HISTORY OF THE PROJECT On August 27, 1979, the City Council of the City of Newport Beach approved Tentative Tract 10391 (the original Aeronutronic Ford project) and later the Certified Final Environmental Impact Report for this project, whose applicants were Daon Corporation, Eagle Development Company, and the Aeronutronic Division of Ford Aerospace and Communication Corporation. (1) Final tract maps for Final Tracts 10986, 10987, and 11041 through 11048 inclusive within Tentative Tract 10391 were approved by the City of Newport Beach and recorded on September 19, 1980. In November 1980, J.M. Peters Company acquired all, of the residential parts of the original project. At its meeting on February 5, 1981, the Planning Commission reviewed a change in concept for development of the residential areas of the Aeronutronic Ford Planned Community. Tentative Tract Map of Tract 11377 and Amendment No. 559 were approved. On March 9, 1981, the City Council approved the Tentative Tract Map of Tract 11377, incorporating by reference the findings and conditions of approval recommended by the Planning Commission. (See Appendix E. ) An Initial Study was done in conjunction with the Tentative Tract approval . During the past few months, the J.M. Peters Company has requested that the City approve changes in the project, some of which could affect the environment. As a result, the City required that this Initial Study be prepared to evaluate the proposed changes pursuant to the State EIR Guidelines. Details follow. Peters Company has proposed several applications which are the subject of this Initial Study. The applications include: 1. Amendment No. 564 An amendment to the previously approved Aeronutronic Ford Planned Community District Regulations so as to reflect the deletion of a park site and increase the permitted number of dwelling units in Area 5 from 39 to 48 within the overall allowed 300 dwelling units for the District. The proposed amendment also includes changes to the Planned Community Development Standards involving ' garage setbacks from sidewalks and the location of future tennis courts. 2. Tentative Tract No. 11064 Request to subdivide 11.48 acres into 33 lots for singl'e family 1 residential development and 2 lots for private landscape purposes, where there were previously 33 lots for single family residential development, 2 lots for private landscape purposes and one lot for private recreational purposes. 3. Tentative Tract No. 11065 Request to subdivide 10.09 acres of land into nine (9) lots for single family residential development and one (1) lot for private open space and landscaping purposes. 6 B. Proposed Changes in the Protect The basic proposed changes are compared with the existing plan (Tentative Tract 11371) in the following table: Existing Plan Proposed Plan (TT 11371) (TT 11604) Number of Lots 33 33 production lots Size of Each Lot 10,000 sq.ft.± 8,100-18,500 sq.ft. Other Uses 10.09 acres for 1 lot, private park and Rugging open space and preserve landscaping * Five of the nine custom lots will be suitable for including tennis courts. ** The private recreation lot is deleted in Tentative Tract 11604 because the applicant has found from experience that residents in this type of project prefer the largest possible rear yard for their private recreation rather than using community facilities. Deletion of the recreation lot will not necessarily mean an added burden on public recreational facilities because the residents would prefer to use their own. 7 One of the conditions of approval (No. 46) for Tentative Tract 11377 requires that the 10-acre park site at the southwest corner of Bison Avenue and MacArthur Boulevard be dedicated to the City and rough-graded per City criteria. In addition, the City required the J.M. Peters Company and eventually the homeowners' association to maintain the public park. The Company feels that this arrangment would give rise to many potential prob- lems and legal questions. At the May 21, 1981 meeting of the Planning Commission, the Company re- quested consideration of the following alternative to Condition No. 46: (1) The Company will install and the•'association will maintain all landscaping on the perimeter slopes and buffer slopes between the park and the residential site. The perimeter and buffer slopes have an area of about 5 acres. (2) The Company will retain a landscape architectural firm, Lifescapes, Inc. , to prepare preliminary and working drawings for the flat area of the park. Those plans would be prepared under the direction of the City's Director of Parks, Beaches and Recreation. (3) The City will assume all maintenance responsibility for the flat park and Turkish Rugging areas (a total of about 5 acres) . (4) The City will analyze the Turkish Rugging area to determine if this natural area needs to be preserved or if it can be incorporated into the landscaped park area. The Parks, Beaches and Recreation Commission had approved the above alternative 1 conditions at their April 7, 1981 meeting. The Planning Commission sub- sequently approved the alternative conditions with the following wording: (A) The J.M. Peters Company, Inc. , shall install and maintain all land- scaping on the perimeter and buffer slopes of the park (except for the Turkish Rugging areas discussed below), until such time as the ' Homeowners' Associations are formed, who will then be responsible for the maintenance of said slope areas. The perimeter and buffer slopes are approximately 5 acres. 8 1 (B) That J.M. Peters Company, Inc. , shall retain a landscape archi- tectural firm to prepare preliminary and working drawings for the park. Said plans shall be developed under the direction of the Director of Parks, Beaches and Recreation, and shall be subject to his approval . (C) The City shall assume all maintenance responsibility for the flat portion of the park and Turkish Rugging areas, The flat park and Turkish Rugging areas are approximately 5 acres. At the June 22, 1981 meeting of the City Council , the Parks, Beaches and Recreation Commission was directed to report back on the acceptance of ' in-lieu fees, and the Staff was directed to report back on whether the Turkish Rugging is an endangered species and should be preserved, or if it can be incorporated into the landscaped area. At its meeting of July 7, 1981, the Parks, Beaches and Recreation Commission voted to recommend to the City Council that in lieu of land dedication the City collect a fee from the subdivider as provided under Chapter 19.50 of the Municipal Code. The Commission also recommended that the fee be based on the present median fair market value. On July 14, 1981, the City Council approved accepting in-lieu park fees (based on a previously determined value) instead of dedicating the park to the City and directed the applicant to prepare a tentative tract map for the site development. Several alternatives for use of the Turkish Rugging site are possible: (1) It can be left in its natural state and incorporated into the public park design with the brow ditch left in place to protect the site from irrigation runoff. (This alternative was rejected by the City's acceptance of in-lieu park fees. (2) It can be left in its natural state and the