Having been born and raised in Newport, it is important that we as citizens be allowed to show that we
can be good conscientious residents. It is imperative that we be allowed to get out of our homes and
enjoy the numerous amenities our beautiful cities has to offer. Do not give in to the communist
overlord of a governor's closure demand. California's state leaders has finally broken the camel's back
and possibly ruined our economy forever!
I believe we should also do what's we can to assist our retailers in every way possible by supporting
their services. Thank you for listening to the residents of your city.

Dear Honorable Newport Beach City Council Members:
Please consider these points on the current situation as you ponder beach closure. Or
ANY closure. (Numbers I saw online mid-day today)
1) With an OC population of 3.22 million and a case count of 2,537 then 99.92% of
the OC population knows how to stay healthy.
2) 50 deaths in OC indicates that 1.97% of the documented positive test cases
resulted in death.....with an unproven attribution of all deaths to COVID-19.
Current news shows that COVID-19 primarily causes pre-existing conditions to
amplify and cause death.
3) 34,218 people felt they were so ill they needed to be tested. Of those 2,537
tested positive. This indicated that even when you feel really sick there is just a
7.4% chance that its COVID-19.
4) Extreme measures of (unconstitutional) forced distancing save a minuscule
number of lives yet destroy the lives of the vast majority.
s) Each citizen has a personal responsibility to protect themselves and their own
spread to others. An entire population cannot be punished because of the
ignorance and recklessness of the few.
6) Fundamentally citizens do not want to contract COVID-19. Extreme closures of
public spaces is assuming the citizens are, in mass, reckless and will act to
transmit the virus if left to their own free will. That is not the case.
7) Constitutional rights and extensive case law demonstrate that the Governor does
not have the authority to force massive restrictive control over the citizens of the
state. Especially when the threat is so very small.
s) Perhaps NB Police can comment on enforceability of personal rights restrictions.
Is the violation a willful intent to do harm to others? It is not illegal to harm
yourself.... it's called stupid.
9) Your measures to control parking and other means of access to the beach are
excellent methods of limiting gathering. Perhaps the residents adjacent to
beaches should park their cars in available street parking locations. No parking =
no visitors.
1o) The enforcement of beach closure rules is probably impossible. Can you imaging
a large contingent of fully uniformed officers dealing with beach sand patrols?

11) Our county hospitals are maintaining their COVID-19 caseload very well and I've
heard PPE is adequate and trending upward.
When looking at percentages of infections, the level of hospital care available and the
huge destructive effect of our OC citizens, the extreme measures limiting the rights of
ALL individuals does not justify the needs of those who ignore personal responsibility
and act without regard to others.

Hello again Council members.
You could have made a plan FOR THE RESIDENTS of Newport Beach, and you chose
not to.
You could have done what Laguna Beach did - when they made sure that *their*
residents could get to the beach for recreation and restrict the time in such a way that
thousands of other people would be unlikely to travel from Los Angeles or San Diego --
where the death rates from Covid19 are #1 and #2 among counties - with the potential
of increasing our infection rate (which has not yet gone down, even).
And now the residents in Newport Beach are suffering, but so are the residents in
Laguna Beach and every other town that chose to do the right thing instead of the
political thing.
You had to decide to choose a pissing match with the Governor over protecting your
fellow residents. Yup, a whole bunch of people that agree with you are throwing a series
of tantrums.
But your job is not to throw tantrums but to consider what is best for YOUR city's
residents.
This makes me sad, frustrated, and really sceptical about how you see your role.

I am a retired physician. My wife and I are 75 and live on the Balboa Peninsula. Opening the beach could cause our
deaths. Please follow the science. If you don't know ask an epidemiologist from UCLA for advice. Don't for one moment
think you know anything that could discount what they say. I thought I lived in California not Georgia or Texas. Please
get a grip on reality.

Hello fellow California citizen,
I just wanted to share these latest pictures of mine dated April 24 (Friday), 2020 at
around 1:15 Pm taken at Newport beach while I'm surf fishing at the "D" Street by the
shoreline. As you can see, I made a selfie on both sides of the shore from West -East,
the beach is almost empty and very, very few people around the beach. I wanted to
dispute this Gov. Newsom's twisted statement that people of Orange County are liars
and not compliant to the order of "King Newsom". Newsom said that more than 40,000
people is crowding the beaches of Orange County- another "Fake News!"
I am a resident of San Bernardino County and I traveled about an hour to my favorite
Newport and Balboa pier to fish for almost 18 years. My job hour was reduced to half
(20 hours a week) not enough income, and now the pier is closed and the parking
Iots.This make me sick that this "Chinese Virus" was used by politicians to violate my
Constitutional Rights in the name of "Health Issue". We have to stand our ground to
promote the truth.

