notices or other material required to be published in a newspaper of general circulation published and circulated in the City of Newport Beach, for the fiscal year ending June 30, 1979. The City Clerk stated that three bids bad been received from the .Newport Harbor Ensign, the Newporter -Mesa News and the Orange Coast Daily Pilot. The Clerk opened the bids and announced the basic bid proposals as follows: Per Column Inch Newport Harbor Ensign $2.50 Newport -Mesa News $2.66 Orange Coast Daily Pilot $3.91 - $3.12 The City Clerk stated that the bids contained statements regarding type size and column widths. A letter dated May 15 to the Bicycle Trails Bicycle Citizens Advisory Committee from Thomas L. Trails Schulman tendering his resignation was presented. CAC . Motion x Mr. Schulman's resignation was accepted with Ayes x x x x x x x regret; the City Clerk was directed to send a Certificate of Appreciation; and (District 6) Councilman Hummel's appointment to fill the unexpired term of Thomas L. Schulman ending December 31, 1978 was postponed to June 26. 5. Board and Commission appointments for four -year Boards b terms ending June 30, 1982: Comsn Appts Motion x Mayor Ryckoff made a motion to postpone the recommendations of the Council Appointments Committee to June 26 for the Board of Library Trustees, the Civil Service Board and the Parks, Beaches and Recreation Commission.