remaining area sub- divided into eight lots. 9 ' (3) The species can be removed or transplanted to another site (Environmental Nature Center?) and the acreage subdivided into ten lots. These alternatives are to be evaluated in a Revised Environmental Document to be prepared by the City. Another project change requested by J.M. Peters Company is within Tract 11041 at the intersection of Jamboree Road and Bison Avenue. Thirty-four lots were originally planned: 33 for residences and one for recreational uses. The developer requests that the latter lot be deleted and the residential lots be enlarged accordingly. (Tentative Tract No. 11604) The aforementioned proposed project changes could cause certain envi- ronmental concerns, specifically relating to the Turkish Rugging, noise, grading, aesthetics, and circulation. These are evaluated in the following section of this Initial Study. Vegetation ' Existing Conditions ' A rare and possibly endangered plant species was found near the northeast corner of the Aeronutronic Ford property and was reported in the Environ- mental Impact Report on that project. The plant was identified as Turkish Rugging (Chorizanthe staticoides ssp. chrysacantha). The previous applicants decided that it would be prudent to preserve the identified patches of this plant. To do this, the developer fenced the Rugging area and included it ' in a park dedicated to the City and to be maintained by the developer and eventually by the homeowner associations. ' This environmental consultant made several inspection trips to the Rugging site during the past year. The plants thrived inspite of the less than ideal winter weather. Individual plants are growing in isolated patches of ex- posed sandy soil with a few hardy ones among grasses. The project site is not the only occurrence of this plant. Nine other populations are known, ranging south to Laguna Niguel and from the sea bluffs at Pelican Point inland 5 to 6 miles. These individual populations are at the following locations:(1) San Joaquin Reservoir, Irvine Sand Canyon Reservoir, Irvine ' Pelican Point - Abalone Point, Crystal Cove State Park Moulton Meadows/Top of the World, Laguna Beach-Aliso Viejo Unnamed ridge east of E1 Toro Road, Aliso Viejo Wood Canyon, Laguna Beach-Al'iso Viejo Moulton Peak, Aliso Viejo Sheep Hills/Aliso Creek, Aliso Viejo Niguel Hill-Aliso Peak, Laguna Niguel (1) Letter to Dr. James P. Smith, Humboldt State University, Arcata, CA from Karlin G. Marsh, Biological Consultant, September 17, 1980. 13 ' At this point it is appropriate to clear up a little of the confusion ' about what constitutes a "rare and endangered species." The Second Edition of "Inventory of Rare and Endangered Vascular Plants of California" (published by the California Native Plant Society) removed Turkish Rugging from classification as a rare and endangered species. This caused concern among some biologists in Orange County who are familiar with its extremely re- strictive habitat and distribution. The First Supplement to the aforementioned publication classifies the Rugging as REVD 2-1-2-3. Following is an explanation of this code. REVD Code Rare and endangered plants are classified according to Rarity, Endangerment, Vigor, and Distribution. The classification is presented. as four numbers separated by three hyphens. The numbers range from 1 to 3. As an example, the current REVD code for Turkish Rugging (Chorizanthe staticoides Benth. ssp. chrysacantha) is 2-1-2-3. Definition of the classification system ' follows: Rarity: R-1 Rare but found in sufficient numbers and distributed widely �.a enough that the potential for extinction or extirpation A\ is low at this time. R-2 Occurrence confined to several populations or to one extended population. ' R-3 Occurrence limited to one or a few highly-restricted pop- ulations or present in such small numbers that it is seldom reported. 14 Endangerment: E-1 Not endangered. E-2 Endangered in a portion of its range. E-3 Endangered throughout its range. Vigor: V-1 Increasing or stable in, number V-2 Declining in number. V-3 Approaching extinction or extirpation. ' Distribution: D-1 More or less widespread outside California D-2 Rare outside California D-3 Endemic to California From this code, Turkish Rugging is considered as occurring in several populations. It is not endangered, but is declining in number and is endemic to California. (Special Publication No. 1 2nd Edition, California Native Plant Society, April 1981) ' Previous correspondence with the State of California Department of Fish and Game included the following information: (') "The California Native Plant ' Society has identified the Rugging as a "threatened" species. Federal and State Endangered Species programs are reviewing this and other plant species for which information is available. These species under review are not ' protected until they have been designated rare, endangered or threatened by the State Fish and Game Commission or the Director of the U.S. Fish and Wildlife Service." Impacts of Project As stated in Section II-B, the developer is requesting land use changes that would permit extending residences on to part of the property previously set aside as a park. This would destroy all or part of the Turkish Rugging. (1) Letter from Stephen P. Rae, State Plant Ecologist, California Department ' of Fish and Game, Sacramento, to Frederick G. Sawyer, Environmental Consultant, January 9, 1979. 15 1 The City has suggested three ways to maintain the Rugging: (1) Leave the Rugging within a fenced area on the property. (2) Leave the Rugging as a fenced preserve and subdivide the remaining area into residential lots. (3) Transplant the Rugging to another suitable site and sub- divide the property into residential lots (Tentative Tract No. 11605). ' Discussion ' 1. The undisturbed Rugging would be a valuable part of a park to show to the public an effort to preserve a plant that is unique to Orange County. The plant is small and unobtrusive, only showing its purple blossoms in the spring. From an environmental standpoint, there is little to quarrel about leaving the Rugging in its present location behind a protective fence. The brow ditch appears adequate to prevent surface runoff from sweeping across the site and washing away the Rugging. There may be some in- congruity in retaining this island of native vegetation within surrounding ornamental nonnative plants. The current wire fence provides some pro- tection, but whether calling attention to the rare nature of Rugging will ensure its avoidance by adventurous youths is open to question. Much of the success of retaining the Rugging will depend upon how the surrounding property is maintained and marked. If the plant is made the focus of an educational display describing the significance of preserving rare and endangered plant and animal species, then there is hope that the ' isolated plants will survive. At this time there is no way to predict how many people would visit the area or how effective the maintenance will be. These uncertainties are of concern. 