The combination of two habitable rooms into one room in order to relocate a new habit le
room to the second floor; the demolition of interior garage walls to allow a second parking
space with clear interior width of 17'-4" where the Code requires 17'-6"; and the creation of
a third parking space, uncovered, with width of 8'-0" where the Code requires 8'-9" with no
property line fencing is present. The existing structure is non-conforming becaus it
encroaches into front and side setbacks. Illegal construction within the garage will be
removed to provide access to two garage parking spaces.

The Modifications Committee, on January„ 17, 2001, voted 3 ayes and 0 noes to approve the
application request based on the following findings and subject to the following conditions.
FINDINGS:
The Modifications Committee determined in this case that the proposal would not be de mental to
persons, property or improvements in the neighborhood and that the modification as approved
would be consistent with the legislative intent of Title 20 of the Newport Beach Municipal Code,
and made the following findings:

1. The Land Use EIement of the General Plan and the Local Coastal Program Lanc Use Plan
designates the site for"Two Fanuly"residential use and the existing residential tructure is
consistent with this designation.
2. This project has been reviewed, and it has been determined that it is categoricafly exempt
from the requirements of the California Environmental Quality Act under Ow s 3 (New
Construction or Conversion of Small Structures).
3. The modification to the Zoning Code as proposed will not be detrimental to persons,
property or improvements in the neighborhood or increase any detrimental eff xt of the
existing use for the following reason(s):
• There would be no increase in the number of habitable rooms on the lot an therefore
not increase in panting demand of the property.
• The number and size of parking spaces are consistent with the zoning requirements
when the duplex was built.
• The provision of the third parking space is beneficial to the neighborhood by reducing
the need for on-street parking.
• The return of the garage for two car enclosed parking will remove the illegal
construction that rendered a portion of the garage unusable for the parking of vehicles.
• The surrounding property owners have no objections to the proposed construction.
CONDITIONS:
1. The development shall be in substantial conformance with the approved plot Ian, floor
plans, and elevations, except as noted in the following conditions:
2. A building permit shall be obtained prior to commencement of the construction.
3. All work performed within the public right of way shall be reviewed and appro ed by the
Public Works Department under an encroachment permitlagreement if required.)
4. A total of three parking spaces shall be maintained for the parking of vehicles at all times,
two spaces shall be available within the existing garage that will be returned to a
configuration for two car parking.

5. The clear interior width of the garage, inside wall to inside wall, shall not be less than 17
feet 4 inches, with the exception of three existing support posts that may diminish that
dimension at non-critical points within the garage.
6. The existing awning adjacent the third parking space shall be removed.
7. Prior to issuance of building permits for the new addition, all non-conforming storage
areas and interior walls within the garage that impact the parking of two vehicles shall be
removed, unless otherwise approved by the Planning Director.
8. This approval shall expire unless exercised within 24 months from the date of approval as
specified in Section 20.93.055 of the Newport Beach Municipal Code.
The decision of the Committee may be appealed to the Planning Commission within 14 days of the
date of the decision. Any appeal filed shall be accompanied by a filing fee of$714.00. NO building
permits may be 'issued until the appeal period has expired.

Notice is hereby given that Michael & Susanne Buettell, property owners, have requested a Modification
of the Zoning Ordinance to permit the combination of two habitable rooms into one in or er to add a
new habitable.room on the second floor; the demolition of interior garage walls to all w a second
parking space with clear interior width of 17'-4"where the Code requires 17'-611; and th e creation of
a third parking space, uncovered, with width of 8'-0" where the Code requires 8'-9" if'there is no
property line fencing. The existing structure is non-conforming because it encroaches into front and
south setbacks. The property is located in the R-1.5 District.

This project has been reviewed, and it has been determined that it is categorically exempt under the
requirements of the California Environmental Quality Act.
A public hearing will be held by the Modifications Committee at 3:00 p.m. on Wednesday, January 17,
2001, in the City Council Chambers, City Hail, 3300 Newport Boulevard. All interested persons will be
heard and all correspondence read at that time. If you challenge this project in court, you may be limited to
raising only those issues you or someone else raised at the public hearing described in this notice, or in
written correspondence delivered to the City, at, or prior to,the public hearing.
