Since applying for a Commercial Harbor Permit Application for a 300
passenger Coast Guard certified vessel, we have located a boat that
is immediately available for sale. She is Coast Guard certified for
250 passengers. Attached is a photograph of the vessel and the
specifications on her.
All information previously submitted is still accurate with the ex-
ception of the following:
ITEM #3 - MAXIMUM NUMBER OF PATRONS OR PASSENGERS
The maximum number of passengers anticipated for any meal fune-
tion will be 142 passengers per trip. The maximum number of
passengers for any cocktail/cabaret cruise will be 250 passen-
gers per trip.
ITEM #5 - PARKING AVAILABILITY
The vessel has a maximum of 2700 square feet of public space.
At the required established City rate of one (1) parking space
per 40 square .feet of public space, 67.5 parking spaces are re-
quired to accommodate a vessel of this size.
With the proposed remodeling of Yachting Associates (please sea
Attachment #3 of the original application) there will be 72
available on-site parking spaces, and if valot service is uti-
lized with tandum parking spaces, there will be 10 additional
parking spaces available on-site for a total of 82 on-site
parking spaces.

planned, and by having sufficient on-site parking available to han-
dle all passengers aboard, that this Application will receive your
immediate consideration and approval.

Dear Ms . Miller:
The Community Development Department has had several requests to
review land development and harbor activities permit applications
in the Mariners Mile area in the past few months . Your application
is one of these proposals , and the project has been evaluated by
the staff for possible environmental impacts .
There are several issues that are raised in each of the projects ,
such as adequate parking , traffic generation and circulation ,
conversion of existing land uses to office/restaurant/parking lot
uses , water quality, and compliance with the Mariners Mile Specific
Area Plan. An Environmental Impact Report was prepared in conjunction
with the adoption of the Specific Area Plan, but each project must
be assessed to determine if any new impacts may result from the
specific proposals which were not addressed in the EIR. The City
presently does not have sufficient data on file to make this
determination . The proposed project must also be evaluated in
light of the recently-adopted Traffic Phasing Ordinance .
In order to comply with the requirements of the California Environmental
Quality Act, and to make the mandatory findings regarding the
appropriate environmental documentation , we must prepare an Initial
Study. Since the information which you supplied to us and our own
evaluation did not provide sufficient data , our normal procedure
is to hire an environmental consultant to research the areas where
our data is lacking , and then to prepare the appropriate documentation.

We have contacted Westec Services , Inc . to prepare the Initial
Study. I would suggest that we set up a meeting , at your convenience ,
to discuss your project in depth with our staff and the consultant.
After this review, we will request a written cost estimate from
the consultant. You will be required to deposit this amount with
the City plus an administrative fee to initiate the work.

Arrangements Unlimited is requesting a Harbor Permit for a
United States Coast Guard certified, 300 passenger dining and caba-
ret cruise vessel to operate on Newport Bay. Newport Bay is unique
t and beautiful and the prime reason Newport Beach is considered a
resort area. People in Newport Beach would enjoy having the oppor-
tunity of cruising the Bay and viewing the life-style of the Harbor
Area. We would like to operate a cruise vessel that would allow
people to enjoy the beauty of Newport Harbor without interferittf
with the residents that live along the waterfront or those resiclahLs
of Newport that are enjoying the Bay aboard their own vessels.
We are conscious of the unique problems that are possible with
such an operation and have, therefore, thoroughly researched these
potential problem areas in order to totally eliminate them. The f
Harbor is as dear to us as the other residents of Newport Beach and
we, too, want to preserve our environment. i
f It is estimated that 75 percent of our business will be on a
chartered and pre-sold ticket basis which means that 75 percent o,°
the people utilizing the boat will arrive at the site by bus or by
groups in private automobiles.

The boat has been designed to be non-polluting and has an en-
r dosed glassed-in cabaret area to eliminate unwanted sound emi.ti:.i_nrJ
from the vessel.
The operation of this dining/cabaret cruise boat is dependent
upon approval of the Harbor Permit for its inception. Upon app,-Oval �
of the permit the boat will be ordered and all plans put into
tiun. It is possible that it will take up to one year for the pS:n-

DATE: June 26 , 1978
Arrangements Unlimited, Inc. , is applying for a license to
operate a dining and cabaret vessel on Newport Harbor. The method
of operation is described as follows in accordance to the informa-
tion requested on the enclosed application:
1. HOURS OF OPERATION
During the daytime hours the vessel will operate from 11AM
to 3PM on a chartered basis only. During the evening hours the
vessel will operate Prom 7PM to 8 : 30PM on a chartered basis and
a pte-sold dirihOf tidket bagig. Duing the night hour§ the Ves-
sel will operate from lOPM to midnight on a chartered and pre-
sold basis.
2. DAYS OF OPERATION
At the maximum, the vessel will operate on a daily basis,
year around. The daytime cruises (11AM to 3PM) will be sold
strictly on a chartered basis to groups such as: weddings,
school tours, receptions, luncheons, Senior Citizen groups,
etc. Therefore, there will be days when the boat will not op-
erate during daytime hours. Since the boat will be sold on a
chartered basis only during the daytime hours, the majority of
the passengers will arrive by chartered busses, thus eliminating
increased traffic congestion and a parking problem. Also, the
boat will dock by 3PM, prior to peak traffic flow on Coast High-
way.

