Recommendation:
Approve the Newport Aquatic Center Facilities Management Plan as the operations
agreement between the City and Newport Aquatic Center, Inc.
Background:
Simultaneous with the City Council's review of the Facilities Management Plan
on January 11, 1988, Teresa Henry, Staff Planner to the California Coastal
Commission, transmitted some minor changes which will better address project
approval conditions required by the Commission. The revised draft has incorp-
orated the changes into sections which address public use of the Aquatic Center
and North Star Beach, environmental concerns and Coastal Commission review of
special events.
The attached draft is presented for information and approval and reflects the
cooperation of the Aquatic Center Board, Dover Shores Community Association,
the Coastal Commission and the City.

NEWPORT AQUATIC CENTER FACILITIES MANAGEMENT PLAN
FOREWORD
The Newport Aquatic Center, Inc. is a non-profit public
benefit corporation which operates and maintains a 9,000 square
foot facility for the purpose of providing training, instruction
and storage of human -powered watercraft. The Aquatic Center
facilities are located on North Star Beach on land leased to the
Aquatic Center by the City of Newport Beach. The Facilities
Management Plan is to insure that the operation of the Aquatic
Center meets specific requirements developed through the project
approval process. In addition, the Facilities Management Plan
will also establish the framework for cooperative programs,
general program development and expectations or daily site
management.
The Parks, Beaches and Recreation Department is the
City's agency assigned to monitor Aquatic Center compliance with
the Facility Management Plan and will cooperate with the Aquatic
Center in the conduct of various instructional programs and
related activities.
The City of Newport Beach and the Newport Aquatic
Center, Inc. look forward to enhancing recreation opportunities
through the provision of programs and services at the Newport
Beach Aquatic Center.

B. Board of Directors:
The Aquatic Center Board of Directors is composed
of nine (9) members. Three Board members are elected to officer
positions consisting of President, Secretary and Treasurer.
Whenever possible, all communication between the Board of
Directors and the City should be referred through the President
of the Board.
C. Liaisons to the Board of Directors:
The City and the Dover Shores Community Association
shall maintain representatives as liaisons to the Aquatic Center
Board of Directors. The Dover Shores Community Association shall
be allowed to elect a representative as a liasion to the Aquatic
Center Board as a means of maintaining a direct line of
communication between the Board and the Association. The City
representative will work with the Board to insure compliance with
all approval conditions, the Facility Management Plan and to
facilitate cooperative programs.
The Aquatic Center Board of Directors shall give
seven (7) days' written notice of all meetings to the Recreation
Superintendent for the City of Newport Beach and the President of
the Dover Shores Community Association. The Recreation
Superintendent and the President of the Community Association
should also receive notice of all meetings of the Board, members
of the Board, or Aquatic Center staff that may have a bearing on
matters discussed in the Facilities Management Plan.
D. Executive Director:
The Aquatic Center Board shall recruit and employ
an Executive Director. In addition to the responsibilities
described in the job description included in the appendices of
the Facilities Management Plan, the Executive Director shall
promptly respond to nearby residents who have inquired about
Aquatic Center activities. As necessary, the Executive Director
will also work with professional staff from the Parks, Beaches
and Recreation Department in the areas of program scheduling and
general operating procedures affected by the Facilities
Management Plan.
E. Program and Support Staff:
The Aquatic Center shall recruit, employ and train
appropriate program and support staff required to conduct

instructional activities, building and ground maintenance and
general administration.
F. Personnel Review:
The names and positions of all persons employed by
the Board shall be provided to the Recreation Superintendent of
the City of Newport Beach.
Section II. General Use and Program Development.
A. City Sponsored Instructional Programs:
Designated instructional programs shall be
developed cooperatively by the City'and the Aquatic Center. The
objective of designating selected instructional programs for City
sponsorship is to encourage the continuous participation of
Newport Beach residents in Aquatic Center activities. The Parks,
Beaches and Recreation Department shall be responsible for the
administration of City -sponsored programs and will compensate the
Aquatic Center for instructional resources.
1. Program Development, Marketing and Adminis-
tration:
The Aquatic Center will develop instructional
activities with the cooperation of the City. The Aquatic Center
will provide the Department with titles, schedules and criteria
for various age and skill levels. The Department will be
responsible for marketing public programs through seasonal
brochures and flyers and for processing individual
registrations. Registration fees will be collected and deposited
by the Department. The Department will retain that percentage of
the revenue necessary to offset administrative and marketing
expenses, and disburse the remainder to the Aquatic Center.
2. Seasonal Programs, Schedule and Fees:
City -sponsored instructional programs will be
organized within a seasonal format consistent with all other
Department activities. Program dates will coincide with publica-
tion deadlines for seasonal recreation brochures. Activity sche-
dules shall be developed to promote use of the Aquatic Center
during hours which will not disturb residents of the Dover Shores
area. Enrollment in City -sponsored programs shall be controlled
in relation to membership activities in order to satisfy
restrictions on daily use.

