TITLE: Ordinance No. 2019-11: Adoption of an Ordinance to Allow
Homeowners' Associations to Opt Out of Saturday Construction
Noise Restrictions and Temporary Construction Signage
Requirements
ABSTRACT -
On July 9, 2019, the City Council voted unanimously to introduce Ordinance No. 2019-11
amending the Newport Beach Municipal Code (NBMC) to allow homeowners'
associations (HOAs) having at least thirty (30) voting members and governed by a board
of directors to opt out of the Saturday construction noise restrictions and temporary
construction signage requirements in designated high-density areas. For City Council's
consideration is the second reading and final adoption of the ordinance.
RECOMMENDATION:
a) Determine this action is exempt from the California Environmental Quality Act
(CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines
because this action will not result in a physical change to the environment, directly or
indirectly; and
b) Conduct second reading and adopt Ordinance No. 2019-11: An Ordinance of the City
Council of the City of Newport Beach, California, Amending Sections 10.28.040 and
15.16.010 of the Newport Beach Municipal Code, to Provide a Process for

Regulations and Temporary Construction Project Signage Requirements.

DISCUSSION:
On July 9, 2019, the City Council approved the introduction of Ordinance No. 2019-11
(Attachment A). The ordinance allows HOAs consisting of at least thirty (30) voting
members and governed by a board of directors the ability to opt out of the Saturday noise
restrictions related to construction activity and the temporary construction project signage
requirements.
For HOAs to request to opt out of the designated high density areas, an HOA would
submit to the City Clerk a resolution or letter voted upon by their board of directors
requesting to opt out of the requirements. The City Council would consider the request
and may find, if granted, that exempting the geographical boundaries of the HOA will not
negatively affect the surrounding property owners.
ENVIRONMENTAL REVIEW:
This action is not subject to the California Environmental Quality Act (CEQA) pursuant to
Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable
indirect physical change in the environment) and 15060(c)(3) (the activity is not a project
as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations,
Title 14, Chapter 3, because it has no potential for resulting in physical change to the
environment, directly or indirectly. The adoption of the amendment does not authorize
new development or change the density or intensity of any potential future development.