The dinner cruise will be sold on a chartered basis and a
pre-sold ticket basis (tickets will be sold prior to the cruise
date) . The same type of cabaret/dining vessel ("The Buccaneer")
operating out of San Pedro during the summer months is sold-out
two months in advance. Because people can enjoy a good meal
aboard a quality vessel and in addition, cruise Newport Harbor
and enjoy its beauty, we anticipate that dinner reservations
will be sold-out at least two months in advance. This means
that people will arrive in groups because it is an evening they
have planned for with their friends. Passenger automobiles
should therefore contain four (4) to six (6) passengers each,
and larger groups will charter busses.
The cocktail cruise will be sold on a chartered basis ap-
proximately 75 percent of the time; the remaining 25 percent
that dP@ antieipat@d to
charter the vessel are: birthday parties, anniversary parties,
corporate incentive programs, convention groups, employee par-
ties for local companies, affinity groups, etc. Being sold on
a chartered basis helps eliminate parking problems and traffic
flow problems as discussed above.
3. MAXIMUM NUMBER OF PATRONS OR PASSENGERS
The maximum number of passengers anticipated for any meal
function will be 250 passengers per trip. The maximum number
of passengers for any cocktail/cabaret cruise will be 300 pass-
engers per trip.
4 . ROUTE OR ROUTES OF TRAVEL
The vessel will be restricted to the routes designated on

Harbor.

Yachting Associates proposes to remodel the existing facil-
ities in order to accommodate the boat operation and to safely
handle the embarkation and ddharkd�;i= 01 _Pa66bft9QVL (P16400
see Attachment #3 for an illustration of the proposed remodel-
ing) .
The location of Yachting Associates was selected as the em-
barkation and debarkation site for the following reasons:
A. PARKING AVAILABILITY
There will be 72 on-site parking spaces available after
the proposed remodeling. Because all boat trips will be
chartered or pre-sold, it is estimated that there will be
at least four (4) passengers per car and that many people
will arrive by chartered busses. Therefore, on-site park-
ing spaces can accommodate 288 passengers (72 spaces at 4
passengers per car equals 288 passengers) .
In addition to the 72 on-site parking spaces, we have
secured 80 off-site parking spaces across Pacific Coast High-
way from Yachting Associates at the following locations:

Therefore, we have a total of 72 on-site and 80 off-
site parking spaces equaling 152 parking spaces. At our

The vessel will have approximately 5100 square feet of
public space. The City of Newport Beach has determined that
one (1) parking space is required for each 40 square feet
of public space in a restaurant. At this established rate
the amount of parking spaces required for a vessel of this
size is 128. Therefore, we have 34 parking spaces above
the required number, if the vessel parking spaces required
are determined in accordance with the established restaurant
requirements for parking spaces.
The above parking availability is based on individuals
parking their own cars . It is feasible that valet parking
service will be-used if it is deemed more desirable at the
time the boat is put into operation.
B. ACCESSIBILITY OF LOCATION
Located on Coast Highway, Yachting Associates is easily
accesible by both bus and automobile without interference to
normal traffic flow. Traffic lights are presently located at

1. Coast Highway and Tustin Avenue, and
2. Coast Highway and Riverside Drive.
These lights will control the traffic flow and allow
busses and automobiles to depart safely from the property.

traffic lights) .
Yachting Associates proposed remodeling will also in-
clude widening of the driveway apron to allow the safe de-
parture of vehicles simultaneously onto Coast Highway in
both an easterly and westwardly direction.
C. HOURS OF OPERATION
It is known that Coast Highway has an unusually high

hours of operation have been scheduled so as not to inter-
fer with the peak traffic flow.
D. ACCESSIBILITY OF OFF-SITE PARKING
The off-site parking spaces which we have obtained are
located directly across Coast Highway from Yachting Associ-
ates. (Please see Attachment #1B for geographical location
of the off-site parking in relationship to Yachting Associ-
ates) . Also, two (2) pedestrian walks are located at Coast
Highway and Tustin Avenue with a traffic light controlling
the pedestrian walks so that boat passengers can safely
cross Coast Highway without interference to existing traffic.

destrian walks) .
E. COMMERCIAL AREA
Yachting Associates is located in a business district
and any noise made by passengers boarding and unboarding the
boat will not disrupt any residents of Newport Beach.

