Staff has received construction bids for the Police Station Gun Range Remodel project
and requests City Council approval to award the construction contract to Optima RPM,
Inc. This project will replace and update the existing indoor police firing range located at
870 Santa Barbara Drive.
RECOMMENDATION:
a) Find this project exempt from the California Environmental Quality Act (CEQA)
pursuant to Section 15301 (Existing Facilities) of the CEQA Guidelines, California
Code of Regulations, Title 14, Chapter 3, because this project has no potential to have
a significant effect on the environment;
b) Approve the project drawings and specifications;
c) Award Contract No. 7080-1 to Optima RPM, Inc. (Optima RPM) for the total bid price
of $691,000.00, and authorize the Mayor and City Clerk to execute the contract; and
d) Establish $70,000.00 (approximately 10 percent) contingency to cover the cost of
unforeseen work not included in the original contract.
FUNDING REQUIREMENTS:
Sufficient funding is available in the Capital Improvement Program budget for the award
of this contract. The following funds will be expensed:

Staff recommends establishing $70,000.00 (approximately 10 percent of total bid) for
contingency purposes and unforeseen conditions associated with construction.
BACKGROUND:
The existing Police Department station was constructed in 1973. The building has
received various updates through the years, including a significant interior remodel in
1985 and a remodel of several offices and rooms in 2018. This remodel effort focuses
on a complete overhaul and upgrade of the indoor shooting range (Attachment A).
Originally constructed in 1976, the current setup consists of a rubber backstop, four
designated shooting lanes with target rails, a suspended acoustical ceiling system,
overhead baffles and an HVAC system.
DISCUSSION:
Police Department staff met with Public Works in order to provide a suitable design and
layout, increasing range safety, making more efficient use of space, and providing easier
access for cleaning the bullet trap. The existing rubber trap and all hazardous waste will
be removed. Five new vertical funnel -type bullet traps will be installed, which, when
coupled with non -lead frangible ammunition, will provide for an easier to clean method of
capture. A new HVAC system will improve ventilation and capture of airborne particles.
New ceiling and wall plates will improve ballistic protection, and new acoustical panels
will improve sound mitigation. Lastly, an automated turning target system and improved,
energy-efficient LED lighting system will provide better training conditions for staff.
On February 4, 2020, at 2:00 p.m. the City Clerk opened and read the following electronic
bids for this project:

After the bid opening, staff received a bid protest letter from the third lowest bidder
(Attachment B), The Stone Collector, claiming that the low bidder's bid was
non-responsive. The low bidder then submitted a response to the bid protest (Attachment
C). Staff reviewed the low bidder's response and determined the low bidder complies
with the bidding specifications for this project. Staff recommends the City Council declare
Optima RPM as the lowest responsive bidder.
The bid amount submitted by Optima RPM is 7.9% below the Engineer's Estimate of
$750,000.00. Optima RPM possesses a valid California State General Building "B"
Contractors License as required by the project specifications and has satisfactorily
completed facility projects for the City and other local agencies.
Pursuant to the contract specifications, Optima RPM is allotted 60 consecutive working
days to complete the work. Liquidated damages in the amount of $1,000.00 per calendar
day will be assessed in case of tardy completion.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this project exempt from the California
Environmental Quality Act (CEQA) pursuant to Section 15301 (Existing Facilities) of the
CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because this
project has no potential to have a significant effect on the environment.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).

bidders to be deemed unresponsive and to be disqualified based on the
information below:
1- Optima RPM Inc.
On page 17 of the submitted bid the license number listed as 761714
belongs to W &C Ingram Landscape not Optima RPM Inc.
2- Dalke & sons construction Inc.
There is no title of the person signing on page 5 of the submitted bid.
According to City of Newport Beach Instruction to Bidders item #13
states: All documents shall bear signatures and titles of persons
authorized to sign on behalf of the bidder.