Just a few hours ago, I got back from La Jolla, a rich and deep -blue enclave of the city of San
Diego that's the home of Mitt Romney. The just -after -sunset beach traipse was to see the
bioluminescence event. Beach waves turn glow -in -the -dark at night as a result of the red tide,
and it's a rare and completely yowza thing to see. Of course it drew a crowd. Street parking
was competitive. The cars just kept coming and coming on Coast Boulevard near Wipeout
Beach, and visitors bunched up at stoplights to use crosswalks — no slipping across the
streets real quick to get to the shore view from the cliffs. Here's a bit of the pre -weekend
flavor, and this was far from the most crowded scene I saw. You can see that the groups have
masks, look more like friends than families, and aren't socially distancing. You can bet
there's going to be more, much more, with the upcoming weekend's bioluminescence viewing.
I decided that this photo was relevant because California's Gov. Gavin Newsom singled out
Orange County and none of the other Southern California counties for full beach
shutdowns. Newsom claimed that a news photograph of Newport Beach proved that nobody
was socially distancing in the O.C. Never mind that Orange County has a far lower rate of
COVID-19 infection than the heavily urbanized areas such as Los Angeles. COVID-19
deaths in the O.C. number 45, while deaths in next-door Los Angeles County have hit 1,045.
And never mind that sunlight and fresh air, such as are found on beaches, are a natural
disinfectant. More specifically, never mind that beach transmission of disease is extremely
rare.
The whole shutdown looked suspicious, vindictive, even — San Diego and Orange County
officials all pleaded to the governor not to do it. But only Orange County got it, something
that, as I noted earlier, pretty much had the odor of Mrs. Grundy punishing the whole class for
something Reggie and Veronica did.
Turns out it was worse, much worse. Newsom let Lumpy and Eddie Haskell get away with
even worse because he had favorites. Political favorites.
San Diego County's coastal cities are now reliably blue. Orange County is historically red,
but ballot -harvesting has somehow made it blue.
It wasn't that Orange County was the most defiant. Actually, San Diego County was. Both
Orange and San Diego Counties had organized angry protests earlier — Encinitas in San
Diego County had at least two organized protests, with hundreds of angry surfers and
multiple arrests, while Huntington Beach in the O.C. had one small beachgoer protest. But
again, only Orange County got the restrictions.
Newsom claimed that it was the news photograph that did them in, supposedly showing
Newport Beach visitors supposedly not socially distancing. I disputed whether that was
really happening in this item here, and on Twitter, some Orange County denizens argued that
news photos could very easily be distorted to make crowds appear bigger than they were.
Newsom's response was creepy: he released a list of all the things Californians were still
allowed to do, which included watch sunsets, and he said Orange County officials had been
great in cooperating with the state and that his move against the entire county was "just a little
tightening."

Now Newport Beach and Huntington Beach are suing, and an emergency protest is being
planned for today, in Sacramento and probably locally. The Orange County sheriff,
meanwhile, has announced he's not going to play Newsom's beach cop, marching surfers off

to the pokey while bona fide child -molesters are being let out in the same county to "protect"
them from COVID-19.
Thing is, the Orange County beachgoers can now flock to San Diego and Los Angeles
Counties for their fresh air fix. That's not a big problem. They'll get their beach in San
Onofre and Vista and Oceanside, in Del Mar and Encinitas and Carlsbad and La Jolla, as well
as El Segundo and Venice and Santa Monica and Malibu, making all of those beaches more
crowded. But hey, nobody's enforcing in those parts.
The people the shutdown is really going to hurt are all the Orange County small businesses up
and down the crowded Orange County coast. Those are the ones who just got the Newsom
death sentence — the bike shops, art galleries, surfboard rentals, flip -flop -making companies
(hey, Rainbow!), bars, restaurants, and cafes.
It raises questions about what Newsom might be thinking. Orange County is historically
right-wing and there's an election coming up. The county has just swung blue in the last
midterm, based not on election night returns, but ballot -harvesting, which one by one by one
managed to flip every seat in the historically red county blue.
Is Newsom convinced he's got the county in the bag for the general election half a year away?
He's just provoked a huge sagebrush rebellion in that country along with lawsuits and likely
scenes of street rage. Things like this have the potential to flip elections from blue to red and
Newsom knows it.
What gives here? Is he convinced the ballot-harvestors have got Orange County so rigged it
doesn't matter how anyone votes? He knows the place is red, he's likely punishing them
because they are red, yet he fears no electoral consequences.
If so, one can only hope that he's wrong about this and he'll be in for a surprise. But rigging is
evil stuff and this highlights that these beach cities ought to be just as vigilant about electoral
corruption in the works, given that Newsom fears absolutely no consequences for his
fundamentally unfair act on one politically inconvenient county.

