"PARKING OF CERTAIN VEHICLES IN RESIDENTIAL
DISTRICTS AND RESIDING IN VEHICLES."
Report from the Assistant to the City Manager re-
garding the Recreational Vehicle Parking Ordinance,
was presented.
Letter from Taylor B. Grant with alternative sug-
gestions regarding subject ordinance, was presented
Letter from Mr. and Mrs. Marshall Braun regarding
the Recreational Vehicle Ordinance, was presented.

The City Manager outlined the recreational vehicle
parking restrictions contained in the ordinance,
which were prepared pursuant to Council directive
of June 14.
The following persons addressed the Council in
support of retaining the 84" width restriction
originally proposed:
Stuart Williams, 1748 Bayport Avenue
Bunty Justin, 206 Emerald Avenue
Robert Leper, 217 Amethyst Avenue
(Mrs. Justin and Mr. Leper stated that they
would support the 90" width restriction,
but only under protest)
Julia and Arnold Payne, 2808 Broad Street, address-
ed the Council in opposition to the Ordinance.
Shirley Moore, representing "The Good Sam Club,"
suggested the City Council consider a. "warning-
type" system for parking of recreational vehicles,
prior to adopting the proposed ordinance.
Hearing no others wishing to address the Council,
the public hearing was closed.

Motion was made to reintroduce Ordinance No. 82 -7,
as submitted, and pass to second reading on
July 12, 1982.
Motion was made to amend the ordinance to change
the width restriction to 84 ", which motion FAILED.
The motion on the floor was voted on and carried.
There being no objections, the staff was directed
to come back in six months with a status report on
the effectiveness of the subject ordinance.
E. PUBLIC COMMENTS:
1. Dee Dee Masters, representing Richard A. Nichols,
President, Corona del Mar Community Association,
addressed the Council regarding a letter they had
written on June 25, 1982, regarding budget alloca-
tions for Corona del Mar 5th Street park projects.
Mrs. Masters stated that their main concern is the
Youth Center facility and the development of the
Jasmine Creek park area as it relates to the OASIS.
The City Manager advised that the Youth Center was
budgeted in this current fiscal year for refurbish-
ment. Due to difficulties in arriving at an ap-
proved plan for the refurbishment, the project did
not go forward. However, the funds are reflected
in the 1982 -83 budget in a reserve account until a
plan is approved. As to a park in the area of
Jasmine Creek, the staff will meet with the commu-
nity associations to obtain their input when an
EIR or plan is further.developed.
F. The following actions were taken as indicated,
except for those items removed:

3. A letter from G. Di Sano regarding the "Bed Tax"
measure, was presented.
Council Member Maurer stated he felt Mr. Di Sano's
letter contained some reasonable suggestions with
respect to increasing revenue through user fees,
and therefore, made a motion to refer the subject
communication to staff for review and report back.
4. A report from the License Supervisor recommending
approval of Special Events Permits for those appli-
cations contained in said report, was presented.
The City Clerk advised that in addition to the
applications listed on the agenda, a request had
been made by the Fashion Island Merchants Associa-
tion for fireworks display on July 8.
Motion was made to approve Special Events Permits
as recommended, with the exception of the Balboa
Improvement Association.
Buzz Person, President of Balboa Improvement Associ-
ation, addressed the Council requesting his appli-
cation include sound amplification for three band
concerts to be held on July 4, August 8 and 29. He
stated that the musical group has a base guitar and
electric piano along with 38 trombones. The con-
certs to be performed by the "Bones West," will be
held at the Balboa Pier Gazebo, on Sunday evenings
at 6 p.m.
During course of discussion, it was noted that
Chapter 10.32 of the Municipal Code requires that
a permit for sound amplification be approved by
Council.
Following comments, motion was made to approve the
request of Balboa :Improvement Association for sound
amplification on July 4, August 8 and 29.
Council Member Hummel stated that he was going to
abstain from voting on the foregoing motion not
because he was strongly opposed to the request, but
that he was not comfortable in supporting it. He
indicated he felt that some people enjoy the beach
because of the sound of the waves and may not appre•
ciate music.
The motion was voted on and carried.
In response to question raised with respect to the
Council's approval of a live band concert held on
June 25, 1982 from 4 to 10 p.m., at 5105 Seashore
Drive, Council Member Plummer reported that she
had attended the event and was very pleased with
how the crowd behaved. She felt it went smoothly
and she was not aware of any police problems.

