The reading in full of all ordinances and resolutions All Ayes under consideration was waived, and the City Clerk was directed to read by titles only. D. HEARINGS: 1. Mayor Pro Tern Williams opened the public hearing Kalatschan regarding the appeal of Steve Kalatschan from the Appeal decision of the Planning Commission approving Use (3208) Permit No. 1897, the request of Vic Sherreitt to permit the construction of a commercial - residential complex in the C -1 District and the acceptance of an environ- mental document on property located at 114 - 22nd Street, on the southeasterly side of 22nd Street between West Balboa Boulevard and West Ocean Front in McFadden Square. The appeal application and the Declaration of Appellant in support of application to appeal decision of the Planning Commission regarding Use Permit No. 1897 was presented. A report was presented from the Community Development Department. William Waters, representing the appellant Steve Kalatschan, and Bill Tappan, in behalf of the applicant, addressed the Council. Vic Sherreitt and Brian Jeannette, architect on the project, addressed the Council. Motion x The hearing was closed after it was determined that All Ayes no one else desired to be heard. Motion x The decision of the Planning Commission was sustained, All Ayes incorporating by reference the conditions and findings of the Planning Commission. 2. A letter received after the agenda was printed from Patrick O'Connor was presented opposing the ordinance. The following people addressed the Council supporting the ordinance and /or the recommendations of the Planning Commission: Dr. Gene Atherton, Dorothy Parker, Margot Skilling, Lou Kaa of Hoag Hospital, Ninfa7arvis and Louise Greeley. David Simms, representing the State of California, addressed the Council and agreed to a continuance to a date in May. Motion x The hearing was closed after it was determined that All Ayes no one else desired to be heard. Motion x The Environmental Document was accepted, and Ordinance Ayes x x x x No. 1800 was adopted as recommended by the Planning �oes x Commission, deleting CALTRANS East. E. ORDINANCES FOR SECOND READING AND ADOPTION: 1. Ordinance No. 1798, being, AN ORDINANCE OF THE CITY OF NEWPORT Bluff BEACH ADDING SECTION 20.51.080 TO THE Development NEWPORT BEACH MUNICIPAL CODE ENTITLED Regulations "DEVELOPMENT OF COASTAL BLUFF SITES" 0 -1798 (RELATING TO PLANNED COMMUNITY DISTRICTS) (3061) Planning Commission Amendment No. 515, a request initiated by the City of Newport Beach to consider an amendment to Title 20 adopting regulations for blufftop developments in the Planned Community District, and the acceptance of an environmental document A report was presented from the Community Development Department. A letter received after the agenda was printed from Bill Nyholm and family was presented in support of the ordinance. Advance Planning Administrator David Dmohowski gave a brief staff report regarding the effect of prezoning. Ayes x A vote was taken on Councilman Heather's amendment, Noes x x x x which failed. Ayes x x x x A vote was taken on Councilman Strauss' main motion, Noes x which motion carried. 2. Ordinance No. 1801, being, Harbor Regulations AN ORDINANCE OF THE CITY OF NEWPORT 0 -1801 BEACH AMENDING CHAPTER 17.33 OF THE (386) NEWPORT BEACH MUNICIPAL CODE RELATING TO PIER FEES. A report dated February 26, 1979 from the City Manager was presented regarding harbor permit fees. Motion x Ordinance. No. 1801 was adopted. All Ayes F. CONTINUED BUSINESS: 1. A report was presented from the City Librarian regarding Library recommendations for a member and an alternate (474) member to the Santiago Library System Lay Advisory • Board. Motion x Mayor Pro Tern Williams made a motion to appoint Ayes x x x x Mrs. Robert E. Hilchey as the Member and Richard Noes x McFarland as the Alternate Member, as originally recommended by the Board of Library Trustees, and to adopt Resolution No. 9525 appointing a member R -9525 and alternate member to the Santiago Library System Lay Advisory Board, which motion carried. 2. A report was presented from the Community Development General Plan Department regarding consideration of Master Plan (673) of Streets and Highways and design alternatives for planned improvements, initiated by the City of Newport Beach, with recommendations of the Planning Commission on Circulation system revisions. A report was presented from the Transportation Plan Citizens Advisory Committee. Don Webb, Cooperative Projects Engineer, gave a staff report. Dick Clucas, Chairman of the Transportation Plan Citizens Advisory Committee, addressed the Council regarding the recommendations of the Committee. The following people addressed the Council in favor of overpasses and /or grade separations. J. Debra Allen, in behalf of the Broadmoor and Harbor View Hills Homeowners Association, addressed the Council and opposed any underpass concept, and endorsed C -6 as an alternative. Motion x Mrs. Allen was granted two additional minutes for All Ayes her presentation. Motion x Councilman Hummel made a motion to accept the General Plan Circulation Element revision as recommende by the Transportation Plan Citizens Advisory Committee, including the four points