Mayor Ryckoff opened the public hearing regarding Height & Ordinance No. 1793, being, Density Regulations AN ORDINANCE OF THE CITY OF NEWPORT BEACH 0 -1793 AMENDING SECTION 20.02.050 OF THE NEWPORT (1279) BEACH MUNICIPAL CODE BY ADDING SECTION (e) THERETO RELATING TO HEIGHT OF STRUCTURES ON THE BLUFF SIDE OF KINGS ROAD AND KINGS PLACE, Planning Commission Amendment No. 523, a request initiated by the City of Newport Beach to amend Title 20 of the Newport Beach Municipal Code for the purpose of reducing height limits and pre- serving existing roof lines on the bluff side of Kings Road and Kings Place between Irvine Avenue and Dover Drive in Cliff Haven. A report was presented from the Community Develop- ment Department. A petition signed by 53 residents of Kings Road and Kings Place protesting the reduction of the height limit of structures only on the bluff side of Kings Road and Kings Place was presented. Letters opposing the propsed ordinance from James C. and Patricia Elms, Warren Howland and Bob Cooper, President of the Cliff Haven Community Association, were presented. A letter from William Nelson Gentry, attorney for one of the factions, was presented requesting a continuance to February 12, 1979. The following people addressed the Council in favor of the ordinance: Dr. Ralph Anderson; Barbara Roy; Joan Petty; Liz. Reimer; Alice Pobog; Bill Mader, Manager of Design Review for The Irvine Company, read a letter regarding the original tract restrictions; Tom Lally; Tom Henderson; Ruby Bertino and Phil Petty. The following people addressed the Council in opposition to the ordinance: Otto T. Wells; Robert Sicca, in behalf of Kings Road /Kings Place • Bluffowners Association; Ralph Shutt, also speaking for other members of the Bluffs Associa- tion; Warren Howland; Ray Wright and Les Miller. A proposed ordinance, being, Bluff Development AN ORDINANCE OF THE CITY OF NEWPORT BEACH Regulations ADDING SECTION 20.51.080 TO THE NEWPORT (3061) BEACH MUNICIPAL CODE ENTITLED "DEVELOPMENT OF BLUFF SITES" (RELATING TO PLANNED COMMUNITIES), Planning Commission Amendment No. 515, initiated by the City of Newport Beach was presented for introduction. A report was presented from the Community Develop- ment Department. A report entitled "Discussion of Slopes and Setbacks in Newport Beach," was presented from Mayor Pro Tem Williams. On March 12,1979, the Minutes of the Council Meeting Height & of January 22, 1979 in connection with Ordinance Density No. 1793 relating to the height of structures on Regulations Motion x the bluff side of Kings Road and Kings Place were (1279) Ayes x x x x x x amended to incorporate the following express findings Abstain x made by the Council in addition to the findings of the Planning Carmission: (a) The ordinance protects the public welfare and constitutes good planning and therefore is not spot zoning; (b) The ordinance will preserve and maintain the general character of the area and neighborhood; (c) The ordinance provides protection of public views and enhances the overall view value in the area; (d) The ordinance will not prevent the property owners fran developing down the bluff and, therefore is reasonable. Gene Atherton addressed the Council regarding the Dover Shores bluffs and suggested that all geological reports be considered in bluff con- struction as well as other suggested restrictions to be considered in bluff construction. All Ayes A vote was taken on Councilman Strauss' motion, which motion carried. 2. Ordinance No. 1787, being, Traffic Phasing AN ORDINANCE OF THE CITY OF NEWPORT BEACH 0 -1787 AMENDING SECTIONS 15.40.020 AND 15.40.040 OF (3006) THE NEWPORT BEACH MUNICIPAL CODE TO CLARIFY THE PURPOSE PROVISIONS AND TO ADD A DEFINI- TION OF "TRAFFIC MITIGATION MEASURES," was presented for second reading. A report was presented from Mayor Ryckoff and Mayor Pro Tem Williams, including a proposed revision of the ordinance. Mayor Ryckoff asked that the following statement be included in the record: • "Because we are ploughing new ground with a rather complex ordinance, it has been necessary to make refinements, as might be expected with new legislation of this scope. The changes proposed tonight clarify that road improvements can be included in traffic analyses and that trip reduction measures will be counted. The application of these measures will be specified in the Policy (Procedures) that will come before the Council shortly. It is not feasible, nor necessary, to include all details in the ordinance. "The intent is as follows: 1. A traffic analysis must be performed on any non - exempt project to determine whether the project causes or makes worse an unsatisfactory level of service at critical intersections. Such traffic analysis must be based on some specific point in time. 2. The traffic analysis will be for the point in time when the project or project phase is completed and ready for occupancy. That is, it will be • based on both the traffic and the circulation system that will exist at project completion. Thus, planned street improvements which are defined Volume 33 - Page 14 CITY OF NEWPORT BEACH COUNCILMEN MINUTES RAP 0p ROLL CALL\ s January 77_ 1979 INDEX • in the Circulation Element may be included in the traffic analysis if it is assured that they will be completed as the project is occupied. The method for assuring this and the basis for calculating the increased traffic capacity resulting from such street improvements will be contained in the Policy. 