TITLE: Corona del Mar Fire Station No.5/1-ibrary Replacement — Notice of
Completion for Contract No. 8136-2 (15F12)
ABSTRACT:
On February 27, 2018, the City Council awarded Contract No. 8136-2, Corona del Mar
Fire Station No.5/1-ibrary Replacement project, to TELACU Construction Management,
Inc. (TELACU) of Orange, California. The work has now been completed and staff
requests City Council acceptance and closeout of the contract.
RECOMMENDATION:
a) Accept the completed work and authorize the City Clerk to file a Notice of Completion
for the project;
b) Authorize the City Clerk to release the Labor and Materials Bond 65 days after Notice
of Completion has been recorded in accordance with applicable portions of the Civil
Code; and
c) Release the Faithful Performance Bond one year after acceptance by the City Council.
FUNDING REQUIREMENTS:
The adopted budget included sufficient funding for this project. The construction contract
was expensed from the following account within the budget:

The work necessary for the completion of this contract consisted of demolishing two
existing buildings; surveying; grading the site; pouring foundations; constructing a
combination fire station and branch library; landscaping the site; and
installing/coordinating with utilities.
The Corona del Mar Fire Station No-5/Library Replacement construction contract was
awarded to TELACU on February 27, 2018 with a Notice to Proceed date of April 16,
2018. The contract has now been completed to the satisfaction of the Public Works
Department.

The final construction contract cost was less than one percent over the original bid
contract amount. Staff issued five change orders that amounted to $8,212.71. The
change orders stemmed from unforeseen issues affecting various trades. The most
significant change order was a credit for unused FF&E allowance for library furniture.

Actual Substantial Construction Completion Date: October 11, 2019
Completion of this project was delayed beyond the original scheduled completion date for
a number of reasons. Some of these delays are accounted for due to events such as
weather or manufacture material delays (last winter was a very wet year with above
normal rain days), while others were due to sub -contractor underperformance and
non -excused schedule slippage.

Understanding there is currently a very tight labor market, and corresponding very high
level of work and product demand, and after generally a very smooth performing project,
TELACU struggled near the end to get a few of their sub -contractors to perform
(particularly in the millwork and finish carpentry areas). As such, even with the good faith
effort by TELACU to finish contracted work, staff determined it was appropriate to assess
$25,000 in liquidated damages for project delays (liquidated damages for this construction
contract are defined at $2,500 per day). The primary intent of the liquidated damages
was not to punish TELACU, but rather compensate the City for damages related to not
completing the construction on time. Damages for this project involved covering all the
costs related to maintaining a temporary fire station, extending consultant construction
services and staff time required to manage the project.
The project was deemed substantially complete as of October 11, 2019, with all building
and site improvements completed and operational. Some miscellaneous close-out items,
operation and maintenance turnover, and financial paperwork post -substantial
completion still remained and have since been finalized prior to this Notice of Completion
action.
ENVIRONMENTAL REVIEW:
On February 27, 2018, City Council found this project exempt from the California
Environmental Quality Act (CEQA) pursuant to Section 15302 (Replacement or
Reconstruction) of the CEQA Guidelines. This exemption covers the replacement or
reconstruction of existing structures and facilities where the new structure will be located
on the same site as the structures replaced and will have substantially the same purpose
and capacity of the structure replaced.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item). In addition, the City Clerk will
be filing a Notice of Completion for the project as a result of this action.
