This amendment is being proposed pursuant to the authority of the City of Newport Beach to modify the 2019 California Fire Code as found in California Health and Safety Code Sections 17922, 17958, 17958.5, 17958.7, 18935, and related sections. Amendment of Chapter 49 (Wildland Fire Areas) of the 2019 California Fire Code is not subject to the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably indirect physical change In the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. All interested parties may appear and present testimony in regards to this item. If you challenge this item in court, you may be limited to raising only those issues you raised at the public hearing or in written correspondence delivered to the City, at, or prior to, the public hearing.
