TITLE: Newport Pier Area Water Main Replacement — Award of Contract
No. 7631-2 (20W11)
ABSTRACT:
Construction bids have been received for the Newport Pier Area Water Main
Replacement project. Staff requests City Council's approval to award the construction
contract to Paulus Engineering, Inc. of Anaheim, California.
RECOMMENDATION:
a) Find this project exempt from the California Environmental Quality Act (CEQA)
pursuant to Class 2 Section 15302(c) (replacement of existing public facilities involving
negligible or no expansion of capacity) of the CEQA Guidelines, California Code of
Regulations, Title 14, Chapter 3, because it has no potential to have a significant effect
on the environment;
b) Approve the project plans and specifications;
c) Award Contract No. 7631-2 to Paulus Engineering, Inc. for the bid amount of
$2,651,674.10 for the Newport Pier Area Water Main Replacement project and
authorize the Mayor and City Clerk to execute the contract; and
d) Establish a contingency of $265,000.00 (approximately 10% of total bid) to cover the
cost of unforeseen work not included in the original contract.
FUNDING REQUIREMENTS:
Sufficient funding is available in the current Capital Improvement Program budget for the
award of this contract. The following funds will be expensed:

Staff recommends establishing $265,000.00 (approximately ten percent) for contingency
purposes to cover the cost of unforeseen conditions associated with construction.

The Newport Pier Area Water Main Replacement project replaces older cast iron and
asbestos cement water mains identified in the Water Master Plan in and around the
Newport Pier area between 30th Street and 23rd Street and between Newport Boulevard
and West Ocean Front Alley. This project also includes water main replacement in the
West Newport area for four alleys located between 46th Street and 38th Street and a water
main located on Balboa Boulevard between River Avenue and 44th Street. Staff is
accelerating these master planned water main improvements, as they need to be
completed earlier than originally planned due to pending resident -initiated utility
undergrounding improvements projects on the Peninsula.
At 10 a.m. on November 21, 2019, City Clerk opened and read the following bids for this
project:
The low bid amount is 26 percent below the Engineer's Estimate of $3,600,000. The bids
are competitive and the disparity between the engineer's estimate and the low bid
appears to be in line with recent favorable bids for water main construction and trench
dewatering bid items. Paulus Engineering, Inc. submitted all the necessary forms and
possesses a California State Contractors License Classification "A" as required by the
project specifications. A check of the contractor's references indicates satisfactory
completion of similar projects for the City of Newport Beach and other public agencies.
Paulus Engineering, Inc. recently successfully completed the Lido Village Water Main
Replacement project for the City of Newport Beach.

Work necessary to complete this contract consists of removing existing deteriorated cast
iron and asbestos cement water mains and installing new PVC pipe, valves, fire hydrants,
water services, pavement restoration, traffic control and appurtenant work as required by
the contract.
Project phasing has been developed to minimize impacts to the community. For example,
work will not be allowed to start until after the Christmas Holidays in order to avoid impacts
with holiday traffic. In addition, working hours have been established to minimize impacts
to commuter traffic, which may include some minimal amounts of night work. A detailed
schedule will be prepared by the contractor following award, which can be adjusted to
address concerns for businesses and residents in the project area.
Pursuant to the Contract Specifications, Contractor will have 160 consecutive working
days to complete the work. Work for this construction contract is scheduled to begin
January 6, 2020.

Staff recommends the City Council find this project exempt from the California

NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).
