PALL CALL. B. The reading of the Minutes of the Regular Meeting of January 12, 1981 was waived, and the Minutes were approved as written and ordered filed. C. The reading in full of all ordinances and resclu° tions under consideration was waived, and the City Clerk was directed to read by titles only. D. •FO:AP -1=9; 1. Mayor Heather opened the continued public hearing regarding the proposed local Coastal Program Land Use Plan and DevelopI Policies initiated by the City of Newport Beach for the Coastal Zone. A report VMS presented from the Planning Depart- ment dated January 19, 1981. letters were also presented from the following, which were rived after the printing of the agenda: Balboa Peninsula Point Association Robert M. Wolff, Engineer, Corona del Mar Joyce C. Zorger, resident, Costa Mesa Mayor Pro Tem Bart referred to her motion which had been carried over from the January 12 meeting to this ur�ting regarding Public Access, item 6, Page 10, and requested said motion be withdrawn. Councilman (bas entered the Cecil mssI at this time. Following omments by various Council Mmbers; with respect to some of their concerns with the land Use Plan, the Council decided to review said plan an a page-by-page basis and took the following Mayor Pro Tern Hart made a motion to amend first line deleting the word "acrd ", adding a comma after the word "roadways ", and adding the wards "and beaches" after the word "areas ". Volume 35 Page 15 l CP/I auud Use (68) Motion All Ayes Motion All Ayes .: x 0 0 MINUTES January 19, 1981 There being no objections, the staff was directed to define the words "Visitor- Serving Facilities" as requested by Mayor Heather. It was also noted that the "Housing" language set forth in the LCP is Ding rewritten for final consideration. There being no objections, the words "Ecological Reserve" were added to the first sentence following the words "upper Newport Bay ", as requested by Mayor Heather. Page 7 Mayor Pro Tem Hart moved to amend paragraph entity Analysis by adding the following words to the first sentence: "except for certain Paster Plan streets, water lines, and sewer facilities ". Page 8 No Changes Pam 9 No Changes Page 10 Mayor Heather made a motion to add the following language at the end of Item 5: "Dedicated access way shall not he required to be opened to public use until a public agency or a private association agrees to accept responsibility for maintenance and liability of the access way ". Councilman Maurer made a motion to amend Item 6 to read as follows: "The City of Newport Beach shall require the granting of access in new ccmrercial waterfront development except where such provision is inconsistent with Public safety, or the protection of fragile coastal resources, or where adequate access exists nearby. "This policy shall be implemented in such a way that it takes into account the need to regulate the time, Place, and marvaer of public access depending upon such circumstances as- 1) The capacity of the site to sustain use and at what intensity. "It is the intent of this policy to provide reason- able public access consistent with private property rights in new developments7. Page 10 continued: Councilman Cox made a motion to add as Policy No. 7 the following: "The City shall maintain a comprehen- sive signing program of City coastal resources including accessways, bicycle routes, public beaches and vista points ". Councilman Strauss made a motion to add as Poll Nc. 8 the following: "Develo ut shall not interfere with prescriptive rights . Mayor Pro Tern Hart made a motion to amend Item 4 of Public Property Leaseholds to read as follows: "W1m tidelands leases are renegotiated, they shall be at full market value and the monies shall be segre- gated in a separate fund and shall be used for acquisition, maintenance, and related visitor generated services of coastal properties to provide uses consistent with the Coastal Act, such as small boat launching facilities, acquisition of eanriron- mentally sensitive habitat areas, and other uses which may be consistent with the tidelands trust provisions ". Mayor Pro Ten Hart made a motion to make no further changes on Page 10. Pages 11 through 14 Mr. Lars de Jounge, 208 Marigold Avenue, Corona del Mar, addressed the Council at this time regarding the three privately owned lots on Ocean boulevard presently designated as Recreation and Environmental Open Space. He spoke in support of retaining the current designation but advised that a grading permit had been issued for comrancement of work on one of the lots. He sutmitted photographs of the subject property, and urged that a stop work order be issued immediately. The Director of Planning reported that he was at the site earlier in the day and determined that some grading had begun on the middle lot. As a result, a stop work order or correction notice was issued. In addition, the necessary mcroachment Permit had not been obtained. Volume 35 Page 17 �0l .. ' W T a� 5 .�1. M MINUTES January 19, 1981 LCP/Land Use (68) Councilman Hummel stated that he would like the staff as well as the Coastal Commission to report on the status of any applications to build upon the three subject lots. • During discussion the City Attorney advised that he would be submitting a report at the next regular Ming regarding the Council's concerns with respect to Inspiration Point and the three vacant lots which were expressed at the January 12 public hearing. Page 15 Mr. Ray Williams, 1723 Port Sheffield, addressed the Council and requested that the proposed extension of University Drive not be put back into the Local Coastal Plan. He stated that he supported the ration of the Planning Commission to delete it from the plan, and also felt it would be in violation of the Local Coastal Act to include it in said plan. Motion x Following discussion, Councilman Cox made a motion to include the extension of University Drive in the Local Coastal Plan, and that the project be evaluated during the environmental review process. Motion Mayor Heather made a substitute motion which was Ayes x x X x Xx accepted by Councilman Cox, to delete the words Noes x "except for University Drive which is specifically excluded from the LCP" from Item 1, and add the • senterce: "Future decisions on University Drive should be based on formal environmental and tech - nical analysis recognizing the proximity to the Upper Newport Bay Ecological Reserve ". Motion x Mayor Pro Tem Hurt made a motion to add the All Ayes following language to Item 3 of Page 15: "The City's Master Plan of Bikeways shall be implemented oancurrently with highway and street improvements consistent with the City's financial ability to do so and the availability of other funding sources. Bikeway improvements may be required as part of development approvals. The City will also work with the surrounding agencies for the development of connecting bO ys ". Motion x Mayor Pro Tem Hart made a motion to add the All Ayes following language to Item 5 of Page 15- "Wlementation of said plan is dependent upon the City's financial ability to do so ". It was noted that Item 5 c) on Page 15 had been amended at the January 12 meeting. Volume 35 Page 18 LCP/Land Use (68) • Motion All Ayes Motion All Ayes • Motion All Ayes • Ix CITY OF NEWPORT BEACH MINUTES Mr.Phil Tozier, Balboa Pavilion, addressed the Council regarding Item 6, Page 15 and 16, per- taining to restricting vehicular access to Balboa Peninsula. The Director of Public Works advised that the staff was currently engaged in preparation of a pre- liminary plan for Newport Boulevard which would include an analysis and upgrading of the traffic signals which had been authorized by the Council sometime ago. Following discussion, Councilman Cox moved to amend Item 6 on Page 15 and 16 to read: "in conjunction with the establishment of a coijre- hensive transit system in the City of Newport Beach, the Balboa Peninsula area shall be studied to determine a means of easing traffic congestion and improving circulation. Implementation of this possibility shall give due consideration to the Balboa Peninsula Business Areas". In response to question raised by the City Manager, the Council indicated that they did not wish to take any action with respect to Item 12, Page 5 of the January 19 staff report. Mayor Pro Item Hart moved to continue the public hearing on the kcal Coastal Program to January 26, 1981. 1 N` 1 51 1 l5. 1. Proposed Resolution authorizing Mayor and City Clerk to execute an Agreement between the City of Newport Beach and Walter E. Gi.11fillan for additional Technical Services in connection with John Wayne Airport, was deferred to January 26, 1981.