Dear Mayor and City Council Members,
I hope that your finance staff is coming up with a cost estimate for legal fees
should you decide to pursue a lawsuit against the state of California. They're
sure to be monumental and these costs ought to be considered as a critical
factor in your decision making. The City is already budget poor due to
COVID19 as reported last week. What gives you the right to put the City into
an even more severe budget deficit at the expense of us taxpayers?
Additionally, I am mystified that you're not seeking out a discussion with the
Governor to find a middle ground. Why not approach him with an
alternative, such as a plan that calls for specific hours of day when the beach
is open for activity, or resurrect the "close the beach for the next 3
weekends" plan. Do you have so much disdain for the Governor that you
would charge ahead without trying? It seems to me that this approach is
unprofessional and shortsighted.
I realize that the deck is stacked against me and like-minded residents, and
that this wasteful and distracting pursuit will be launched.

Dear City Council Members and City Manager,
I thought I might be able to relax for a while now that the beaches have been closed.
But no. Now you are having a special meeting to discuss suing Governor Newsom (with our tax dollars)
because he cares about protecting the people of his state.
I am 100% opposed to this harebrained idea. Check out the video footage of the COVIDiots protesting at
this very moment in Huntington Beach. Watch for the spike in cases next week, as the result of last
weekend. And watch for a spike the following week as a result of the today's mass gathering in HB. (Yes,
I know they have a right to protest. But they are endangering themselves and others in doing so.)
Please don't align yourselves with science deniers. Please read the articles about bodies stacked in
refrigerator trucks in NYC. Still. The only reason that has not happened here is because people have, for
the most part, been responsible and followed suggested social distancing and mask wearing guidelines.
Some need more help than others in being responsible, and I believe that is why the Governor stepped
in.
I appreciate how hard yourjobs are. I really do. But Governor Newsom is just asking for beach closures
for a month so that we can keep COVID case and death rates down. Why not devote your time, money
and energy toward making plans to slowly reopen businesses, obtaining more COVID tests, checking in
with local nursing and assisted living facilities to see how they're doing, or discussing what the
school situation will look like in the fall?
But another frivolous lawsuit? That's how you want to spend your time?
Please. Don't. Do. It.

As a State we have had relatively few deaths due to covid 19 . Yet the governor and local officers are
trampling our civil liberties. I live on Balboa Island and the walkway around the island is closed as are
the beaches. How stupid. How many people have died from suicide etc because of these
restrictions. Please use common sense and lift these restrictions and restore our civil liberties.

Hi Will:
I trust you and yours are doing OK and are staying healthy and safe. I
don't believe I've ever weighed in on an issue within the city, but I thought
I'd provide perspective from a Newport Coast resident and an O'Neill
supporter.
In a nutshell I do not think it's in the cities interest to get belligerent with the
governor. He will win the public relations battle with the general public, has
the bully pulpit, and frankly, from my perspective at least at this stage, he's
in the right. Whatever pressures the city council is under to open the
beaches, pales in comparison to the negative publicity starting a legal
battle with the state would bring. Any time a city as small as ours makes
CNN it is bad news. I also feel terrible for the citizens of beach portions of
our community and I think their quality of life should be the councils primary
focus.
Best wishes to you and the council as you work through this. You are
another set of unsung heroes that put time and effort into a situation you
never signed up for. Thank you.

