Brown Act. Among other things, the Brown Act requires that the Balboa Village Advisory Committee agenda be posted at least seventy-two (72) hours in advance of each regular meeting and that the public be allowed to comment on agenda items before the Committee and items not on the agenda but are within the subject matter jurisdiction of the Balboa Village Advisory Committee. The Chair may limit public comments to a reasonable amount of time, generally three (3) minutes per person. The City of Newport Beach’s goal is to comply with the Americans with Disabilities Act (ADA) in all respects. Please refer to http://www.newportbeachca.gov/bvac for additional information regarding the Balboa Village Advisory Committee. 2 CITY OF NEWPORT BEACH BALBOA VILLAGE ADVISORY COMMITTEE MINUTES Marina Park – 1600 West Balboa Boulevard Wednesday, May 15, 2019 – 3:30 p.m. I.CALL MEETING TO ORDER Chair Dixon called the meeting to order at 3:31 p.m. The following persons were in attendance: Balboa Village Advisory Committee Members: Diane Dixon, Council Member (Chair) Marcel Ford, Balboa Village Merchants Association Grace Dove, Central Newport Beach Community Association Colleen D'Aluisio, OceanQuest Representative Jim Stratton, At-Large Representative Staff Members: Jim Campbell, Deputy Community Development Director Mike Sinacori, Assistant City Engineer Benjamin Zdeba, Associate Planner II.PUBLIC COMMENTS ON NON-AGENDIZED ITEMS Kelly Carlson announced the Balboa Village Merchants Association is working on a mural project with Visit Newport Beach. Artist submissions are due Friday. Selections will be made on Monday, and the artists will be notified the following Friday. A media event, around the project, will be held shortly after the next BVAC meeting. The Balboa Village Merchants Association wants the City to reconfigure the pier parking lot. Deputy Community Development Director Jim Campbell reported the Coastal Commission will have to authorize reconfiguring of the parking lot. Bill Dildine noted the City has paved the parking lot next to the restroom, and it looks much better. He requested an update regarding the theater and the Mithrush building. Associate Planner Benjamin Zdeba advised that the theater project is moving forward, and the developer is preparing plans for the project. The Mithrush building is under construction. Mr. Dildine indicated construction on the Mithrush building has stopped because of financial problems. Brian Ouzonian added that the time for an inspection of the Mithrush building is close to expiring. If the inspection does not occur, the project will have to be re -permitted. III.ITEMS FOR REVIEW 1.MINUTES OF NOVEMBER 7, 2018 Recommended Action: Approve Minutes of November 7, 2018 Associate Planner Zdeba explained that the recording of the March 20, 2018 meeting did not capture approval of the November 7, 2018 minutes; therefore, the City does not have an official record of it. ACTION MINUTES OF APRIL 17, 2019 Recommended Action: Approve Action Minutes of April 17, 2019 MOTION: A motion was made by Committee Member Dove, seconded by Committee Member D'Aluisio, to approve the action minutes of the April 17, 2019 meeting as presented. The motion passed unanimously. 4. BALBOA VILLAGE PARKING STRUCTURE PRESENTATION BY OCEANQUEST Recommended Action: No Action Required Chair Dixon announced the item has been continued to the next meeting at OceanQuest's request. Brian Ouzonian requested information regarding the appearance of the structure and its size. Public parking is needed. Chair Dixon advised that the concept for the parking structure is under revision, and details are not known at the current time. The parking garage will be open to the public. The merchants should be involved in planning the project. Committee Member D'Aluisio requested comments or suggestions for the parking structure be emailed to her. 5. PARKING PERMIT PROGRAM AND OTHER PARKING UPDATES Recommended Action: No Action Required Fiscal Specialist Caryl Bryant reported the City currently has three parking permits: the master permit, the annual permit, and the Balboa Pier overnight permit. Current technology eliminates the need for a physical permit or permit decal, allows the transfer of a permit from one vehicle to another, provides online purchase or transfer of a permit, allows renewal of a permit 365 days after purchase rather than every January 1, and creates different pricing for off-season and peak-season parking. In response to questions and comments, Fiscal Specialist Bryant explained that an enforcement officer takes pictures of license plates, and the computer determines whether the driver paid for parking. Enforcement officers can walk or drive to check parking. Ass istant City Engineer Mike Sinacori clarified that officers walk to verify parking at coin meters. Coin meters will be replaced over time with pay points. Fiscal Specialist Bryant advised that coin meters are not part of the permit program. A vehicle par ked beyond the posted time limit at a coin meter can be cited