It was pointed out that pursuant to an appraisal

report, a range value of $1,350,000 to $1,650,000
had been established for the 18.41 acre parcel.
•
With respect to funding, and the realization that
General Plan Amendment 81 -1 could be delayed to
'November 1982, it was noted that, if GPA 81 -1 is
defeated, source of funding, which would be in-
lieu fees, would not be available for the subject
parcel. Therefore, it was recommended this item be
referred to the Parks, Beaches and Recreation
Commission with the thought that some of their
funds may be required if it is their desire to
pursue acquisition of the property.
Mayor Pro Tem Hart indicated she would like more
information from the staff and /or CALTRANS as to
the value that has been placed on the realignment
of Superior Avenue.,
The Director of Public Works responded that that
decision will be reached during this coming fiscal
year.
It was noted that the amount of right -of -way
needed for the road alignment is approximately
five acres, leaving a net of thirteen acres.

Report from Personnel Director, was presented.
Letter from Silver and Kreisler, Attorneys, on
behalf of the Newport Beach Fire Fighters Associa-
tion, was presented.
It was pointed out that the City's Negotiation Team
and representatives from the Fire Fighters Associa-
tion have been unable to reach an agreement for
Fiscal Year 1982 -83. The City's final offer con-
sisted of the following:
1) Total compensation increase -- 9.5%
2) Salary increase — 6.6%
3) Salary increase assumes a 75% Health &
Dental premium increase. The City will
•
adjust 1/1/83 up or down depending upon a
final premium increase.
4) Family sick leave: use of four (4) twelve
(12) hour shifts to include spouse, son or
daughter which requires the employee's
presence.
5) Resolution period: July 1, 1982 through
June 24, 1983.
The increased cost in total compensation of the
City's final offer would be $353,670. The Fire
Fighters Association's position as of June 8, 1982,
would cost approximately $741,633 annually.
Stephen H. Silver, 1428 Second Street, Santa Monica
Attorney representing the Fire Fighters Associa-
tion, stated that they were not asking the Council
to select between two competitive proposals. They.
felt that, for all intents and purposes, they have
not had an opportunity to actually negotiate with
the City's negotiating team. Mr. Silver summarized
their proposal, as set forth in his letter of June
8.

Beach Police Employees Association, was presented.
As stated in the staff report, the City's negotiat-
ing team and representatives for the Police Employe-
es Association have been unable to reach an agree-
ment for Fiscal Year 1982 -83. The City's final
offer consisted of the following:
1) Total compensation increase - Sworn: 10.5%
- Civilian: 9.0%
2) Salary increase:
a) Class -by- Class: - P.O. 3.4%
- Sgt. 6.1%
- Lt. 12.9%
- Capt. 10.7%

b) Civilian - 4.3%
3) Salary increase assumes a 75% Health and
Dental premium increase. The City will
adjust 1/1183 up or down depending upon
a final premium increase.
4) Family sick leave: expand definition of
current policy to include spouse.
5) Resolution period: July 1, 1982 -June 24,
1983.
6) Tuition reimbursement: Amend tuition reim-
bursement policy for civilian personnel
from the current 6 semester units or 9
quarter units to a maximum of $450 a
semester or $300 a quarter; maximum $900
for fiscal year.
The increased cost in total compensation of the
City's final offer would be $500,929 (includes
sworn and civilian personnel). The Police Employe-
es Association's position would cost approximately
$628,499.
Sergeant Paul Henisey, Communications Section
Supervisor and Member of the Police Employees
Association, addressed the Council and discussed
•
the negotiation process to date. He displayed a
visual aid which depicted the City's final offers,
(Proposals A 6 B) and the Police Employees Associa-
tion offer.

Captain Jim Gardiner of the Police Department ad-
dressed the Council and stated that the morale
within the department is very high, and the staff
is enthusiastic about their work. As a result,
their productivity has increased, which reflects a
safer community. For the first five months of
this year, they have lowered their seven major
offenses by 11 %. He spoke in support of their
proposal and indicated their willingness to work
with the Council and staff to resolve the differ-
ences.
Barbara Long, 1337 Galaxy Drive, Vice President of
Area II Community Congress, addressed the Council
and stated that she represented a volunteer organi-
zation consisting of representatives from the
various homeowners associations in the City. She
organizes and administers "Neighborhood Watch"
programs, and feels the community needs a strong
police department. She stated that the residents
want to retain the current personnel; continue
to attract the "cream of the crop," and urged the
Council to give consideration to the association's
proposal.
It was indicated the Council would also consider
the Police Employees Association's proposal in
Executive Session following the meeting.
K. ADDITIONAL BUSINESS:

1. Motion was made to schedule a public hearing on
August 9, 1982, for Use Permit No. 822 (Amended),
Traffic Study and Resubdivision No. 723, St. Andre,
Church.

2. Motion was made to extend completion date of con-
tract to July 15, 1.982, with Douglas Cavanaugh
relative to the Balboa Pier Concession, as recom-
mended by the City Manager.
The Council adjourned to an Executive Session at 9:50
p.m., to discuss personnel matters.
The meeting reconvened at 10:30 p.m., and adjourned in
memory of Carter McDonald, former member of the Library
Board of Trustees, and William Harbeck, former Chief
Building Inspector.