B. Public Use of Facilities:
1. Public Use of Facilities:
The City Council and the Coastal Commission
approved construction of the Aquatic Center based on findings the
facility and related programs would enhance public use of North
Star Beach. At least 20% of the 250 person maximum allowable
daily use will be reserved for general public walk-in use of boat
launching facilities, public restrooms and outdoor showers. Boat
launching facilities, public restrooms and public parking shall
be available to the general public during posted hours of
operation, subject to the restriction that, during the hours of
6:00 A.M. to 7:00 A.M., the facility shall be used only for
training by persons with advanced skills. Limited indoor boat
storage shall be available to members of the general public
without a requirement for enrollment in any facility program and
at a reasonable per diem rate.
2. Aquatic Center Instructional Programs:
The Aquatic Center will also offer
instructional programs available to the general public. The
Aquatic Center shall be responsible for all marketing, promotion,
registration and general administration of these instructional
programs. Participation in Aquatic Center instructional programs
shall not be denied on the basis of race, color, religion, sex,
marital status, national origin, ancestry, physical handicap,
medical condition, age, or other constitutionally impermissible
criteria, nor shall membership be limited to Newport Beach
residents.
C. Membership Programs:
The Aquatic Center will offer various membership
programs based on annual, monthly or per diem rates. Membership
classifications for adults, juniors, families, guests and
visiting teams will be available. Exact membership programs,
fees, requirements and benefits are listed on the Aquatic Center
Membership Application included in the appendices of the
Facilities Management Plan. Membership in the Aquatic Center
shall not be conditioned on race, color, religion, sex, marital
status, national origin, ancestry, physical handicap, medical
condition, age, nor shall participation be limited to Aquatic
Center members or Newport Beach residents.

In recognition of the maximum allowable daily use
and potential growth in Aquatic Center membership programs, id
may become necessary to limit the frequency of use by members.
Any such limitation will be based on review of monthly attendance
reports as provided in Section IV.A. All members shall be
advised, in writing, of the 250 person maximum allowable daily
use restriction and members shall also be advised, in writing,
that their right to use the facility may be limited in the event
the review of monthly attendance records indicates the 250 limit
is being exceeded.
Section III. Use Regulations and Restrictions:
A. Scheduled Activities:

A.M. to 10:00 P.M., the Aquatic Center shall restrict programming
activity in the following manner:
a. Only advanced training activity will be
permitted between 6:00 and 7:00 A.M.
b. No outdoor programs will be offered after
the hour of 7:00 P.M. on Aquatic Center grounds, with the
exception of training activities in the water.
3. Overnight Use:
There will be no overnight accommodations
provided within the Aquatic Center facility or grounds.

The Newport Aquatic Center shall be used for
recreational
and instructional activities related to human -
powered watercraft. Such craft are defined as vessels used for
competitive
rowing, kayaking and canoeing. Permitted related
activities
include safety instruction, classroom/outdoor
instruction
and physical training which directly enhances the
individual's
ability to operate human -powered watercraft.
Sunbathing,
swimming, fishing, picnicking and other passive
recreational
uses shall be permitted at the beach and bayside
areas, within
the leased premises so long as those activities do
not interfere
with instructional programs or related
activities.
Nothing in this plan shall impair the right of
members of the general public to use those portions of North Star
Beach other
than the leased premises for recreational purposes.
2. Restricted Programming Hours:
Within the established operating hours of 6:00
A.M. to 10:00 P.M., the Aquatic Center shall restrict programming
activity in the following manner:
a. Only advanced training activity will be
permitted between 6:00 and 7:00 A.M.
b. No outdoor programs will be offered after
the hour of 7:00 P.M. on Aquatic Center grounds, with the
exception of training activities in the water.
3. Overnight Use:
There will be no overnight accommodations
provided within the Aquatic Center facility or grounds.

4. Special Events/Public Address Systems:
Use of the Aquatic Center facility or grounds
for special events other than those specifically permitted in
this Lease may be permitted subject to issuance of a special
event permit pursuant to the provisions of Chapter 5.10 of the
Newport Beach Municipal Code. In no event shall the Aquatic
Center, nor any special event permittee, utilize any sound
amplication or public address systems on the property. Certain
special events or activities may require a Coastal Permit, and
the Aquatic Center Board and staff shall be responsible for
obtaining all necessary permits prior to conducting special
events or activities on the premises.
5. Daily Use Limitations:
Use of the Aquatic Center shall be limited to
a maximum of 250 persons per day. The maximum use shall be
restricted through development of a program planning process
which will estimate participation in various membership
activities, the requirements for use of the facility by the
general public as provided in Section II(B)(1) of this Plan, as
well as City and Aquatic Center instructional classes. Aquatic
Center staff will be responsible for recording instructional
class, and public use attendance.
6. Indoor Weight Lifting Facilities
Indoor weight lifting facilities are to be
used by Aquatic Center program participants only, and are not
available for independent weight training programs.
B. Motor Vehicles and Parking:
1. Parking:
The Aquatic Center shall maintain a minimum of
83 parking spaces for motor vehicles. Parking will be available
only during the previously stated operating hours of 6:00 A.M. to
10:00 P.M. If parking is utilized for storage of boat trailers,
such use shall be in addition to the minimum 83 parking spaces
provided for motor vehicles. Employees shall park in designated
spaces within the Aquatic Center parking lot.
2. Trailers and Trailering:
Trailers used to transport boats to the