16 2. The second alternative involves leaving the Rugging as is, but subdividing the adjoining property to the west into residential lots. This alternative retains the same concerns mentioned above. The open area will be smaller and the number of nearby residents will be larger. It is difficult to predict the effects of these differences. Certainly ' it would be advantageous to the developer to insert more residences on the property. There would probably be less surface runoff toward MacArthur Boulevard, assuming that the residence water would flow into the internal ' street and ultimately to the MacArthur Boulevard storm drain. ' 3. This alternative would remove the Rugging or transplant it to another site and then subdivide the property into nine residential lots. See Tentative Tract No. 11605. Removal of the Rugging without transpanting would create an unavoidable adverse environmental impact and would require the preparation of a Supplemental Environmental Impact Report in accordance with Section 15067 ' of the State EIR Guidelines. ' The plant requires a particular habitat to thrive: fine-grained sandy soil ; no interfering grasses; gentle slope facing south to southeast; no artificial irrigation, just minimal rain runoff. Some patches seem to be associated with ant colonies, but their relationship is not known. Several potential transplant areas were studied in the spring of 1980, and with the help of Gordon Marsh, biologist from the University of Cal- ifornia at Irvine, a remote campus site was selected for transplanting Rugging. A number of plants were removed from the project area, and along ' with some of the associated soil were placed at the campus site. 17 ' The rationale behind these actions was that if Rugging could be transplanted ' successfully in an area that would not be heavily impacted and could be assured of adequate protection, then the third alternative would be possible. Several inspection trips were made to the University plot during the past year, and in spite of the unfavorable weather of last winter some of the plants were thriving as of July 28, 1981. This field experiment indicates that Rugging can grow in another area when its unique habitat could be met. ' As expected during any such operation, some plants thrived and others were lost. No attempt was made to quantify the field experiment so that a numerical success rate is impossible to state. The main value of the field ' test was to see if any Rugging would survive the move to another location. Because some plants thrived, plans were made to a) assess the condition of the Rugging on the project site; b) collect plants and seeds from the project site; c) evaluate the Environmental Nature Center at Newport Harbor High School to see if any areas might be suitable to accept Rugging trans- plants;(1) and d) if such areas are availabl'e, arrange for the Center and the applicant to plant the Rugging in suitable soil removed from the project site. ' On July 30, 1981, representative Rugging specimens were collected from throughout the project site. The most prolific clusters were facing south on gently-sloping, sandy areas that were almost barren of competing vege- tation. ' The Environmental Nature Center was visited to evaluate potential habitats that would be optimal for growth and propagation of the Rugging. Most of the Center is unsuitable because of wrong exposure, clayey soil , competing vegetation, and active uses, however, two areas appear to be satisfactory. ' These are shown on the accompanying map. A third area needs further study. ' (1) See Appendix for letter from Rae L. X E3 � ¢�� , . Potential Transplant Site 00 91. 19 ' The northernmost site is at the lower edge of the desert-planted area near a gate. Some grading would be needed to level the land and remove ' the Eurasian grasses. ' The second site is at the extreme western end of the Center in an undeveloped area next to a low wire fence on 15th Street. Heavy grass growth would have to be removed, and since there is no gate, the fence would have to be taken ' down to allow entry of equipment. Rae L. Price, President of the Center, stated that a higher fence should be installed to ensure protection from trespass, and suggested that part of the project site fence be moved here. ' The two plots would each cover about 1000 square feet, but these areas can be changed to suit planting density recommended by the biological consultants. ' Soil from the park site would have to be added to each transplant plot and compacted somewhat before planting the Rugging. No irrigation would be needed to supplement the natural rainfall . The two plots are not shaded by large trees, particularly important in the case of eucalyptus ' which inhibit vegetative growth beneath their crowns. ' The Nature Center is willing to accept the Rugging and provide space and normal permanent maintenance. J.M. Peters Company would be responsible for the following: a. Provide and pay for a qualified horticultural consultant selected ' by the Center to supervise the entire process. b. Prepare the site at the Center to receive the plants. ' c. Provide all labor and materials for transporting and transplanting the Rugging. d. Provide all necessary permits or approvals by any agency involved. e. Become a member of the Environmental Nature Center as a "lifetime member" at a one-time cost of $250. 20 1 1 This maintenance method for the Rugging is acceptable based upon the following considerations: 1 (1) That transplanted Turkish Rugging will thrive in a suitable habitat. (2) That the Environmental Nature Center can provide competent and permanent maintenance of the transplated Rugging. ' (3) That J.M. Peters Company will accept responsibility for preparing the Center plots, transporting and transplanting the Rugging at ' the Center, and installing a suitable fence to protect the 15th Street plot. (4) That the Center can show to best advantage the Rugging as an educational exhibit to students and other visitors. The planted areas will show how a rare species is being preserved in the living state. An exhibit building at the Center can present by display ' and text the subject of rare and endangered species. (5) That recognition be given to the fact that Rugging is growing at nine other locations in Orange County (ten including the UCI plot). These could provide additional plants for other transplant plots. Mitigation Measures Some of the aforementioned considerations could be classified as mitigation measures, however, two others are specified below: (1) That a qualified horticultural consultant, approved by the City of Newport Beach, supervise any transplant process. ' (2) That the applicant pay for any costs and fees associated with transplanting the Rugging. 