As a lifelong resident, former Newport Beach ocean lifeguard, avid beachgoer and retired City
Manager, I urge you to ignore the Governor's beach closure order. This order is at best an
overreach, and at worst an unconstitutional intrusion on local control and the police powers of the
City of Newport Beach. I urge you to direct your public safety personnel to undertake no
enforcement action in response to this order. I also urge you to challenge this order in court.
Open access to the coast is a central tenant of the Coastal Commission, and this order flies in
the face of that state agency's raison d'etre. It is widely recognized that outdoor recreation is
central to both physical and mental well being, which is both highly prized and sorely lacking at
this time. The beach provides a broad open expanse where people can recreate safely.
The publication of highly misleading photos of last weekend's beach crowds has once again
proved the detrimental impact that irresponsible reporting has on informed decision making. My
personal beach -going experience of the past two weeks has been that the vast majority of people
are practicing responsible social distancing. To believe otherwise is to ignore the facts on the
ground.
The Governor's overly broad orders have already negatively impacted the state's economy. He
is unwilling to accept that whatever gains may have accrued in slowing the spread of CVOVID-19
during the first month of his stay at home order are now being outweighed by the economic
disaster threatening our state. As a tourist based economy, Newport Beach is particularly
susceptible to the negative impacts of this latest unwarranted action from the Governor.
Again, I urge you to ignore, challenge and fight by all means necessary the Governor's beach
closure order. Thank you.

I understand there are different viewpoints on whether to close the beaches in Newport and/or Orange County.
Regardless of whether one agrees with the Governor's action to close Orange County's beaches, I would implore the City
Council to not seek legal action on this matter. It would drain precious resources from our City coffers and well as the
State's. Perhaps we can "ride" this out a bit longer or discuss the issues with the Governor. It would be good to keep
busy with more important things keeping Newport Beach running during the pandemic.

I want to thank you for your recent meetings and voting to get OC open again, and to keep the beaches
open. Our county has rallied together during this time. Our families have cooperated and stepped into
homeschooling. Residents have obeyed the orders. We are now looking at a very low level of this
disease in our hospitals and a flattened curve in OC. Gov. Newsom's overruling of local officials (NB
Mayor, council and local authorities stating based on data that they believed our beaches should remain
open) feels like a massive overreach of his authority.
Please consider a lawsuit against Newsom as defenders of our rights.
Citizens in our county have been compliant to the terms set out in the beginning of this. We have
experienced economic loss and have cooperated. It is time for us to be able to use our own wisdom to
follow social distancing protocols and be able to enjoy the sunshine and fresh air on our beloved
coastline.
We need to be as healthy as possible when the Fall sickness season hits. It is in the best interest of
every non -immunocompromised OC citizen to get outside and begin building their immune system
NOW. That is far healthier than waiting on a vaccine, which will have known side effects and risks.

In light of the recent order to close all Orange County beaches I feel there needs to be some sort of
provision within it to allow surfing, boogie boarding and body surfing, ONLY. Similar to Black Ball
restrictions but for beach access.
Surfing in general exceeds the social distancing requirements merely due to the constant movement of
the ocean. Additionally, most people that do surf regularly are there very early in the morning and do
not "hang out" or congregate on the beach. What happened last weekend was an anomaly and clearly a
bi-product of 100 degree temperatures.
Here is a simple solutions that would work
• Adapt a Black Ball program but for the beach, restricting access from the hours of 9AM to
7PM. Issue tickets or citations between those hours.
This would be relatively easy to enforce with officers on ATV's on the beach, officers on bikes,
etc. Basically, just like a normal Summer day.
I feel it is unjust to restrict a small group of dedicated ocean goers due to the irresponsibility of a larger
group of people, most of whom came from outside the area.

It is my guess that some day, each and every one of you will be thanking the governor for what he has and is doing in
California. The only reason California is doing better than a lot of the States is because he has intervened, when the

You had the opportunity to close the beaches just on weekends, but decided not to do that.
Now Gov Newsom has had to decide to close the beaches as a precaution for our health
and safety. This may not last too long, but it could have been handled so much better by

Dear Mayor O'Neill and the Newport City Council -
Per my emails to you below, I have been a supporter of closing the beaches to promote adherence to
the California stay-at-home order. I now see in the media that you are contemplating fighting the state
on their recent action. Please don't. This would be an emotional response -- a few weekends at the
beach is not worth fighting over -- even if you 'won', what would it achieve for our city? In the process,
we will only create more division within our local community and with the state government -- and this
matter has driven way too much of that already. Please lead us in working collaboratively with the
state.
As a father of a 7 year old and 3 year old, I have become familiar with Daniel Tiger during the stay at
home order and I expect some of you may be familiar as well if you have young children. Daniel Tiger's
mom would say (sing actually) "Give a squeeze, nice and slow. Take a deep breath, let it go". Please
consider this advice.

