The discussion opened in connection with this item and
Mr. Sid Buck, Vice-President of The Koll Company,
appeared before the Commission and requested approval
of the Traffic Phasing Plan.
Motion X Motion was made for approval of Amendment No. 2 to the

following findings and revised Condition No. 38, which

FINDINGS:
1. That subsequent changes in the project will not
require revisions to the Certified Final EIR.
2. That no new significant environmental impacts not
considered in the Certified Final EIR were found.
3. That no substantial changes have occurred with
respect to the circumstances under which the
project will be undertaken.
4. That no new information of substantial importance
related to the project has become available.
5. That the Phasing Plan is consistent with the
Newport Beach General Plan and the Planned
Community Development Plan for Koll Center
Newport.

6. That based on the Phasing Plan and surrounding
information submitted therewith, there is a
reasonable correlation between projected traffic
at time of completion and the capacity of affected
intersections.
7. That the applicant has taken into consideration
the preparation of his plan characteristics in the
design of his development which either reduce
traffic generation or guide traffic onto less
impacted arterials or through intersections in the
least congested direction.
REVISED CONDITION NO. 38:
38. That prior to the occupancy of any buildings on
the site beyond the existing development completed
or under construction, an additional eastbound
through lane shall be constructed at the
intersection of Coast Highway and MacArthur
Boulevard (unless. subsequent project approvals
require modification thereto) or the applicant
shall contribute $41,000.00 to a fund for the
construction of improvements to Coast Highway in
conjunction with the Coast Highway widening
project. This improvement shall be subject to the
approval of the City Traffic Engineer.

Application
The applicant has requested the approval of an amendment to the
Traffic Phasing Plan (TPP) for the remaining development in the Kbll
Center Newport Planned Community under Koll/Aetna ownership. The
amendment will amend Condition No. 38 of the Traffic Phasing Plan as
indicated below:
38. That prior to the occupancy of any buildings on the site
beyond the existing development completed or under
construction, an additional eastbound through lane shall be
constructed at .the intersection of Coast Highway and
MacArthur Boulevard (unless subsequent project approvals
require modification thereto) or the applicant shall
contribute $41,000.00 to a fund for the construction of
improvements to Coast Highway in conjunction with the Coast
'Highway widening project. This improvement shall be subject
to the approval of the City Traffic Engineer.
Phasing Plans must be developed in accordance with the Planned
Community Development Plan, City Council Resolution 9742, Amendment
No. 514, Amendment No. 550, and the City's definition of the term
reasonableness. The Traffic Phasing Plan was originally approved by
the City Council on November 10, 1980 and by the Planning Commission
on September 4, 1980. Amendment No. 1 to the Traffic Phasing Plan was
approved by the Planning Commission on April 9, 1981.

Environmental Significance
An Environmental Impact Report was certified in conjunction with the
adoption of the Traffic Phasing Plan for the Koll/Aetna Properties in
Koll Center Newport. Staff has reviewed the proposed amendment and
determined that there are no new significant environmental impacts not
previously considered, nor has there been substantial changes with
respect to the circumstances under which the project will be
undertaken.
Phasing Plan
The approved Phasing Plan for the Koll/Aetna properties allows for the
following .phasing schedule:
1981 - Occupancy of a 7,650 sq.ft. addition to Koll Co.
Corporate Headquarters
1983 - Occupancy of Phase I (,440' room Hotel and 225,198 sq.ft.
of office/restaurant/retail use.)
1984 - Occupancy of Phase II (100,736 sq.ft. of office/restaurant
use.)
Staff Analysis
The City Council is presently considering the Coast Highway Widening
project and Draft EIR/EIS. Subsequent to the Council's review and
recommendations, the reports will go to the State and then to the
Federal Highway Administration. The proposed amendment to Condition
No. 38 of the approved Traffic Phasing Plan will allow the Koll
Company to occupy the buildings now under construction in the Koll
Center Newport and contribute a sum equal to that required to make the
intersection improvements. Staff feels that any action taken by the
Planning Commission related to the changes to the Coast
Highway/MacArthur Boulevard intersection would be premature, and
therefore, recommends approval of this amendment.
Suggested Action
Staff recommends approval of Amendment No. 2 to the Koll/Aetna Traffic
Phasing Plan with the findings and subject to the revised Condition
No. 38 as indicated in Exhibit "A".
