Brown, City Clerk - 949-644-3005, (brown@newportbeachca.gov Jennifer Nelson, Assistant City Clerk Appointments to the Aviation Committee On March 26, 2019, the City Council adopted Resolution No. 2019-26 which amended the membership of the Aviation Committee and added a term limit of June 30, 2019 for current members. The new membership will be comprised of a total of 15 members: two (2) members of the City Council, seven (7) citizen members, one from each district, one (1) at -large member, one (1) member of the general aviation community, one (1) resident of Newport Coast if the District 6 or District 7 member is not a resident of Newport Coast, the President of the Airport Working Group (AWG) or his/her designee, the President of Stop Polluting Our Newport (SPON) or his/her designee and the President of Citizens Against Airport Noise and Pollution (CAANP) or his/her designee. RECOMMENDATION: a) Determine this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because this action will not result in a physical change to the environment, directly or indirectly; b) Confirm Mayor Diane B. Dixon's appointment of Alan Guenther as the District 1 Member on the Aviation Committee for a term expiring June 30, 2025; c) Confirm Mayor Pro Tem Will O'Neill's appointment of Hugh Logan as the District 7 Member on the Aviation Committee for a term expiring June 30, 2025; d) Confirm Council Member Brad Avery's appointment of Steve Byers as the District 2 Member on the Aviation Committee for a term expiring June 30, 2022; e) Confirm Council Member Duffy Duffield's appointment of Bonnie O'Neill as the District 3 Member on the Aviation Committee for a term expiring June 30, 2025; f) Confirm Council Member Kevin Muldoon's appointment of Thomas Meng as the District 4 Member on the Aviation Committee for a term expiring June 30, 2022; 19-1 Appointments to the Aviation Committee June 11, 2019 Page 2 g) Confirm Council Member Jeff Herdman's appointment of James Dunlap as the District 5 Member on the Aviation Committee for a term expiring June 30, 2025; h) Confirm Council Member Joy Brenner's appointment of Jeffrey Cole as the District 6 Member on the Aviation Committee for a term expiring June 30, 2022; i) Confirm Mayor Diane B. Dixon's appointment of Jack Stranberg as the At -Large Member on the Aviation Committee for a term expiring June 30, 2022; j) Confirm Mayor Diane B. Dixon's appointment of Stephen Livingston as the General Aviation Community Member on the Aviation Committee for a term expiring June 30, 2025; and k) Direct the City Clerk to advertise for the Newport Coast seat on the Aviation Committee. FUNDING REQUIREMENTS: There is no fiscal impact related to this item. DISCUSSION: At the March 26, 2019 City Council meeting, the City Council adopted Resolution No. 2019-26, which amended the membership of the Aviation Committee and states, in part, that the Aviation Committee shall consist of seven members, one from each City Council District, nominated by the District Council Member and confirmed by the City Council; an At -Large member, nominated by the Mayor and confirmed by the City Council; a member of the General Aviation Community, nominated by the Mayor and confirmed by the City Council; and a resident of Newport Coast, nominated by the Mayor and confirmed by the City Council if the District 6 or District 7 seats are not filled by a Newport Coast resident. The term of the District 2, 3 and 6 citizen members and the At -Large member is three years and shall be eligible for reappointment for two additional six year terms. The term of the District 1, 3, 5 and 7 citizen members and the General Aviation Community member is six years and shall be eligible for appointment to one additional six-year term. The Presidents of qualified community group members, or their designees, shall have an indefinite term, pending action by the qualified community groups. Those seats do not need confirmation by the City Council, as long as the community groups provide proof to the Aviation Committee Chairperson that they are a legally organized entity and provide the name of the President or authorized designee of their organization. Pursuant to City Council Policy A-2 (Boards, Commissions and Committees) and the Maddy Act, a Vacancy Notice was prepared by the City Clerk for posting and publication. The notice was posted in the City Clerk's Office, Central Library, on the City's bulletin board in the Council Chambers and on the City's webpage on March 28, 2019. The City Clerk's Office also published the notice on March 30, 2019 in the Daily Pilot. 19-2 Appointments to the Aviation Committee June 11, 2019 Page 3 Subsequent to reviewing the applications, the following nominations are being brought before the City Council for confirmation: Mayor Dixon has nominated Alan Guenther to fill the District 1 seat, Jack Stranberg to fill the At -Large seat, and Stephen Livingston to fill the General Aviation Community seat, Mayor Pro Tem O'Neill has nominated Hugh Logan to fill the District 7 seat, Council Member Avery has nominated Steve Byers to fill the District 2 seat, Council Member Duffield has nominated Bonnie O'Neil to fill the District 3 seat, Council Member Muldoon has nominated Thomas Meng to fill the District 4 seat, Council Member Herdman has nominated James Dunlap to fill the District 5 seat, and Council Member Brenner has nominated Jeffrey Cole to fill the District 6 seat. The Newport Coast seat will remain vacant until the Mayor provides a nominee for City Council confirmation. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). I serve on the Eastbluff Community Homeowners Association and also the current Aviation Committee. I have tried to play a part in reducing noise/pollution to our community. I keep our 460 residents informed as to what is going on at John Wayne Airport. it is important to communicate with them and keep them aware of the actual items happening at the airport as it affects them along with correcting their misconceptions of incorrect things that they might hear.