3. To evaluate the traffic impact of a project, the traffic volume generated by the project must be estimated. The Policy (procedures) will include procedures for performing traffic _ analyses and will establish standard trip generation figures for various categories of projects. Reductions in these standard trip generation figures can be allowed by the Planning Commis - sion, prior to the traffic analysis, if the developer proposes specific trip generation reduction measures that can be quantified and assured. 4. The concept is that although planned street improvements defined in the Circulation Element can be included in the traffic analysis for -a project if • they will be completed as the project is occupied, they are not improvements for a special project. Improvements to streets represent the efforts of the City and other public entities to reduce traffic problems. By contributing funds for planned street improvements a developer would be expediting the improvements so that they will be - installed when the project is completed, thereby allowing him to include the improvements in his traffic analysis. Finally, the ordinance as proposed and the resulting Policy will provide the mechanism whereby development and road improvements will be synchronized. The object is that within General Plan parameters we have traffic capacity to accomodate development, and that we allow development within the limits of traffic capacity." The following people addressed the Council: Robert Shelton of The Irvine Company asked for a straw vote by the Council to indicate Council support for the Mayor's statement; Richard Spooner asked for a copy of the Mayor's statement; Gordon Jones, representing The Irvine Company as a • consultant, suggested a few changes in the newly proposed ordinance, asked for clarification of some of the terms and that consideration of the ordinance be postponed; and Lucille Kuehn opposed the ordinance. Motion x Mayor Pro Tem Williams made a motion to reintroduce and pass to second reading on February 12 Ordinance No. 1787, being, AN ORDINANCE OF THE CITY OF NEWPORT 0 -1787 BEACH AMENDING CHAPTER 15.40 OF THE NEWPORT BEACH MUNICIPAL CODE TO CLARIFY THE PURPOSE OF THE ORDINANCE IN SECTION 15.40.020 ADDING OR CHANGING WORDING IN SECTIONS 15.40.030, 15.40.050 AND 15.40.070. Councilman Hart asked that the proposed ordinance be amended to change wording in Section 15.40.030 (D) (iii), which amendment was not accepted by the maker of the motion. Councilman Heather asked that the following statement be included in the record: "Let the record show that I am not supporting the motion in the absence of a staff report and the absence • of a policy which will allegedly make everything clear, I do not understand the ordinance and cannot vote to support it." A report dated December 20, 1978 was presented Council from the City Manager pertaining to proposed Policy Council Policy S -1 regarding the administrative (430F) procedures for implementing the Traffic Phasing Ordinance. A report dated December 13 was presented from Mayor Pro Tem Williams. Motion x Mayor Pro Tem Williams made a motion to continue - consideration of the administration procedures • regarding the Traffic Phasing Ordinance to February 12. Motion x Councilman Strauss made a substitute motion to Ayes x x x x continue the item to February 26, 1979, which Noes x x x motion carried. 4. A report dated December 20, 1978 was presented Transfer from the Parks, Beaches and Recreation Commission Station regarding a request for relocation of the Corona (2046) del Mar Main Beach transfer station. • A letter received after the agenda was printed from Dr. W. F. Dr. W. F. Robinson and Dr. Jack Larson addressed the Council in favor of the relocation. A report was presented from the Community Develop- Council ment Department regarding the results of the Right of Traffic Study prepared in connection with the Review/ proposal of Signal Development Corporation, Signal Oil Irvine, for general office buildings located at Company 4060 and 4100 Campus Drive and 4063 Birch Street; (3094) zoned M -1 -A. Roland Wedemeyer of Signal Development Corporation addressed the Council objecting to further delay. A report was presented from the Public Works Encroachment Department regarding the application of Andrew Public Glassel VII to construct retaining walls, a R -O -W/ sewer lateral, curb and driveway in Dahlia Dahlia Av Avenue and Bayside Drive adjacent to 400 Dahlia (3146) Avenue. Bill Baca, owner of adjacent property, addressed the Council regarding his own problems with • ingress and egress from Bayside Drive. Motion x Mr. Baca was granted five more minutes for his Ayes x x x x x x presentation. Khayatian for property Khayatian loss of ten precious stones which were (3154) allegedly taken by the Police Department when they arrested an employee of Mr. Peter Welch. The employee was arrested on October 1, 1978 at his home and the stones were in his possession at the time.