21 B, Noise Existing Conditions For preparation of the Aeronutronic Ford Environmental Impact Report, ' noise measurements were made at various locations throughout the project site. Contours of ,equal CNEL (Community Noise Equivalent Level ) were plotted for the values of 60, 65, and 70 dB in order to provide guidance for planning the development. Particularly critical was the 65 CNEL contour because of its restriction on residential planning. J.M. Peters Company proposes some development changes that require a ' new evaluation of the noise impacts. These were made and are discussed below. Impacts of Project The major project changes that need evaluation in terms of noise impact are a) addition of residences on the former park site; b) addition of a traffic signal at the intersection of MacArthur Boulevard and Bison Avenue; ' and c) addition of walls along MacArthur Boulevard. ' Predicting noise from future traffic (especially including the effect of a nonexistent traffic signal ) calls for extensive measurements of present ' conditions plus reasoned extrapolation. Factors to be considered include a) vehicular speed (approaching/leaving the signal and free-flowing higher- speed traffic) ; b) traffic volume; c) traffic composition (percentage of ' trucks) ; d) vehicle noise source (tires, engine) ; and e) distance from noise source. ' Traffic speeds along MacArthur Boulevard were recorded in a series of 3000 ' field measurements at various distances from the Ford Road traffic signal . This intersection was selected because it approximates conditions to be found at the Bison signal ; consideration was given to the fact that the former is a 4-way signal and Bison would be 3-way. The study shows that future highway noise from MacArthur Boulevard near the Bison Avenue signal will be substantially less than for free-flowing traffic studied earlier.(1) For slow-moving vehicles, where engine noise is dominant, interruptions in flow at an intersection may raise the noise level if there are many trucks. However, ultimate traffic is expected to include only 1.7 per cent medium trucks and 0.6 per cent heavy trucks, therefore, the noise behavior of automobiles will determine the noise levels heard by project residents. Field measurements show that for free-flowing higher-speed traffic (where tire noise is dominant) any reduction in speed greatly reduces the noise from each vehicle. After evaluating all factors, the 65 dB CNEL contour will range from 112 feet to 192 feet from the centerline of MacArthur Boulevard on ' Tentative Tract No. 11605, as shown on the accompanying map. Fourteen feet in from the eastern edge of Lot No. 5 would be exposed ultimately to a noise level of 65 dB CNEL or above (shaded area on the map). All other lots in the project between Bison Avenue and Ford Road are within the 65 dB CNEL contour. The complete report from the noise consultant is in the Appendix. (1) Revised 65 dB CNEL Contour Study, BioAcoustical Engineering Corp. , June 25, 1980. 24 The noise impact of traffic along Bison Avenue was determined previously.(1) The 60 dB CNEL contour was found to be 83 feet from the Bison centerline, based upon a traffic volume of 5100 vehicles per day (current volume plus project-generated volume) . From this datum, the 65 dB CNEL contour is calculated to be about 43 feet from the Bison centerline. It is not shown on the accompanying map because it is within the Bison right-of-way. The expected ultimate traffic volume would not change the location of the 65 dB CNEL contour significantly. It will be well outside the proposed residential lots along Bison Avenue. ' Although all the residential lots along MacArthur Boulevard (except Lot No.5 in Tentative Tract 11605) and those in Tentative Tract 11604 will be well within the 65 dB CNEL contour, the developer feels that future residents would like further noise attenuation. Toward that end, an 8-foot high solid wall of slumpstone is planned along the slope tops as shown on the accompanying map. A wrought iron fence is planned along Bison Avenue in ' Tentative Tract 11604. For all at-grade outdoor living space behind the solid wall , attenuation will be over 5 dB so that the one negatively-impacted lot will be within the 65 dB CNEL contour and all other lots behind the wall will be well below III that limit. Mitigation Measures An 8-foot high solid wall shall be built along the top of slope adjacent to MacArthur Boulevard and Bison Avenue, as shown on the accompanying map and proposed by the applicant. (1) BioAcoustical Engineering Corp. report, March 8, 1979, included in the Aeronutronic Ford Certified Final Environmental Impact Report, November 1979. 25 C. Grading Existing Conditions The approved grading plans are described in the Certified Final Environ- mental Report (November 1979) and on the related Tract Maps. Impact of Project Major changes are proposed for Tract No. 11043 as shown on the revised plan (Tentative Tract No. 11605). If approval is given to transplant ' the Turkish Rugging and delete the park, then pads will be graded to accommodate nine residences, including part of the former natural area. ' The brow ditch will be removed and the flat area extended as shown in the accompanying cross-section diagram. The Edison easements will be paved to allow access to poles on the property. The easement pavement along MacArthru Boulevard is planned ' as a bicycle trail. This replaces the former trail which meandered up the slope to connect with the park. The dimensions of the desilting basin at the extreme northeast corner ' of the tract will remain unchanged from the approved plan. Contours near the basin will be modified slightly to refine the slope and to accommodate the Edison easements. With the proposed lot configuration, the end lots will drain to the ' internal street instead of toward MacArthur Boulevard. This should ease somewhat the runoff burden in the desilting basin. 26 Tentative Tract 11604 proposes that the original plan (33 residential lots and 1 for recreation) be changed to 33 resisidential lots, each slightly larger because they will absorb the deleted residential lot. Part of the streets at the east and west ends of the tract will be moved closer, adding about 10 feet to the rear yards of the residences. Depending ' upon the dwelling unit placement, this additional setback may help slightly ' in reducing noise from Jamboree Road and the internal street. Mitigation Measures No new mitigation measures are required to supplement the City's conditions ' of approval relating to grading and drainage. r i I� 27 D. Aesthetics Existing Conditions The slopes facing MacArthur Boulevard between Bison Avenue and Ford Road ' are graded except for Tract 11043 containing the park site. The same is true along Bison Avenue. The wire fence surrounding the Turkish Rugging area is utilitarian. Impacts of Project Removal of the Turkish Rugging from the project site would eliminate the wire fence and the discontinuity of the island of native vegetation surrounded by the other vegetation specified in the landscape plan for the slopes facing MacArthur Boulevard. Although no landscape plan has been prepared for deletion of the Rugging area, the landscape architect should continue the perimeter plantings along MacArthur Boulevard so that there is a pleasant continuity between ' Ford Road and Bison Avenue. If residences are to replace the Rugging and associated natural area, ' special attention must be given to blending the perimeter plantings into the dramatic Canary Island Date Palm theme trees at the MacArthur-Bison corner. There should be no abruptness in vegetative feeling. ' With the changes proposed in Tentative Tract 11605, it is assumed that a solid wall will be continued along MacArthur Baoulevard, turning the corner to Bison Avenue and running to Belcourt Drive North. Tract 10141 is planned for 33 residences and a recreation lot with access provided by a circular street connecting with Bison Avenue. Impacts of Project As discussed in Section 1-B, in Tract 10143 the developer proposes to delete the park, transplant the Rugging, and prepare nine residential lots. These residences would be on a cul-de-sac connecting with B elrourt D.rive'North'.' Traffic generated by these residences would be not more ' than 100 daily trips. This is not considered a significant traffic impact and poses no circulation problems.