closed similar to the state's beaches, county's beaches, and our neighboring Huntington Beach's. The
message has consistently been sent out by our City that people ought to be following the state's

coastal access and we strongly encourage local governments to consider approaches that balance
public health order requirements and equitable public access -- the coast belongs to

. With Santa Cruz and Ventura opened last week, San Clemente reopened today, and San Diego
County reopening Monday, we would expect easing throughout the county, but surely there is
something that we can do better for our residents.
To the extent you are relying on pictures, it's worth looking at the attached pictures taken from our
police helicopter yesterday. Side angle pictures always make situations look more chaotic, top-down
tells the story.

I am writing as a constituent — and am epidemiologist at our local university — to comment on the beach
closure issue.
First, as someone who lives walking distance from Newport Beach and as an avid surfer, I understand
how important fresh air and sunshine is and how much we all love our local beaches. When the beaches
were open, I took advantage and, like many of my neighbors, was down at the beach last weekend. I can
report that many people were maintaining social distancing. I can also report that *many* people were
not, and additionally many of my neighbors were complaining that the lockdown was stupid, a
conspiracy, and a hoax. As a scientist, I can assure you that is not the perspective of the medical or
epidemiological community. Despite my own personal desire to keep the beaches open, the overall
consensus of the public health community is that the beaches should be closed in order to safely ease
restrictions and prevent a "second wave" that will necessitate us starting these strict social distancing
measures all over from the beginning.
As such I implore you *not* to take legal action against the state. I believe that a few weekends of
sunshine are not worth the overall dissent legal action will cause, and will communicate to our
community that social distancing is not important, fuel anger in people already upset about the shelter -
in -place order, and ultimately hinder economic recovery. The longer it takes to get the virus under
control at a statewide level, the longer these restrictions will persist. Moreover, a second wave that
necessitates a second lockdown would be absolutely devastating to the local economy, that has already
suffered so much.
I humbly ask that you not succumb to political pressure and make the right choice for both public health
and economic recovery of our community. A war with the governor is not going to accomplish our goals
of a swift recovery. Our community has done so well getting this virus under control. I think a few more
weeks of sacrifice will be well worth it in the long run.

I understand the multi levels of this issue. I do feel that a compromise is possible to:
1 -Keep people safe
2 -Keep our neighborhoods less crowded from people coming from all over.
3 -Allow locals to use the beach for health and well being.
We could:
1)Have beaches open to exercise- moving, walking, jogging, swimming, surfing, NOT sitting, sunbathing etc....
2) have beaches open from limited hours so people can use them for exercise 6am-10am or something like that.
3) A more difficult thing would be to check ID for residency.
From witnessing what has been happening at the beach over the last 5/6 weeks. I go every day.
What changed was that when all of the other beaches closed (LA, San Clement and San Diego) and the weather was nice
the crowds came. With so many people unemployed and not knowing what to do, our beach became their activity. The
problem that I saw was huge groups, not wearing masks, not socially distancing and partying on the beach. Or even in
the streets! Not respecting the neighborhoods, people's properties etc .... This is the problem. Not the walkers, joggers,
surfers etc....
Please consider ways to stop the influx of people without taking it away from everyone. Most people have been using
the beach in a respectful and safe way.

Per Fox News this morning, who had the Mayor of San Diego as a guest, San Diego
beaches will be open. They got some "special dispensation" from the Governor's office
because of the SD rules for beach use worked out well last weekend.
Beaches in SD are open for walking, jogging, swimming. You CANNOT SIT on the
beach. Police, lifeguards, etc are there to patrol and inform those at the beach.
Can we do something similar in Newport Beach, rather than litigate?

Attention City Council:
I think it is very disappointing that some of the Council continues to oppose the decision of Governor
Newsom. I wonder if any of you could have led the successful fight against the Coronavirus that he
did? He has the overall support of the state ( see the poll in today's LA Times) for being one of the main
heroes in our battle with the virus, which is not close to being over. Without his quick and strong
leadership, many of us could have lost a loved one or been a victim of the virus itself. And that battle is
far from over.
The possibility of exposure passed on by a day or two of pleasure at the beach compared to the health
risks not just for the beachgoers but the community is unconscionable.
The California Coastal Commission does support the Governor's stance.
This has become a political issue and shows that we are incapable of appreciating true heroism when we
see it. We are more concerned about our own political future!
I just wonder if we would see any of you and your families on the beach enjoying yourself, knowing that
the threat of exposure to the virus was still strong. I would hold my loved ones close and protect them
as much as I could. And in your position, I would do that for my constituents as well.