Aquatic Center, and stored in the Aquatic Center parking lot,
shall conform to the Motor Vehicle Code. Trailering of boats to
or from the site shall occur only between the hours of 9:00 A.M.
to 4:00 P.M.
C. Use and Storage of Boats:
1. Outdoor Storage of Boats:
Outdoor boat storage is prohibited on the
leased premises. Requests for storage of outrigger canoes shall
be referred to the Department. The location for outdoor storage
of outrigger canoes shall be determined solely by the Department,
Parks, Beaches & Recreation Commission and City Council, shall be
on that part of North Star Beach maintained by the City and
County, and permission to store outrigger canoes will be granted
only after the applicant has obtained all appropriate permits.
2. Boat Fabrication:
No new boat fabrication will occur on-site.
Repairs to existing boats and equipment are permitted.
Section IV. Site Management:
A. Monthly Attendance Report:
The Aquatic Center shall be responsible for
recording daily attendance for all scheduled programs, membership
activities, and general public use. Attendance reports will be
reviewed monthly by the Aquatic Center Board of Directors, Dover
Shores Community Association representative and City
representative. Monthly attendance reports will also be
evaluated semi-annually for conformity to the maximum allowable
daily use requirement. The Aquatic Center shall develop
instructional class and membership activity schedules in a manner
which will insure compliance with the maximum allowable daily use
requirement.
B. Hours of Operation:
It is anticipated that the hours of operation will
be adjusted seasonally due to activity demand. However, in no
event shall the Facility be open prior to 6:00 A.M. nor remain
open after 10:00 P.M. A staff member of the Aquatic Center shall
be on site, and responsible for supervision of the parking lot,
beach area, launching facilities and the Center during hours of

operation. (Certain restrictions apply between the hours of
6:00-7:00 A.M. - see Use Regulations and Restrictions.)
C. Building Maintenance:
The Aquatic Center will be expected to develop and
keep on file a building maintenance program. The program shall
include a daily schedule and specifications and frequency for
each task. Although it is anticipated that building maintenance
needs may vary due to seasonal program activities, the level of
service shall insure that the facility's interior is kept clean
and free of litter and safety hazards on a daily basis. The
schedule shall specify the level and frequency of maintenance
performed on floors, restrooms, walls, window fixtures and
furnishings.
D. Grounds Maintenance:
The Aquatic Center will be required to develop and
keep on file a grounds maintenance program. The program shall
include a daily schedule, specifications and frequency for each
task. Although it is anticipated that grounds maintenance needs
will vary due to seasonal growth of plant material, the level of
service shall insure that the facility's exterior is kept clean
and free of litter and safety hazards on a daily basis.
Environmental maintenance must also be performed at a level which
will insure proper and timely trimming of shrubs and trees,
weeding and mowing.
E. Irrigation, Pesticide and Fertilizer Use:
The Parks, Beaches and Recreation Department shall
review the specifications and frequency for application of
pesticides, herbicides and fertilizers. The Department shall
also review the irrigation schedule. The Aquatic Center sha11
not use pesticides, herbicides, or fertilizers in a manner which
would cause those substances to intrude into the riparian habitat
on North Star Beach. The Aquatic Center is also prohibited from
using pesticides, herbicides, and/or fertilizers in conjunction
with the irrigation in a manner which would cause those
substances to enter Upper Newport Bay. The Aquatic Center shall
use native drought -resistant vegetation, minimize the use of
pesticides, herbicides and fertilizer, and take all reasonable
measures to prevent excess runoff.
F. Security and Lighting:
The building, grounds and parking area shall be
secured no later than 10:30 P.M. All activities in the Aquatic

Center facility shall be scheduled to conclude approximately
thirty (30) minutes prior to the closing of the parking lot. The
parking lot shall be secured by a chain or gate at the entrance
off Whitecliffs Drive. The parking lot lighting shall be
operated through an automated timing device which will turn off
the light at 10:30 P.M. The Aquatic Center shall be required to
maintain the parking lot lighting in a manner which will ensure
minimum light spillage and glare to adjacent residents.

Job Description
Searching for an administrative director for a public aquatic facility within the city of Newport
Beach. The Center will accommodate youth programs, general membership and public
programming in the areas of kayaking, canoeing and rowing on a year-round basis.
The director's responsibilities include (but are not limited to): overseeing all Center operations
(coaching, instructional programming, organizing special events, hiring/ management of all
Center employees, facility operations and maintenance, budget operations, assisting in
developing and implementing fund raising and interact on public relations issues).