(1) iTract 10141 was approved for 33 residences and one recreation lot. The developer proposes to delete the recreation lot and make some of the other lots slightly larger, but the nuber of residences will be unchanged. The internal street will have a somewhat different design, but there should be no circulation problems. (1) For security, a guard station is planned on an island in Beicourt Drive North and a traffic signal is planned at the intersection of Bison Avenue and Celtis Place. The removal of this taxon from listing in the second edition of the C.N.P.S. Inventory of n Rare and Endangered Plants is cause for concern among m the sall umber of people in this county who are familiar with its extremely restrictive habitat requirements and distribution range. The bulk of the rugging populations are on private land and given the ' reai estate situation down here, all privately owned populations are, in the absence of some official or quasi-official recognition, under :immediate or future threat of elimination. Ten population loci or isolated individual populations are presently known to me for the taxon. Distribution as currently documented, ranges from Newport beach south to Laguna Niguel and from the sea bluffs at Pelican Point inland Ca. 5-6 miles (Sand Canyon Reservoir, 61 Toro Road ridge) . All known populations are located on or in the vicinity of the San Joaquin Hills - Laguna Hills uplift. individual populations or population loci include the following, listed from north to south: 1. ford Aeonutronics Property/Bison Ave. R.O.W. , Newport Beach 2. I':vLn(l; ) wrs' the Niguel Hill.-Aliso Peak population locus, by Dr. Phal 42 Dr. James P. Smith, Dept of Biology 2 ' Rundel, (U.C. Irvine) , and Dr. Tom Meehan (V.T.W. , Inc.) . The Pelican-Abalone Point locus is a well known, historic collecting locality. . The type locality, "bluffs along coast, Laguna Beach" may no longer exist, because of subsequent urbanization. Although Goodmanl cites a single collecting locality for the nominate Chorizanthe staticoides within the C. S. chrysantha distribution (Crawford, May 51 1916, Pomona College Herbarium: "bluffs along shore, Laguna Beach." ) , he states that the range of the latter taxon is south of that of the former. The Crawford sheet would certainly warrant reexamination and possibly notation. My experience with C. staticoides staticoides is that its distribution in the county Ts centered around the Santa Ana Mountains uplift. I have observed it near San Juan Guard Station along Cal. Route 74, which • crosses the range, and also on the slopes of the Canada Grobernadora drainage in the Santa Ana Mountain foothills. Goodman cites an intriguing but woefully imprecise collecting locality "Hills near Santa Ana" (Geis, 1902, Dudley Herbarium. Geis apparently collected a. second now "lost"iChorizanthe at this unknown locality, C. parry; var. fernandina) . The taxon exhibits- definite substrate and exposure preferences. We usually find it on sandy marine terrace exposures. According to Robert Montgomery, a biologist employed by Orange County Environmental Management Agency who has been following the fate of C. s. . chrysacanthe, the substrate material can be the mid-Miocene Topanga Sandstone as well as quaternary marine sediments. Occasionally the taxon shows up on more gravelly material along with Dudleya multicaulis. (This may be of San Onofre Breccia origin.) At any rate, the sites are barrens, well drained and non-alkaline and they are almost always oriented toward the south or southeast. The taxon appears unable to compete with overshadowing forts and grasses. Dr. Fred Sawyer (a self-employed E. I . R. consultant) and I have periodically monitored the Ford 'Aeronutronics population since 1977. A three-year high-precipitation period since original discovery of the population has resulted in herbaceous overgrowth of most of the site. The Chorizanthe is hanging on, but its numbers are fewer and its distribution contracted from the 1977 setting. Some of us have also observed that site disturbance which effects a removal of competitive species is beneficial for the taxon. Based on the limited number of population loci , the restricted range and exacting exposure and edaphic requirements for Chorizanthe staticoides chrysacantha, I believe that you should again place it . .._ . in CNPS listing. At this time, it is not an endangered species; this situation may change with contemplated and future development. At this writing, so far as I know, the Pelican—Abalone Point, Ford Aeronutronics and some of the Aliso Viejo populations are protected. IGoodman$ George J. , 1934. Smith, Dept of Biology 3 I believe that the taxon should be included in List Three (Plants Rare but Not Endangered) in an early supplement to the Second Edition of the Inventory. A lot of work needs to be done with the taxon. Because of its somewhat shaky taxonomic standing, some careful morphological studies would be appropriate. Additional substrate analysis, along with, a quantitative ecological study and a determination of specific pollenators and seed dispersing fauna is also needed. I look foreward to preparing a formalized status report for Orange County Turkish Rugging, as discussed in our telephone conversation of September 8, 1980. As you know, the Environmental Nature Center, located adjacent to Newport Harbor High School, was established in 1972 as a sanctuary and learning facility of native California plants and wild life. It encompasses 2Y2 acres, including a stream, ponds, trails, amphitheater and resource learning room. Twelve native plant communities have been formed on the site, including the Coastal Sage Scrub of ' which the Turkish Rugging is a member. The facility is maintained with the help of the school district and volunteers from the community. It is open all year to the public and offers youth Nature Camp programs during the summer. ' We would like to propose that we would be willing to accept all or part of species in our Center and provide continued normal maintenance as currently provided in the Center. We will provide the space and permanent maintenance only. We would expect the City or the J.M. Peters Company to provide the following: a. Provide and pay for a qualified horticultural consultant to be selected by us for supervision of the entire process. b. Prepare the site at the Center which is to receive the plants under our direction and that of the qualified horticultural consultant. c. Provide all labor and materials for the transplanting and transportating of the species under the direction of the qualified horticultural consultant. d. Provide for all necessary permits or approvals by any agency involved. ' e. A series of three thousand "K" Band Doppler