Brown Act. Among other things, the Brown Act requires that the Zoning Administrator agenda be posted at least seventy-two (72) hours in advance of each regular meeting and that the public be allowed to comment on agenda items before the Zoning Administrator and items not on the agenda but are within the subject matter jurisdiction of the Zoning Administrator. The Chair may limit public comments to a reasonable amount of time,generally three(3)minutes per person. Please Note: All mail or written communications (including email) from the public, residents, or applicants regarding an agenda item must be submitted by 5 p.m. on the business day immediately prior to the meeting. This allows time for the Zoning Administrator to adequately consider the submitted correspondence. NOTICE REGARDING PRESENTATIONS REQUIRING USE OF CITY EQUIPMENT Any presentation requiring the use of the City of Newport Beach's equipment must be submitted to the Community Development Department 24 hours prior to the scheduled meeting. If in the future, you wish to challenge in court any of the matters on this agenda for which a public hearing is to be conducted, you may be limited to raising only those issues which you (or someone else) raised orally at the public hearing or in written correspondence received by the City at or before the hearing. Jackson Residence Coastal Development Permit No. CD2019-012 (PA2019-037) Site Location: 808 West Bay Avenue Project Summary A request for a coastal development permit to allow the demolition of an existing single-family residence and the construction of a new 5,740-square-foot, single-family residence including a 948-square-foot, attached 4-car-garage. The project includes augmenting the existing bulkhead to increase the height. No work will be conducted bayward of the existing property. The proposed development also includes additional appurtenances such as walls, fences, patios, hardscape, drainage devices, and landscaping. The proposed residence complies with all applicable development standards including height, setbacks, and floor area limits. No deviations are requested. Recommended Action 1. Conduct a public hearing; 2. Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15303 Class 3 (New Construction or Conversion of Small Structures) of the CEQA Guidelines, because it has no potential to have a significant effect on the environment; and 3. Adopt Draft Zoning Administrator Resolution No. _ approving Coastal Development Permit No. CD2019-012. 3. Engstrom Condominiums Coastal Development Permit No. CD2019-037 and Tentative Parcel Map No. NP2019-011 (PA2019-144) Site Location: 2324 Pacific Drive Project Summary A request for a tentative parcel map for two-unit condominium purposes. A two-family dwelling has been demolished and a new duplex is currently under construction. No waivers of Title 19 (Subdivisions) are proposed. The Tentative Parcel Map would allow each unit to be sold individually. The Tentative Parcel Map also requires the approval of a Coastal Development Permit pursuant to Title 21 Local Coastal Program Implementation Plan in the Municipal Code. Recommended Action 1. Conduct a public hearing; 2. Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15315 under Class 15 (Minor Land Divisions) of the CEQA Guidelines, because it has no potential to have a significant effect on the environment; and Zoning Administrator Meeting October 24, 2019 Page 3 3. Adopt Draft Zoning Administrator Resolution No. _ approving Coastal Development Permit No. CD2019-037 and Tentative Parcel Map No. NP2019- 011. 4. Annual Review of North Newport Center Development Agreement (PA2009-023) Site Location: Fashion Island; Block 100, Block 400, Block 500, Block 600, and Block 800 of Newport Center Drive; and San Joaquin Plaza Project Summary An annual review of Development Agreement No. DA2007-002 for North Newport Center, pursuant to Newport Beach Municipal Code Section 15.45.080 (Periodic Review) and California Government Code Section 65865.1. The Development Agreement executed in 2008 and amended in 2012, vested development rights for regional commercial, office, mixed-use and residential uses in North Newport Center and required public benefit contributions to the City. The Zoning Administrator will review Irvine Company's good faith compliance with the provisions of the Development Agreement between January 2018 and December 2018. North Newport Center includes the following sub-areas: Fashion Island; Block 100, Block 400, Block 500, Block 600, and Block 800 of Newport Center Drive; and San Joaquin Plaza. Recommended Action 1. Conduct a public hearing; 2. Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15321 (Class 21 - Enforcement Actions by Regulatory Agencies) of the CEQA Guidelines, because it has no potential to have a significant effect on the environment; 3. Find that the applicant has demonstrated good faith compliance with the terms of the Zoning Implementation and Public Benefit Agreement; and 4. Receive and file the North Newport Center Zoning Implementation and Public Benefit Agreement Annual Report Year 2018. 5. Campbell Residence Coastal Development Permit No. CD2019-035 (PA2019-142) Site Location: 605 Via Lido Soud Project Summary A request for a coastal development permit to allow the demolition of an existing single-family residence and construction of a new 3,015-square-foot, single-family residence with an attached 500-square-foot, two-car garage. The project includes accessory appurtenances such as walls, fences, patios, drainage devices, and landscaping. The property contains a private bulkhead which is proposed to be raised in conjunction with the construction of the project. The project complies with all Zoning Administrator Meeting October 24, 2019 Page 4 applicable development standards including height, setbacks, and floor area limits, and no deviations are requested. All proposed improvements are located within the confines of the private property. Recommended Action 1. Conduct a public hearing; 2. Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15303 under Class 3 (New Construction or Conversion of Small Structures), because it has no potential to have a significant effect on the environment; and 3. Adopt Draft Zoning Administrator Resolution No. _ approving Coastal Development Permit No. CD2019-035. 6. Bentley Residence Coastal Development Permit No. CD2019-045 (PA2019-172) Site Location: 119 Shorecliff Road Project Summary A request for a coastal development permit to allow the demolition of an existing one-story single-family residence and construction of a new two-story 6,055-square-foot, single-family residence with an attached 848-square-foot, four-car garage. The project includes accessory appurtenances such as walls, fences, patios, drainage devices, and landscaping. The project complies with all applicable development standards including height, setbacks, and floor area limits, and no deviations are requested. All proposed improvements are located within the confines of the private property. Recommended Action 1. Conduct a public hearing; 2. Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15303 - Class 3 (New Construction or Conversion of Small Structures) of the CEQA Guidelines, because it has no potential to have a significant effect on the environment; and 3. Adopt Draft Zoning Administrator Resolution No. _ approving Coastal Development Permit No. CD2019-045. V. PUBLIC COMMENTS ON NON-AGENDA ITEMS Public comments are invited on agenda and non-agenda items generally considered to be within the subject matter jurisdiction of the Zoning Administrator. Speakers must limit comments to three (3) minutes. Before speaking, we invite, but do not require, you to state your name for the record. The Zoning Administrator has the discretion to extend or shorten the speakers' time limit on agenda or non-agenda items, provided the time limit adjustment is applied equally to all speakers.
