REVOCATION The proposal to which this Schedule of Standard Contract Provisions is attached shall be considered revoked if acceptance -is not received within 90 days of the date thereof. ARBITRATION Any controversy or claim arising out of or relating to this contract, or the breach thereof, shall be settled by arbitration in Newport Beach, Cali- fornia, in accordance with the rules of the American Arbitration Association, and judgment upon the award rendered by the arbitrators may be entered in any court having jurisdiction thereof. Hewicker, Director FROM: Fred Talarico, Environmental Coordinator SUBJECT: Parking for St. Andrews Presbyterian Church Pursuant to your request, attached please find a drawing of the location for additional parking on the St. Andrews Presbyterian Church site per the City Council actions on this project. No formal design study was prepared by any member of the department related to the required on-site parking spaces. The 250 on-site parking space requirement came from the environmental documentation on this project. It was determined that without the additional parking an unavoidable adverse environmental effect on the neighborhood would occur and an Environmental Impact Report would need to be prepared before the City Council could take action on this project. This impact was mitigated through this and other conditions of project approval and the City was able to accept and certify a Negative Declaration for the project. We realize that parking structures are an expensive portion of any project. ANDREWS PRESBYTERIAN CHURCH Through my conversation with Councilman Maurer and Carl Irwin I have been lead to believe that the suggestion that 250 automobile parking spaces could be placed on the church site originated with this department. As we now know, the church is having a very difficult time designing a 250 car parking facility without going to structure parking, which is very expensive. Inasmuch as churches normally are in the business of catering to people's religious needs as opposed to building parking structures, this poses a real dilemma for them. I would appreciate seeing a copy of the study which you performed which apparently lead to the 250 on-site parking space requirement. ANDREWS PARKING STRUCTURE The following comments refer to the revised two level parking structure for the proposed expansion of St. Andrew's Church: 1. The proposed structure has almost 50% compact parking spaces. While this percentage is much lower -if all church spaces, including the high school , are counted I believe it must be considered as a separate entity due to its proximity to the church. This percentage is much higher than any previously approved by the City but should probably work in this instance because of the church's ability to get their members' cooperation.' 2. The ramp designs are not-detailed but they appear to exceed certain design criteria regarding maximum ramp angle and transitions. More information is needed to determine what design options exist. 3. Strong consideration should be given to widening the driveways up to a maximum of 28 feet to better facilitate two-way traffic. Ric and M. Staff has raised certain issues relative to this project that may warrant discussion prior to the July 12, 1982 Council meeting. These issues are as follows: 1. Section 20 .80.060 sets forth the procedure pursuant to which use permits are garanted. Sub-paragraph C of that section provides as follows: "Use Permits shall not become effective for 21 days after being granted, and in the event an appeal is filed or if the City Council shall exercise its right to review any such decision, the Permit shall not become effec- tive unless and until the decision granting the Use Permit is made by the City Council" . Thus, should the decision on St. Andrews result in a 3-3 vote, the church would not be entitled to a Use Permit; 2. The St. Andrews project has been necessarily conditioned on the abandonment, by the City, of an alley which transects the building site. In order to abandon the alley the City Council must adopt two resolutions . A resolution, to be effective, must be adopted by four affirmative votes. Thus, the possibility exists that the vote on the project itself, if two Councilmembers were to abstain, could be 3-2 in favor of the project, but the project could fail because of the inability of the City, to adopt resolutions necessary to abandon the alley; Wynn/Hewicker ' July 2 , 1982 • • page 2 3. In the event that it -is deemed appropriate to process the abandonment prior to the decision on the project itself, it will be necessary for the City Council to adopt a resolution of intention to abandon the alley on July 12, 1982 to allow for the 15 days notice required by Section 8320 of the Streets and Highways Code. However, the City Council has not directed staff to prepare a resolution of abandonment, and the attorney for St. Andrews, Milan Dostal, has in- dicated a preference that a vote on the project precede efforts by the City to abandon the alley. In the absence of direction from the legislative body or a petition or request of an interested person it seems somewhat presumptuous of staff to prepare the resolution of intention and place it on the agenda. The only concern of thi's office is that, should the decision on the abandonment be postponed to sometime in the future, St. Andrews may find that a considerable some of money has been spent in vain. These fears may be groundless, however, and •Jim Hewicker has suggested that St. Andrews advise the City Council that it understands the need for four affirmative votes to adopt a resolution to abandon the alley and to acknowledge that it wishes to proceed with a decision on the project prior to abandonment. obert H. ANDREWS MASTER PLAN OF FACILITIES Dear Fred: Now that we have completed the Initial Study for the St. Andrews Church Master Plan, I feel it is appropriate to review the project budget. Our origi- nal budget allocated $8,150 to prepare the Initial Study and attend hearings. In reviewing our work performance to date, I feel LSA has performed work over and beyond what was originally anticipated on this project. In addition, we have not yet attended hearings on the project. Consequently, we will incur costs beyond the original budget allocation. The additional work and costs are described below. The principal factor which contributed to our increased work effort was changes in the project which required revisions to our report. Project sta- tistics on such things as square footages were changed and there were incon- sistencies in the statistics which could not be clarified by the architect in Huntington Beach. Additional time and effort were spent to resolve these inconsistencies. Parking space statistics were revised, with the resulting need to revise the traffic report. Also, more copies of the document were requested than we had budgeted for. We are requesting a budget augment of $837. The intent will be to fully mitigate all potential impacts either with existing City policies or with project-specific mitigation measures. If this is possible, then the City can issue a conditional Negative Declaration for this project. LSA proposes the following scope of services: SCOPE OF SERVICES Project Description. LSA will prepare a full project description to include all proposed onsite improvements and project information. The description will also include a full discussion of the local and regional set- ting for the proposed project. This discussion will present necessary infor- mation on committed and planned projects in the vicinity. Major Issues. LSA will prepare an analysis of the major issues raised by this project. Land Use. The proposed land use will be compared to the provi- sions of t e ity' s General Plan and current City zoning. Emphasis will be placed on analyzing the compatibility of the church facilities with surround- ing land uses. 2 Lsa Views and Aesthetics. LSA will analyze the, project design with emphasis on views from the surrounding neighborhood. There will be a brief analysis regarding possible views of the church from other areas of the city. Specifically, this analysis will include a discussion of building height and setbacks. Circulation and Parking. Weston Pringle and Associates (WPA) will conduct the circulation and parking study. The traffic engineer will complete the analysis required by the City's Traffic Phasing Ordinance (TPO) . WPA will also measure existing parking demand and availability during December and January. These data will be used to estimate project-related demand for parking. The study will also include analysis of the site plan for both onsite and offsite impacts. WPA will conduct two Sunday traffic and parking counts and two weekday "peak-hour" counts. Construction Impacts. LSA will analyze the potential impacts of grading an construction activities. Noise and dust impacts will be specifi- cally addressed. Minor Issues. We assume that the following issues will be minor.