shift radar measurements were made of traffic speeds on MacArthur Boulevard at a number of distances from the signalized intersection with Ford Road. Statistical analysis was used to determine expected traffic speeds for any location on that roadway near an intersection. Speeds thus determined were then used in a proprietary computer program version of the Federal Highway Administration's Highway Traffic Noise Prediction Model, FHWA-RD-77-108, to predict the location of the 65 dB CNEL contour near the future signalized intersection of MacArthur with Bison for an ultimate traffic flow rate of 46430 vehicles per day. The 65 dB CNEL contour was found to range from 112 feet to 192 feet from the centerline of MacArthur Boulevard on Tract 11605 on the southwest corner of the Bison Avenue/MacArthur Boulevard intersection, as is shown in the following sections. ' INTRODUCTION Previous twenty-four hour noise measurements on the Ford Aeronutronic property, along MacArthur Boulevard, in the vicinity of the Ford Road ' intersection, showed a marked reduction in level 2 compared with noise levels away from the intersection. However, in earlier studies, these results were not generalized and applied to the future intersection at Bison since the corner property was proposed to be a park site. With the proposed change of use of Tract 11605 from a park-site to residential, it is critical to carefully determine the noise impacts for future years traffic flow rates, to assure land use compatibility for this more noise sensitive use. 1. I� 81/202 2 48 For slow vehicular speeds, where engine noise is dominant, interruptions in the flow for an intersection may raise the noise level when large percentages of heavy trucks are present. However, as was determined by field measurement, for free flowing higher speed traffic,with tire noise being the dominant source, any reduction in speed greatly reduces the noise emission level from each vehicle, as is shown by the FHWA Traffic Noise Model. Therefore, to predict 1 future years traffic noise levels from MacArthur Boulevard on Tract 11605, with interrupted, and therefore slower flow at the Bison Avenue intersection, it is necessary to determine the change in vehicular speeds near an intersection. In the following section, a radar detected vehicular speed study is described. The study was performed on MacArthur at Ford Road, the nearest representative signalized intersection to the unfinished MacArthur/Bison intersection. The speed information thus developed was then used to predict the noise impact at ' various distances from the Bison intersection along MacArthur Boulevard. VEHICULAR SPEED MEASUREMENTS On July 29, 1981, a set of traffic speed measurements were made along MacArthur Boulevard using a "K" band Doppler shift radar gun having an eleven degree sensitivity angle. Measurements were made of each vehicle or cluster of vehicles passing a location along the roadway. North and south bound lanes were measured separately, from each side of the roadway, for ten cycles of the traffic signal for each distance from the center of the intersection; starting with 100 feet and progressing out to a distance of 1300 feet north of Ford Road. A total of 3000 measurements were made. Table I presents the mean, standard deviations, and variance of the sample speeds for each location for north and south bound traffic separately. The standard deviation is greater nearest the intersection because there is a large speed difference between the vehicles that stop for the light and those that go through at full speed on green. Farther away from the traffic control light, its influence is less and the vehicles tend to have less variation in speed. The mean vehicular speeds approaching and leaving the stop light have been plotted in Figure 1 to show the relationship between speed and distance from the intersection for both traffic directions separately. These 1 data are used in the following section to determine the traffic noise levels. ACOUSTICAL IMPACTS The acoustical•,impacts to the property, shown in Figure 2, from MacArthur Boulevard were determined using the Federal Highway Administration's Highway Traffic Noise Prediction Model, FHWA RD-77-108. The ultimate traffic flow rate (ADT) of 46430 was used with medium trucks making up 1.7% of the ADT and heavy trucks accounting for 0.6% of the ADT 3 An iterative calculation procedure using the FHWA model was used to determine the unshielded traffic noise impact from the north and south bound lanes separately at 100 foot increments from the center of the future signalized intersection with Bison Avenue. Table II presents the results of these calculations, and Figure 3 displays the resultant 65 dB CNEL plotted on the Tentative Tract map.Lot 5 of the pro- posed development is shown to have a section approximately 14 feet wide along the top of slope along MacArthur Boulevard that would have an unshielded noise impact greater than 65 dB CNEL. However, as described in the next section, this impact will be mitigated. 3. For all at- grade outdoor living space in the area shown to be impacted by over 65 dB CNEL, the attenuation of this wall will be in excess of 5 dB, thereby reducing the outdoor noise exposure to less than 65 dB. CONCLUSION The results of an extensive radar detected speed study of vehicular traffic entering and leaving the intersection of MacArthur Boulevard and Ford Road show the basis for the observed, "reduced" CNEL impacts at that location, as was determined by on-site 24-hour measurements. The results of this traffic speed study along MacArthur Boulevard have been used to predict the traffic flow speeds and noise emission levels that can be expected to be encountered for ultimate traffic levels near the yet to be completed traffic signal controlled intersection of MacArthur with Bison. A calculated determination of the location of the unmitigated 65 dB CNEL contour shows one small portion of the proposed lot 5 would be impacted with levels above 65 dB CNEL. Using this value and a park , requirement of 5.64 acres for a 300-unit residential development, a park fee of $914,926.44 would be collected. However, the appraisal noted is in the process of being updated, and inasmuch as the Coun- cil has not had the opportunity to review the updated appraisal and establish a new value, and inasmuch as the in-lieu fee was waived by the Coun- cil when the Tentative Map was approved in August 1979, the staff recommended that any in-lieu fees collected now be based on the earlier value. In response to the Council's inquiry as to whether Turkish Hugging was deemed an endangered species, the City Manager reported that Turkish Rugging has been determined as a "threatened" species, but not an endangered species. Bob Trapp, representing the J. M. Peters Company, addressed the Council, advising that he had reviewe the staff report and did concur with the recommends tions contained therein. He stated that they pro- posed to remove and relocate, at their expense, the Turkish Bugging to the Environmental Nature Center at Newport Harbor High School so it can be pre- seryed. He noted that the preliminary plans includ ad with the report are just that, "preliminary" plans, and are to give the Council