6 . TYPES OF ACTIVITIES TO BE PERMITTED ON BOARD
Following is a list of those activities that will be per-
mitted aboard the boat:
1. Dining (lunch and dinner)
2. Hors d' oeuvres
3 . Cocktails
4 . Entertainment
5. Dancing
It is realized that anytime alcoholic beverages are served
there is the possibility of over-indulgence. Arrangements Un-
limited is concerned not only with the reputation of the com-
pany within the City of Newport Beach, but also. its re§ponsibil-
ity to the pdssengers aboard the boat. Passeftger-s will cons-

passenger with signs of inebriation. All bartenders will be
instructed not to serve any passenger who has had too much to
drink and we will ensure that this policy is strictly enforced.
No alcoholic beverages will be allowed to be taken off the boat.
Liquor liability insurance will be carried in addition to the
normal liability insurance. (Insurance. is further discussed
below under Item #8) .
Entertainment aboard the boat will be both recorded and
live. During meal functions there will generally be recorded
background music, unless live entertainment is requested by a
group that has chartered the boat. Live entertainment will be
provided for the night-time cocktail/cabaret cruise. Entertain-
ment will be restricted to a self-contained area to prevent any
noise pollution in the Harbor. The volumn of live music will be
monitored constantly to ensure non-pollution of the Bay. Live
entertainment will be a versatile "middle-of-the-road" variety.

Rules applicable to the behavior of all passengers aboard
the boat will be posted at conspicuous locations throughout the
boat. (Please see Attachment #51 "Rules Applicable to All Pass-
engers" ) .
7 . TYPES OF MERCHANDISE TO BE SOLD
There will not be any retail merchandise sold aboard the
vessel. Only food and beverages will be sold to the public.
All food will be pre-sold, prior to the date of the boat' s de-
parture. Beverages will be purchased aboard the vessel or sold
at a package price prior to the date of sailing.

cruises, the price of the meal will be included in the pre-
sold package (meal plus boat trip plus perhaps cocktails) . When
a cocktail cruise is sold, two (2) cocktails will be included
with the package price. If an individual is hosting the party,
he will pay for the consumption of beverages at the conclusion
of the boat trip. -
Regardless of whether beverages are sold individually or
on a hosted basis, strict controls will be enforced to ensure
proper behavior of all passengers.
The food served aboard the boat will be of two categories:
lunch/dinner and hors d' oeuvres. Lunches and dinners will be
prepared in a catering facility and delivered to the boat for
final cooking and serving. Hors d' oeuvres will be prepared in
a catering facility and delivered to the boat for consumption.

8 . OTHER PERTINENT INFORMATION
A. LIST OF ITEMS TO BE PROVIDED
Prior to the operation of the vessel (dependent upon
the approval of the Harbor Permit) , Arrangements Unlimited
will furnish the City with copies of the following permits
and contracts:
1. City Business License
2. Liability Insurance Policy
3. Liquor License
4 . Liquor Liability Insurance Policy
5. U.S . Coast Guard Certification of Inspection
6 . Skippers Licenses for skippers who will be pilot-
ing the vessel

B. OFFICERS OF THE COMPANY
Arrangements Unlimited is a hospitality company. Even
though the company has been in existance for only three
months (incorporation papers were signed April 20 , 1978) the
partners have established backgrounds in the Newport Harbor
Area.
KATHY MILLER, president of Arrangements Unlimited, was
in the restaurant business for over 15 years and was general
manager of Western Canners Company (The Cannery Restaurant)
for four and a half years.
TOM STEMPER, vice president of Arrangements Unlimited,
has been a resident of Newport Beach since 1963. He is pres-
ident of TransPac Yachts and has been in the boating industry
for 15 years.
JEANNIE PECK, secretary of Arrangements Unlimited, has

been in the hotel industry for nine years, the last five
with Del Webb' s Newporter Inn as director of public rela-
tions and advertising.
GARY POELSTRA, treasurer of Arrangements Unlimited,
has a business background in investments. He was with
Hornblower and Weeks for six years and now has his own com-
pany, Poelstra Financial. He has been a resident of Newport
Beach for five years.
DESCRIBE THE MANNER IN WHICH YOU INTEND TO DISPOSE SEWAGE, TRASH AND
LITTER RESULTING FROM TI:tIS OPERATION:
Sewage will be held in holding tanks aboard the vessel and dis-
posed of at authorized sewage docks in Newport Harbor by means of
sewage pumps. All trash will be collected aboard the vessel and dis-
posed of in commercial containers. Trash will be picked up on a daily
basis (excluding Sundays) by a contracted disposal service.

Cook VII" is 96 ' long with a 28 ' beam and draws 6 .51 . The vessel is
powered by twin 16V71 engines each with 425 horsepower @ 1800 rmps.
There is approximately 5100 square feet of public space aboard the
boat. The vessel has the capacity of 13 knots. It is steel con-
struction; the holding tank capacity is 3, 000 gallons; the fuel ca-
pacity is 5, 000 gallons. The estimated cost of the vessel is
$1,000,000 .

to the use of parking spaces located at 2400 West Coast Highway,
Newport Beach, California, for the use of Arrangements Unlimited
in the event it obtains a commercial harbor permit from the City
of Newport Beach to operate a dining and cocktail cruise boat on
the Newport Bay. Upon obtaining such a permit you agree subject
to acceptable terms to execute parking space rental agreements
with us for the use of the above-described facilities.

Newport Beach to operate a dining and eooktail oruiso boat on
Newport Bay. Upon obtaining such a permit you agree to execute
dock and parking space rental agreement with us for the use of the
above-described facilities, including parking, dock, sewage and
trash disposal and other related maintenance facilities.