It has been reported that the City Council voted yesterday to pursue injunctive action against the State
of California regarding the governor's order on beach closures.
As a taxpayer and resident of Newport Beach and of the state of California, I implore you to reconsider
that action. You will waste my taxpayer dollars on both sides of the action, as a Newport Beach
taxpayer and as a State of California taxpayer. For what benefit? Beach closure under these
circumstances is a short-term issue and the supposed constitutional issue, which I suspect the City will
lose, shouldn't be decided based upon a short-term beach closure order.
With all levels of government already facing severe budgetary issues, this is a total waste of taxpayer

This email is in response to the Governor's closure of our beaches.
My family and I were at the beach in West Newport last Saturday and the scene was vastly different
than what has been portrayed in the media. Everyone on the beach was social distancing and sitting
well over six feet apart. I went surfing and everyone in the water was keeping their distance, as well.
While the beaches closer to the pier may have been more crowded, the crowds were likely comprised of
people who do not live here. In fact, as we rode our bikes under the Newport Blvd. bridge you could see
large numbers of cars - likely from out of town - descending on the Peninsula as if it were a peak
summer weekend day. THOSE are the people who are not doing their part by staying in their own
neighborhoods, not the local residents.
My suggestion is that you restrict automobile traffic on the Peninsula and West Newport to residents
only and close nearby parking to prohibit visitors from parking in nearby neighborhoods, including
Newport Shores. Restricting access on July 4 has been effective for the most part and blocking nearby
parking would provide another level of security.
We have been doing our part in this crisis by keeping our kids at home and away from their friends. The
beach is the one place that we have for them to get out of the neighborhood and get some fresh
sunshine and exercise, while still social distancing. We also willingly pay our unfair share of property
taxes to live in an area that allows us access to the beaches via bicycle (another healthy activity). It is
not right that we are denied access to our beaches due to the selfish activities of others that do not pay
to live here.
Please come up with a solution that allows our beaches to stay open to Newport Beach residents, while
keeping us all safe (including the visitors) by prohibiting access to those who do not live here.

I am a 50 year owner whose age is 83 and I am a resident of West Newport. I live on Seashore and I
support the freedom of all to go to the public beach. I have seen good social distancing and a few
bad. This would happen anyway in any streets.
I feel more threatened now with all the apartment dwellers now forced to exercise on the streets.
I am much closer to people now that I am forced to exercise on the street rather than on the beach,
I believe surfers are also no threat, but being penalized. Many residents are in that 40;000 that you
quote, so it's not all from out of town.

Dear City Council Members: Before you take the misguided step of suing the state because of the order
to close the beaches, I'd like to take issue with your claim, made by Mayor Will O'Neil, Councilman Kevin
Muldoon and others that Orange County has "flattened the curve" on the Coronavirus so opening
beaches and, in fact, reopening other parts of our closed city and country is merited. According the the
CDC (and virtually all epidemiology textbooks), the curve that needs to be "flattened" during an
epidemic is the cumulative cases curve, not the new cases curve. All you need to do is look at our
current curves to see that our cumulative cases are still rising at a fairly steep angle. When the new
cases curve is flat, if it is at a substantial rate—and OC's seven day average rate for the last week was 85
new cases per day—the cumulative curve continues to rise. The only way to flatten it is to reduce the
number of new cases, not keep them steady. No new cases would completely flatten the cumulative
cases curve, but lessening them would at least reduce the upward trajectory and flatten the curve
somewhat. This would be the type of flattening of the curve that could be used to justify relaxing the
lockdown. This is not happening. Not only has have the rate of new cases not declined, but four out of
five of the highest days of new cases occurred this week! This certainly does not indicate that we have
turned the corner on reducing the danger of the coronavirus, and council members should stop claiming
that OC has "flattened the curve" on the Coronavirus, because if they are referring to any curve at all, it
is the wrong curve and not the ones that epidemiologists or the CDC look to to make decisions.

