On October 10, 2019, Governor Gavin Newsom signed into law Senate Bill 330 – also known as the Housing Crisis Act of 2019 – aimed to stimulate homebuilding amid the housing shortage in California. The new law imposes several new restrictions on local agencies, including a restriction on the adoption of zoning amendments that would result in the reduction of allowed density or intensity of land uses than what was allowed under the land use designation and zoning ordinances in effect on January 1, 2018. The law defines “less intensive use” to include, but is not limited to, reductions to height, density, or floor area ratio, new or increased open space or lot size requirements, new or increased setback requirements, minimum frontage requirements, or maximum lot coverage limitations, or anything that would lessen the intensity of housing. Agenda Item No. 5 is a Study Session item that will provide the Planning Commission with a greater explanation of Senate Bill 330.