even though sufficient coins have been deposited into the meter. If there is no posted time limit, the vehicle cannot be cited for exceeding the time limit. The notation of a time limit on a coin meter is not considered a posted time limit. Green curbs with a stenciled time limit and green-and-white signs stating a time limit are considered posted time limits. Vehicles with parking permits are subject to posted time limits. A paper citation is placed on the vehicle, and the citation provides information about appealing the citation. The photos and time stamps are evidence supporting the citation. The number of citations issued for exceeding a posted time limit has increased since the City implemented enforcement vehicles with mounted cameras in 2013. Staff can provide a graph of citations issued. Enforcement officers do not receive notification of vehicles exceeding the posted time limit. The computer system shows parking as paid or not paid. A seasonal parking permit could offer a lower price for winter months or for a longer period of time. Chair Dixon advised that the proposal for a residential 4 Balboa Village Advisory Committee May 15, 2019 Draft Minutes Page 3 parking permit program was dropped because the community did not support it. The Coastal Commission would not support a residential parking program on Balboa Island because of concerns about beach access. Committee Member Stratton remarked that Balboa Island has a 2 -hour time limit but no meters. The time limit does not apply to residential streets. Committee Member Dove indicated the parking system is a powerful planning, economic development, public relations, and coastal access tool that should be considered comprehensively. Kelly Carlson supported the use of time limits to encourage turnover of vehicles. Without a posted time limit, cars are parked in the same spot all day. Craig Batley believed the posted time limits should state citations will be issued for exceeding the time limit. Chair Dixon suggested the City allow drivers to obtain one 1-hour extension in a two-hour zone. Fiscal Specialist Bryant indicated the parking system can work with two hours or three hours, but not two hours plus one hour. Brad Ouzonian suggested different time limits for peak season and off season. He supported permit expiration based on 365 days rather than the calendar year Deputy Community Development Director Campbell reported the City Traffic Engineer works with merchants to propose time limits for Council adoption. Fiscal Specialist Bryant noted support for a virtual permit, expiration based on 365 days, and different pricing for off-season and peak season. A zone parking permit would allow a purchaser to choose the zones in which the permit is valid. Vehicles with zone parking permits would still be subject to posted time limits. Specific parking lots can be excluded from zone parking permits. 6. APRIL 17, 2019 WALKABOUT RECAP Recommended Action: No Action Required Assistant City Engineer Sinacori reported three trees will be planted to replace the three eucalyptus trees south of Main Street. Trash cans have been relocated, and the parking lot has been paved. Parking meters have been removed from the parking lot. A pay station will be added near the bike rack in a few day s. Enforcement of parking at red curbs on Main Street can be increased. Wayfinding signage will be presented at the Committee's next meeting. A landscape project for Balboa Boulevard , from 12th Street to Medina Way, is moving forward. Parking meters will be removed so that trees and landscaping can be planted. Kelly Carlson requested the work area, in the parking lot, be reduced if it cannot be removed by Memorial Day. Associate Planner Benjamin Zdeba advised that the facade improvement program is active. Identify key tenants; develop incentive program tailored for those tenants; obtain City Council approval of program and funding; outreach to owners and brokers to secure tenants. Ongoing effort. Not a formal program. 3. Support new cultural facilities (ExplorOcean/Balboa Theater). Ongoing, regular communication with entities to identify needs and opportunities; offer assistance in completing planning development application(s). Ongoing effort. In conjunction with Parks and Recreation Department, refine project scope and select consultant/promoter to prepare program and identify funding opportunities. Complete. Program to include public outreach and explore requirements from Coastal Commission. Eliminated from priority list. 6. Consider development of Palm Street parking lot for mixed- used project. As appropriate, obtain City Council approval to proceed with solicitation of a developer for the property. Eliminated from priority list. 7. Allocate additional funding to Balboa Village BID. Develop marketing strategies with input from BID and visit Newport Beach; and monitor implementation. Complete. Modify boundaries of Balboa Village BID to delete area from Adams to Coronado Streets. Requires ordinance to be approved by City Council.Complete. 1.
