TITLE: Resolution No. 2020-23: Reestablishing the Ad Hoc Committee on
Short Term Lodging
ABSTRACT:
In July 2019, the City Council adopted Resolution No. 2019-69 forming an Ad Hoc
Committee (committee) of three City Council Members to review and determine whether
provisions of the Short Term Lodging ordinance should be modified and to make
recommendations to the entire City Council. The committee automatically expired on
February 11, 2020 after the committee made their recommendations to the City Council.
The committee members desire to continue reviewing the provisions of the Short Term
Lodging ordinance and return with updated recommendations. For City Council's
consideration, is a resolution reestablishing the Ad Hoc Committee on Short Term
Lodging.

a) Determine this action is exempt from the California Environmental Quality Act
(CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines
because this action will not result in a physical change to the environment, directly or
indirectly; and
b) Adopt Resolution No. 2020-23, A Resolution of the City Council of the City of Newport
Beach, California, Reestablishing the Ad Hoc Committee on Short Term Lodging.

DISCUSSION:
At the February 11, 2020 City Council meeting, the Ad Hoc Committee on Short Term
Lodging (Ad Hoc Committee) submitted recommended changes to the Newport Beach
Municipal Code (NBMC) on short term lodging. The Ad Hoc Committee automatically
expired after the recommendations were introduced to the entire City Council. At the
February 25, 2020 City Council meeting, the Ad Hoc Committee members desired to
continue working on the recommendations before the City Council took final action. Due
to the automatic sunset of the Ad Hoc Committee a new resolution, reestablishing the Ad
Hoc Committee is required.
The attached resolution rescinds Resolution No. 2019-69 and reestablishes the Ad Hoc
Committee, comprised of City Council Members Diane Dixon, Jeff Herdman, and Joy
Brenner. The purpose of the Ad Hoc Committee is to review, determine and make
recommendations to the entire City Council of proposed revisions to the NBMC related to
Short Term Lodging.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find approval of the Agreement is not subject to the
California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the
activity will not result in a direct or reasonably foreseeable indirect physical change in the
environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378)
of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it
has no potential for resulting in physical change to the environment, directly or indirectly.
