Please be advised that additional information is required in order to process the above referenced
application. Therefore, the submittal has been determined to be an incomplete application and you
are hereby requested to provide the additional information requested or provide your written request
for withdrawal of the application. The Planning Department cannot process the application without
the following information:
a. Plot Plan that accurately depicts the location of the property line in relation to the street
improvements (face of curb or back of sidewalk).
b. Location of the proposed retaining walls from the property line.
c. A profile that depicts in cross section the height of the proposed retaining walls and wrought
iron fence in relation to the top of curb elevation or the top of sidewalk elevation.
d. Partial landscape plan that depicts the proposed planting that is to be provided in front of the
retaining walls.
e. Any other additional information that you feel is relevant or serves to justify the proposed walls
location and height.
Once the necessary information is provided, the application will be scheduled for hearing. Thank

Purpose of this Request: This application for a modification permit is being submitted in a
"preliminary" or "conceptual' form to elicit comments and suggestions of the Planning
Department. If the Planning Department gives approval in principle for the proposed retaining
wall and fence,then I will hire a civil engineer and an architect to design the final details, and
then submit a formal application for a modification permit. We seek permission to build two
terraced wall/retaining-walls near the sidewalk around the edge of our lot. These wall will
consist of a 46 inch wall of which 36 inch will function as a retaining wall, and a second 84 inch
wall of which 36 " to 42" will function as a retaining wall.
Introduction: We seek permission to build two terraced retaining-walls along the edge of our
vacant lot at 3 Park Place. The proposed retaining-walls will be similar in size to the retaining
walls presently located on Park Place The stylistic features of the proposed retaining-wall be
consistent with the existing retaining-wall in front of our house at 2 Park Place.
Description of Existing Retaining Walls on Park Place: Park Place is a private cul-de-sac
street in Newport Beach located near Cliff Drive immediately northwest of and adjacent to
Ensign View Park and the Newport Theater Arts Center.. Between Ensign View Park and Park
Place there exists a 112 feet long retaining-wall. Several sections of this retaining-wall are 6 feet
tall topped with an additional 3.5 feet of metal fencing. Between the retaining wall and the street
surface there is a 20 inch wide strip of earth planted with shrubs and a 24 inch-wide side walk.
Background: We (Jeff and Kathy) are the owners of the two adjacent lots at 2 Park Place and 3
Park Place. Our home is at 2 Park Place. We are planning to develop our vacant lot at 3 Park
Place into a garden and play area for our two children, Dora, age 3.5 years, and Paytra age 2
years. The surface of 3 Park Place is elevated six feet to 6.5 feet above the sidewalk and slopes
steeply to the concrete sidewalk that surrounds the lot on two sides. In order to provide a flat
play-area upon which the children are always visible,we plan build a retaining-wall along the
periphery of the lot.

Notice is hereby given that Jeffrey A. Klein, property owner, has requested a Modification of the Zoning
Ordinance to permit the construction of a combination 6-foot high retaining wall and 3-foot 6-inch
wrought iron fencing on top. The retaining wall will encroach to within 1 foot of the back of sidewalk
where the Conditions of Approval (No. 12 of Tract No. 12873) of the Tract require a minimum
distance of 2 feet. The Zoning Code limits the height within the front yard setback to a maximum
height of 3 feet above existing grade. The subject property is located on a private street (cul-de-sac).
The property is located in the R-1 District.

This project has been reviewed, and it has been determined that it is categorically exempt under the
requirements of the California Environmental Quality Act under Class 11 (Accessory Structures).
A public hearing will be held by the Modifications Committee at 3:00 p.m. on Wednesday, May 9, 2001,
in the City Council Chambers, City Hall, 3300 Newport Boulevard. All interested persons will be heard
and all correspondence read at that time. If you challenge this project in court, you may be limited to
raising only those issues you or someone else raised at the public hearing described in this notice, or in
written correspondence delivered to the City, at,or prior to,the public hearing.
