PLEDGE OF ALLEGIANCE - Mayor Bever, City of Costa Mesa II. ROLL CALL Present: Mayor Selich, Mayor Pro Tem Daigle, Council Member Henn, Council Member Rosansky, Council Member Webb, Council Member Gardner, Council Member Curry, Mayor Bever, Mayor Pro Tem Mansoor, Council Member Foley, Council Member Leece Excused: Council Member Dixon III. OPENING COMMENTS 1. Mayor Edward D. Selich, City of Newport Beach Mayor Selich reported that this meeting is a historic event and that Newport Beach and Costa Mesa have common problems that they can work on together. 2. Mayor Eric R. Bever, City of Costa Mesa Mayor Bever stated that both cities will get further if they work together, and thanked the public and both Councils and staff for attending. IV. DISCUSSION ITEMS 1. Presentation - Evaluation of Transit Connection to John Wayne Airport/OCTA "Go Local" Program. Peggy Ducey, Ducey and Associates, utilized a PowerPoint presentation to highlight why it was important to look into using a transit carrier system for John Wayne Airport (JWA). She discussed her scope of work for the Go Local Program, the targeted high density clusters by zip code, the targeted air passengers, current hotel shuttle service to JWA, shuttle service options, the impacts on JWA by South County residents, and how Disneyland handles its resort/hotel traffic. She discussed the passenger counts into Los Angeles Airport (LAX), JWA, and Ontario Airport. Joel Griffith, Ducey and Associates, discussed the primary reasons for traveling out of JWA, the resident/visitor mix, where Orange County travelers come from, current modes of ground transportation to JWA, where JWA employees reside, and transit rideshare potentials. Jeff Thomas, Landen & Brown, reported on the airport options Southern California residents consider, and reasons and opportunities for regionalization. He noted that the origin of JWA passengers are fairly concentrated, and that this is similar to LAX's data. Heather Summers asked if there will be a move to use McCarran International Airport in Las Vegas more and whether legislation allows the use of airport funds for secondary and Volume 58 - Page 591 City of Newport Beach City Council Minutes September 30, 2008 tertiary transportation purposes In response to Council Member Curry's questions, Consultant Ducey indicated that it may be possible to have people bussed back and forth between JWA and LAX; however, they need LAX's data in order to look into this further. Council Member Gardner noted that JWA can assist with employee transportation issues. Council Member Webb indicated that JWA may be able to subsidize the employee cost for transit passes, etc. Consultant Ducey noted that this is not part of her scope of work but JWA is enthusiastic to their ideas. Motion by Mayor Selich to receive and file. The motion carried by the following roll call vote: Ayes: Mayor Selich, Mayor Pro Tem Daigle, Council Member Henn, Council Member Rosansky, Council Member Webb, Council Member Gardner, Council Member Curry In response to Costa Mesa Council questions, Consultant Ducey noted that she did not contact any hotel shuttle services, but came up with the idea of a centralized shuttle service for JWA based on how Disneyland operates. She reported that she will finalize her report in about two weeks for each City Council to approve. She noted that the Go Local funding only allowed her to look at local transportation, not regional transportation. She believed that improving ground transportation is the area's best solution. Mr. Thomas stated that they will also be integrating LAX's data with JWA's data, and hopefully receive data from Ontario Airport. He suggested that a regional source be used to fund the analysis since this is a County -wide issue. Mayor Bever suggested asking OCTA to create an on -call shuttle service for Newport Beach and Costa Mesa residents in order to help relieve airport congestion. He expressed concern that providing transportation from JWA to Anaheim would increase traffic. Mr. Thomas indicated that they are exploring using Ontario Airport, not JWA, as the airport for Disneyland vacationers. Motion by Council Member Leece to receive and file. Memorandum of Understanding on John Wayne Airport between the City of Costa Mesa and the City of Newport Beach, California. Newport Beach City Manager Bludau provided the background behind the 1985 Settlement Agreement and amendment to the Settlement Agreement. He pointed out the importance of the Federal Aviation Administration (FAA) letter that grandfathers the agreement from the Federal Airport Noise and Capacity Act (ANCA). He indicated that the current agreement expires on December 31, 2015 and that corridor cities assisted with that effort. Costa Mesa City Manager Roeder reviewed the goals and objectives listed in the Memorandum of Understanding (MOU), and pointed out that the MOU also provides financial assistance from Costa Mesa. Volume 58 - Page 592 City of Newport Beach City Council Minutes September 30, 2008 Regarding Objective 4 (work with other cities in Orange County), Council Member Rosansky recommended focusing on the South County cities that fought against having an airport at El Toro. Council Member Curry emphasized that this is a quality of life issue for both cities and that money spent on this is an investment. Council Member Henn expressed support for the MOU and hoped that this will be a template for the two cities to work together on other issues. Mayor Selich believed that preserving general aviation at JWA will assist with minimizing the impacts on the two cities. Mayor Pro Tem Mansoor requested that "to a lesser extent" be removed from the fourth Whereas and Objective 3 (establishing a working staff relationship between the two cities). He received clarification from both City Managers regarding Goal J (enabling Orange County residents and businesses to conveniently access underused out -of- county airports). City Manager Roeder added that the MOU will evolve and change over time. Council Member Foley encouraged involving both North and South County cities. She thanked AirFair and the Airport Working Group (AWG) for their involvement. Mayor Bever reported that a general aviation airport in Florida agreed to a voluntary curfew and requested that this be brought up with JWA. He noted that Newport Beach has a sphere of influence agreement and questioned if Costa Mesa can generate an agreement. City Manager Roeder stated that he will discuss this with Newport Beach and bring something back to the Costa Mesa City Council. Mayor Bever indicated that AirFair has concerns with using "modest" to describe the airport growth. City Manager Roeder and Costa Mesa City Attorney Potter stated that this is in the staff report and has no legal substance relative to the MOU. City Manager Bludau discussed that, although there are four parties to the Settlement Agreement, there are many outside influences on the issue, such as the airline industry. He emphasized that this is the reason the parties allowed for some growth, otherwise the Settlement Agreement may not have been grandfatbered by the FAA. Nancy Alston, AirFair, reiterated their concern with using "modest" to describe the airport growth. She expressed their support for the MOU and noted that there is currently no way to reach the Ontario Airport from Anaheim. City Manager Roeder indicated that they will remove "modest" from the staff report. Jim Fitzpatrick expressed hope that a rail and transit system is developed and encouraged the two cities to work together on other issues of mutual interest. Motion by Mayor. Pro . Tem .Mansoor to approve the amended Memorandum of Understanding.
