TITLE: 2018-2019 Playground Improvements Project— Notice of Completion
for Contract No. 7582-1 (19P01)
ABSTRACT:
On April 23, 2019, the City Council awarded Contract No. 7582-1, 2018-2019 Playground
Improvements, to R.E. Schultz Construction, Inc. (R.E. Schultz) of Orange, California.
The work is now complete and staff requests City Council acceptance and closeout of the
contract.
RECOMMENDATION:
a) Accept the completed work and authorize the City Clerk to file a Notice of Completion
for the project;
b) Authorize the City Clerk to release the Labor and Materials Bond 65 days after Notice
of Completion has been recorded in accordance with applicable portions of the Civil
Code; and
c) Release the Faithful Performance Bond one year after acceptance by the City Council.
FUNDING REQUIREMENTS:
The adopted budget included sufficient funding for this purchase. The construction
contract was expensed from the following account within the budget:

The work necessary for the completion of this contract consisted of removing and
disposing of existing improvements, including rubber surface and playground equipment;
furnishing and installing flexible play surface systems; installing City -purchased
playground equipment at Eastbluff, Channel Place and Cliff Drive parks; and other
incidental items to complete the work in place as required by the contract documents.
The design and play components installed at Channel Place and Eastbluff parks were
based on community input received at two public meetings. The improvements included
equipment with a modern design that provides limitless possibilities for kids' play and
increased accessibility for all users while promoting age-appropriate challenge and fun.
The 2018-2019 Playground Improvements Project was awarded to R.E. Schultz on April
23, 2019 with a Notice to Proceed date of May 3, 2019. The contract has been completed
to the satisfaction of the Public Works Department.

Two change orders were issued for this project and the final construction cost was less
than one percent over the original contract amount. The change order was due to two
unforeseen conditions at Channel Place Park. Once the half inch rubber -top surface was
removed from the existing playground and the new foundations were cut in for the new
equipment, it was determined that the remaining attenuating rubber layer should be
completely replaced in order to get a good and fully -warranted product. Additionally, the
contractor performed a manufacturer -approved necessary field repair on one of the
equipment components that was not included in the contract documents.

ENVIRONMENTAL REVIEW:
City Council found this project exempt from the California Environmental Quality Act
(CEQA) pursuant to Section 15301 —Class 1 (Existing Facilities) and Section 15302—Class
2 (Replacement or Reconstruction) of the CEQA Guidelines, because this involved
maintenance of existing facilities and reconstructed existing facilities on the same site as
the structure [facility] replaced. The project has substantially the same purpose and
capacity as the structure [facility] replaced.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item). In addition, the City Clerk will
be filing a Notice of Completion for the project as a result of this action.