an idea of what they propose to do with the site. They would have to come back and file a tentative map and zone ' change at the time they process the 8 to 10 units. _ The fee of $914,926.44 is based on 300 units, and assuming they get 10 units on the park site, the fee is still below the 300 units, so there would not be an increase in the fee. In response to a question posed by Commissioner Thomas , Planning Director Hewicker stated that 1 the $914 ,000 park dedication fee was waived by the City Council because the homeowner' s associ - ation would be burdened with the responsibility o maintaining the public park . The Council did not feel justified in requiring them to pay the fee and maintain the park. ' Commissioner Allen asked why one-hal-f of the park will be located in the over 65 CNEL area . Mr. Webb, Assistant City Engineer, stated that the area outside of the 65 CNEL is in addition I to the required park dedication and contains the turkish rugging protected area . Commissioner Allen requested that Mr. Webb get back with her on this issue. Commissioner Allen expressed her concern regard- ing the possibility of a concrete block wall for ' the entire length of the project on MacArthur Boulevard. Planning Director Hewicker stated that a wall is being proposed at a substantial distance from the right-of-way on MacArthur Boulevard , which will include a landscaped earthern berm. He stated that in the event a wall is built, there are standard provisions re- qu-iring the developer to build the wall a uni- form height and with uniform building materials . He added that if the wall is a concern of the Commission, the developer can be required to ' bring back a rendering of the wall prior to ob- taining building permits . Commissioner Thomas expressed his concerns with the changes in the application , since the prior approval , particularly that of the grading plan . Commissioner Balalis stated that the present ' applicant, JM Peters and Company, Inc . , may be able to eliminate some of the concerns of the Commission . He stated that ' the wall should be designed in such a manner so as to disperse the noise, rather than reflect the noise. ' The public hearing opened in connection with thes items and Mr. J .M. Peters , the applicant, appeared before the Commission. Mr. Peters explained the changes that have been made to the Planned Com- munity and the minor changes to the road circula- tion pattern. He stated that the proposed wall will be substantially set back from MacArthur ' Boulevard and will include a landscaped berm which will provide better sound attenuation.' He added that they would have no objections in bring- ing the wall design back for approval . ' Commissioner Allen stated that she is concerned with increasing the allowable fence heights and ' the placement of tennis courts on the lots along MacArthur Boulevard. Mr. Peters stated that the. lots' will be built by the individuals , but that the wall will be a part of the Master Plan and ' the responsibility of the developer. He stated that in consider.in•g the configurations and gradin of the lots , • they felt as though an eight foot wall would be appropriate for these lots . Commissioner Allen suggested discretionary ap- proval be required when the landscape plan is completed to scrutinize the treatments of the chain link fences around the tennis courts . Mr. Peters stated that there is a substantial grade change from MacArthur Boulevard to the lots in ' question. He stated that there should be no problem visually, when the landscaping is in place . Commissioner Allen suggested that dense landscaping be utilized to hide the tennis courts and chain link fencing . Mr. Bentley stated that they are concerned w-ith the silt problems , but that the applicant has worked well with the Country Club on this en- deavor. Mr. Peters referred to Condition No . 40 of the Tentative Tract Map, which requires a car wash facility, and requested that this condition be deleted for the same reasons it was deleted from Big Canyon Country Club. He stated that con- sidering the nature of the proposed development, he could not conceive of a car wash facility being utilized by the residents . He also stated that it would be a waste of property and an eye- sore. Mr. Peters stated that a $25,000 deposit has been ' made to help solve the silt ,problem. He stated that an erosion control plan is a "living" plan and they will continue to respond to the silt problems . Commissioner Thomas pointed out that silty water is presently being' pumped over the top of the dike into the bay. Commissioner Beek stated that this request pro- poses to change the height of the buildings by at least a full story , which is a substantial change in the character of the development. Mr. Peters stated that the additional height is needed to achieve the architectural design of the townhouses . He stated that it will be com- patible with the surrounding developments in the area . Commissioner Thomas suggested breaking down the ' project in terms of discussion into 3 phases : 1) residential 2) industrial , and 3) low-cost housing. Commissioner McLaughlin inquired whether the rent proposed are consistent with the ones proposed by the Orange County Community Housing Corporation , to which Mr. Morrissey replied that the Orange County Community Housing Corporation is using a table published by the County of Orange Environ- mental Management Agency , entitled Housing Afford ' ability Table providin� rental schedules based on 3 levels of income : i below County median , 2) a•t County median , and 3) 120% of County med- ian , at which the Ford-Aeronutronic project ren- tal schedule is at the low end of the Orange County Environmental Management Agency Housing Affordability Table , and that there will be no encumbrance upon the City with any State , County or Federal aid, and that the County Housing Com- mission is not controlling rental units , but is controlling resale units as an agreement with the City, based on median escalation and median in- come. Commissioner McLaughlin then expressed her discom- fort regarding the phrase , "Tenants presently oc- cupying property shall qualify under the adopted affordable housing guidelines . " . Commissioner Allen inquired whether there is a 1 way to weight the scale of criterion or eligibi - lity more heavily to those working in Newport Beach , to which Commissioner Balalis and Mr. Mor- rissey suggested 100%. -4- COMMISSIONERS \ MINUTES Special Adjourned Meeting _ August 16 , 1979 City of Newport Beach ()1 L CALL INDEX Commissioner Beek expressed his feeling that it was their job to set up the criterion in such a way that it does not pay anyone to quit their job in order to qualify, stating his preference to see no reference to Newport Beach City boundaries . Ralph Kennedy , member of the Board of Directors of the Orange County Community Housing Corpora- tion , appeared before the Planning Commission to state that incorporation occurred i year ago as a non-profit private corporation and that they are under contract for one project and negotiat- ing for 2 others , and that they would not want to displace someone who is there and might qualify for the very kind of housing they are trying to 