home. Have you been to Came Shores lately? If not, I recommend you drive there any day of the week right now at any
time. You will see over 50 cars parked that DO NOT live in the community. Each of these people is using our
neighborhood to park their cars and go surf, exercise without masks or social distance, or lay out on the beach. These
people all bring with them their own DISEASES. The signs for this neighborhood are childsplay-- a small sign that you
can't even read when you are driving unless you get to 6 ft away. There is 0 enforcement. So are these communities
like Cameo Shores supposed to suffer because you keep the beaches and parks open?
It seems none of you have had a family member pass because of this disease. If you had, your decisions would not be so
irresponsible. Challenging the governor is irresponsible. Should there be a single death after the date of your challenge,
if its accepted, you should be responsible for that death and claim responsibility for it due to the terrible decisions
made. Follow the orders. Tell people to stay at home. Be leaders in the community. Isn't that why you are all ELECTED
officials? To give a voice to the PEOPLE? The people want to LIVE. Anything else is not good enough-- CHOOSE

I have been a resident of the Balboa Peninsula for the past 26 years and a homeowner here for the last 11 of those
years. My home is near Coronado but on E Bay where the beaches are vast with sand and usually quiet (even in the
summertime). I am an avid runner and my daily runs on the beach bring me peace and centeredness. I was struck with
great surprise when Governor Newsom took the stance of the hard closure of all OC beaches. And quite honestly, it
causes me a lot of angst to not be able to run on the beach.
So, my question to you is this: should the beaches remain closed to the public, is there a way to find a compromise by
allowing residents accessibility to exercise (run, walk, surf, swim, paddle board, etc)? The complete and sudden closure
of the beach seems so severe based on the influx of non residents who came to the beach over one weekend at the end
of April. That weekend was not an accurate depiction of how Newport has been daily since the Stay at Home measures
have taken place.

are having an emergency meeting tomorrow morning at gam and that there is a lawsuit being filed by
Dana Point and Huntington Beach against the state of California. I would like to ask that Newport Beach
join in this endeavor. The Governor is forcing more unprecedented and unwarranted (given the new
treatments and relatively low number of cases California has experienced) restrictions upon the citizens
of this state.
We were told 30 days to slow the spread, which has come and gone. Indefinite house arrest was never
in the cards and is completely unconstitutional. There is already evidence that coronavirus is killed off
by sunlight, there is no reason that our children can't play at parks and that beaches cannot safely
remain open. The state should be working to re -open things and return to a more normal/healthy way
of life.... instead the Governor appears to be implementing further restrictions!
Elderly and at risk individuals can continue to be protected while the rest of the population returns to
work and more normal behavior. This will help with people's mental health and keep them out of
poverty - we cannot continue to keep business closed and ruin people's ability to make a living.
Please hear us! The majority of citizens strongly object to these draconian measures... please fight for us!

I encourage you to follow the order by our Governor to keep Orange County beaches closed. Some of you may have
made to keep them open on Tuesday because of the recommendations of the Police and Fire departments chiefs. First
you should know that they both have strong biases about whether they should be patrolling the beaches or with the
lifeguards having any responsibilities to enforce laws on the beach. You may believe that the pictures they showed you
were the reality of what was going on here last weekend, it was not. If you had been to the "L" street beach you would
have seen much larger crowds with little or no social distancing and most without masks. Do the right thing until this

Thank you for all your hard work trying to come to a compromise with Gavin Newsom and the CA ORS.
When I read the document to Newport Beach from caOES, It reads that they are wanting to open the
beach with some guidelines in place.
CalOES verbiage:
"We continue to encourage residents to spend time outdoors in their neighborhoods and local parks
that remain open for activities while maintaining safe physical distance. Additionally, we are hopeful and
confident that we can collaborate with local Orange County leaders to identify measures that can
restore safe beach access as soon as possible. But until such time as those measures are in place, this
additional step to preserve public health and safety has proven essential."
I suggest two options
1. Make the beach an active beach Saturday and Sunday only. This will fall into California current stay at
home order.
2. Close the beach from 10:00 am to 5:00 pm Saturday and Sunday
If Newport publicly announces either option and media covers this information, lots of non Orange
County residents will find it difficult to make the voyage to our wonderful beaches.

If the City sues the State I assume that by the time the suit is heard in Court the beaches will be open and perhaps many
business that are currently closed will also be open or opening. Therefore (not being an attorney) I again assume that
the damages that can be claimed as a result of the beach closures ordered by the State, that will stand up in the court
would be for the additional costs incurred by the City for safety services and enforcement of keeping the beaches
closed. And the costs involved in the filing and processing the suit may over shadow the possible remuneration to be
achieved.
It appears that these costs and thoughts should be considered and weighed against any possible moral victory.
Should we not be considering the costs involved in the suit as an additional burden on the lower revenue the city will be
realizing in the budget due to dwindling Sales Tax, TOT and other revenue sources affecting the City during this
Pandemic?