in connection with the San Joaquin Hills corridor as of May 10, 1976. Motion x Councilman Hart made a substitute motion to accept Ayes x x the recommendation of the Planning Commission Noes x x x to proceed with the review of land use alternatives consistent with circulation system capacity; to agree in concept with the grade separation with the understandin that it would be a last resort and that maximum intersec- tions will generally be nine lanes, which motion failed. Conversions / Council The following people addressed the Council and opposed Policy the Council Policy: David Neish, representing Daon (430F) Corporation; Richard Valenstein; Keith Greer, representing The Irvine Company; and Lake Trout. Motion x Mr. Trout was granted two additional minutes for All Ayes his presentation. John Harrison addressed the Council in favor of the proposed Council Policy. Motion x Council Policy T -1, "Condominium Conversions," Ayes x x x x was adopted, as amended, changing the vacancy Noes x rate from 5% to 3% and adding language to indicate that the Policy is only a temporary measure until a condominium conversion ordinance can be enacted, and that it will terminate not later than six months. G. CURRENT BUSINESS: 1. A report was presented from the Community Development Tracts 5463 Department regarding a request of the Bluffs Homeowners' & 5480 Community Association to amend the Declaration CC &R's of Covenants, Conditions and Restrictions as recorded on March 16, 1964. • The City Attorney presented a letter from The Bluffs Homeowners' Community Association stating that the request listed on the agenda had not come from them and asking that it be deleted or denied. A report was presented from the Public Works Npt Pier Department regarding the Newport Pier Ramp Ramp Reconstruction, Contract No. 2072. Reconstruc- tion Motion x The informality contained in the bid of Submarine R -9527 All Ayes Engineering Associates was waived; and Resolution (3196) No. 9527 awarding a contract to Submarine Engineering Associates in connection with the Newport Pier Ramp Reconstruction, Contract No. 2072, was adopted. 4. A report was presented from the Public Works Federal -aid Department regarding Orange County FY 1979 -82 Urban • Federal Aid Urban (FAU) Program. Systems Pr;,--;- R -9528 Motion x Resolution No. 9528, indicating to the Orange County (2743) All Ayes Transportation Commission that the City of Newport Beach is willing and able to implement the development of East Coast Highway from Bayside Drive to MacArthur Boulevard within the Orange County Federal Aid Urban Program and will include within the appropriate future budgets the necessary matching funds, was adopted. 5. A report was presented from the Parks, Beaches Vandalism/ and Recreation Commission regarding vandalism Public and destruction of publicly -owned property. Property (3225) Motion x The City Attorney was directed to take the necessary All Ayes steps to accomplish full financial restitution. 6. A letter from the Newport Outrigger Canoe Club Boat was presented asking permission to use the beach Storage facilities at 18th Street from April 1 to October 1 (1212) to store outrigger canoes and paddling equipment and as a home bas & for paddling workouts. A report was presented from the Marine Department. (3209) Motion x Councilman Hart made a motion to deny the request. Kerr for property damage to her car at Albertson's Market in Corona del Mar on February 28, 1979, allegedly because she was un- able to exit the parking lot in the proper way due to construction by the City. (d) Claim of Mark Winfield Moss for Brian Winfield Moss for reimbursement of bail bond premiums incurred in connection with the arrest of Brian on March 4, 1979. (e) Claim of Mark Winfield Moss for Martin Stephen Modiano for reimbursement of bail bond premiums incurred in connection with the arrest of Martin on March 4, 1979. Summons and Complaints: The City Clerk's referral to the insurance carrier was confirmed: (a) Summons and Complaint of Southern California Edison Company, Case No. 34423 in Municipal Court, Orange County Harbor Judicial District. The original claim was for property damage which occurred as a result of excavation activities allegedly being done by the City on June 13, 1978. (b) Summons and Complaint of Virginia B. Pearson for personal injuries, Case No. 308596 in Orange County Superior Court. The original claim was for personal injuries received when she tripped and fell on a City sidewalk in front of 4621 Fairfield Street in Corona del Mar which was allegedly in need of repair. (c) Summons and Complaint of Mohammed M. Khayatian for damages, Case No. 308375 in Orange County Superior Court. The original claim was for recovery of ten precious stones allegedly taken by the Newport Beach Police in connection with the arrest of Peter Welch. (d) Summons and Complaint of Fred Miller for Interference with Civil Rights, Case No. 79- 0738 in the U. S. District Court. There was no prior claim filed. The original letter for interference with Civil Rights was received August 9th and answered by Bill Brown, Safety and Insurance Administrator on the 13th of October regarding federal regulations for employment with the CETA program.