1 increase the supply of, and arrangements and screening would occur. In response to a further question by Commissioner ' McLaughlin , Mr. Kennedy replied that there would be a recorded restriction that the property must be used only for that purpose and that Daon might ' possibly sell it to the City or Housing Corpora- tion or a private group , to which Commissioner McLaughlin replied that she would be reluctant to see the City go into housing , to which Mr. Morris- sey replied that there are other options . In response to a question posed by Commissioner Cokas , Mr. Morrissey replied that the renters would be screened to qualify, and would necessar- ily requalify annually. Commissioner Balalis posed a consideration whether their intent was to accept the concept and leave the administration as to what should be the City' s position, or take 1 of the 4 options to the City Council to accept at a later date , or a sug- gestion by the Planning Commission at a later date , or accept or modify the document before them presently . Mr. Morrissey commented regarding Commissioner Beek ' s suggestions , 1) suggesting that they sub- stitute the word "emp.loyee" for-the word "afford- able" in the agreement , 2) that the agreement be structured to assure that if the housing was trans- ferred to another organization , to assure that it be appropriately maintained , stating Commissioner Beek ' s preference that it become the property of the agency that administers it , rather than the property of Daon , and Mr. Morrissey stated Daon ' s willingness to transfer the property to a third party on the basis that the third party assume an encumbrance on the property , 3) consideration regarding the operation of the property , about which the City has the right to select from a list of 4 , with a possibility of increasing the length of the list , 4) regarding Paragraph 6 , Commis- sioner Beek suggested deleting all language after the second half .of the first sentence , to which Mr. Coffin responded that in order to obtain an ' injunction , sueing would be necessary , and Daon ' s intent was that injunction was the only relief, rather than sueing for damages . -6- ' C:UMMISSIONERS. Commissioner Allen inquired regarding the indust- rial portion as part of a Master Plan in planning for a number of years , commenting regarding the April 1978 report , in which Mr. Morrissey , Ford Aerospace and Communications Corporation , made a presentation on the square footage of the existing and proposed developments of Ford-Aeronutronics , the figures of which now are doubled. Mr. Morrissey responded that the figures used in the minutes were inaccurate. James Hewicker, Assistant Director-Planning , read from Resolution No . 9472 of October 1978 , regard- ing the Ford-Aeronutronics project. Commissioner Allen expressed her difficulty that it is , in fact, a less intense use, as the indus- trial portion covers almost the entire allowable in the P-C Text, as the physical density of the buildings is the same as the •previous plan . M. peak hour trips in addition to the present figure with the ad- dition of 1771 employees , leaving 4 intersections over acceptable levels ; and she commended the residential effort , but expressed her concern with the industrial effort. To create this balanced housing mix, the J.M. Peters Company, Inc. is proposing several modifications to the approved development plan. It is envisioned that these modifications will provide a significant improvement to the project. The following aspects of the development will remain as approved: 1. The 50 unit condominium project on Jamboree Road and Ford Road 2. The dedication of the park land at MacArthur Blvd. and Bison Avenue 3. The major road circulation system and the connections to Ford Road and Bison Avenue 4. The 65 CNEL setback lines on Jamboree Road and MacArthur Blvd. 5. The overall number of homes (a maximum of 300). '6. Participation in the Highway Action Team by the developer 7. The agreement between District No. 5, the Irvine Water District, and the City of Newport Beach. As the enclosed landplans illustrate, modifications to the development have occured in several areas, (please see land use plan, page 6). The custom lots adjacent to MacArthur Blvd, (area 5), have been increased in size from approximately 7$ 00 square feet to 10,000 square feet and have been reduced in number from 53 to 39. The single family detached, residences adjacent to Ford Road (area 2), have also been increased in size from an average of 6,000 square feet to 8,000 square feet and has been reduced in number from 67 to 54. In conjunction with these modifications, 110 townhomes have been placed in the circular shaped area near the corner of Ford Road and MacArthur Blvd, (area 6), and the area adjacent to the park and Bison Avenue (area 7), replacing 97 single family detached homes. The use of townhomes in these areas allows creative landplanning to occur incorporating a garden like atmosphere with attractive greenbelts and street scenes. Additionally, using townhomes has permitted' the custom lot and single family detached home areas to be increased in size with 13 of the custom lots now having the capacity to attractively accomodate rear yard tennis courts. Design for the townhomes (areas 6 & 7), will be similar in character to townhomes created at the Ridge at Mountaingate in Brentwood. Examples of the style of homes found at Mountaingate and specific land plans for areas 6 do 7 are included in this booklet. It is the intention of J.M. Peters Company regarding the Chorizanthe staticoides chrysantha (Orange County Turkish Rugging) native plants at the Philco/Ford site, I would like to restate our proposal for your benefit. As you know, the Environmental Nature Center, located adjacent to Newport Harbor High School, was established in 1972 as a sanctuary and learning facility of native California plants and wild life. It encompasses 2Y2 acres, including a stream, ponds, trails, amphitheater and resource learning room. Twelve native plant communities have been formed on the site, including the Coastal Sage Scrub of which the Turkish Rugging is a member. The facility is maintained with the help of the school district and volunteers from the community. It is open all year to the public and offers youth Nature Camp programs during the summer. We would like to propose that we would be willing to accept all or part of species in our Center and provide continued normal maintenance as currently provided in the Center. We will provide the space and permanent maintenance only. We would expect the City,or the J.M. Peters Company to provide the following: a. Provide and pay for a qualified horticultural consultant to be selected by us for supervision of the entire process. b. Prepare the site at the Center which is to receive the plants under our direction and that of the qualified horticultural consultant. c. Provide all labor and materials for the transplanting and transportating of the species under the direction of the qualified horticultural consultant. d. Provide for all necessary permits or approvals by any agency involved. e. Provide necessary minor irrigation modifications for new plantings off the existing irrigation system.