I've been doing physical therapy for my knees and legs from being hit by a pickup truck a couple of years ago for about
1/2 of the days that the pandemic was going on on Newport's dry sand beaches.
The only criticism is in the very beginning it took a little while for the city to close the boardwalks and I did notice it first
when I was working on the boardwalk that joggers wood huff and puff right next to me.
So I started walking right down the middle of the beach on the dry sand with a gigantic buffer between me and any
other people usually crossing the beach to get to the waterfront although some people once in awhile like me walk
lengthways in the dry sand or jog in the dry sand east/west.
I grew up in Newport from age 8 to age 18 in the 70s.
I am now a visitor.
What I have noticed the entire time is almost a paranoid level of lifeguard police and fire vehicles patrolling the beach to
make sure that people are keeping a distance and usually they don't need to tell anyone anything because people are
using common sense and maintaining, even closer to the water, in worst-case 20 to 30 foot distances I would say from
each other or each family or couple.
And in the middle of the dry sand you only rarely see a few sunbathers.
I read in the daily pilot today online that the photos in question that angered the governor were utilizing unrealistic
telephoto lenses.
And I'm actually wondering if there's any proof that those photos were taken when the news sources claimed they were
taken. how do we know those photos aren't from some Fourth of July in a past year such as last year or before the
coronavirus pandemic?
The police aerial photography shown in the news over both news over both Pier locations show the same thing that I
have stated above in terms of worst-case distancing that I have seen with my eyes of 20 or 30 ft apart.
I was not at the beach during this Heat wave last weekend I will admit, however.
If you Google you will see that walking barefoot has many health benefits, it's been proven, including reducing
inflammation. this is probably why I can walk a long distance with my bad knees on the dry sand, and get a good
workout without having any pain. it has to do with the body's electrical basis and electrical grounding on the Earth while
walking barefoot.
So for me Newport Beach is an invaluable way for me to conduct physical therapy from a pickup truck hitting me while I
was in a crosswalk 2 years ago.
Not to mention in my opinion the safest place to be from the coronavirus. because this entire time there has been a
strong Sea Breeze coming off of the ocean which would blow away in a microscopic virus particles, you don't need to be
a biologist to realize that.
Even if the sunlight theory is an urban myth which it sounds like most scientist believe that it is not, you can't really
argue about the fact that a strong Breeze and fresh -air does just what the doctor ordered for a virus like this.
After all if I were to instead walk in a residential neighborhood on the sidewalk, which I think sidewalks are usually only
about 4 feet wide, I'm going to pass people about 1 foot distance from my mouth to their mouth. and there's way more
risk because I have to stay on the sidewalk. whereas on a 800 to 1000 yard wide Beach I have a huge amount of space
and I can take an indirect route to avoid oncoming people.
The governor seems to be picking on Orange County coastal cities, which is known to be heavy regarding Republican
voters.
In order to avoid lawsuits from cities and beach area restaurants still open, I think he would have to have closed every
beach in the state rather than discriminate based on one or two questionable photos in the Press that might not even be
time/date-stamped.
On top of this I'm betting Newsom has never visited Newport Beach and doesn't realize how large the that beaches are
here nor how sparsely populated they usually are.
All of the city parks are closed. the sidewalks are dangerous places to walk because you pass one foot next to other
people. we don't even know if masks are working on sidewalks unless they are n95 masks, and even those may not be
working because obviously we have to breathe in air to get oxygen.
For people who live in apartments, their neighbors could very well be 37 ft away from them or less, if both of the
neighbors' windows are open.
OC hospitals can ask coronavirus patients if they have been to the beach recently, and then we would know if there's
any real link between Beach going and infection.
The pandemic has put a lot of stress on everyone and everybody knows that Sunshine fresh air and exercise are good for
stress relief.
I have also noticed that the City of Newport Beach has closed both parking lots at both Piers for most of the pandemic to
reduce the congestion at the pier locations.
I urge you to join Dana Point and Huntington Beach in sending a message to the governor that the cities know what
they're doing with their own beaches, and issue a restraining order against the governor and state as well as a lawsuit to
set a clear precedence for local governance.
The boardwalks should remain shut down until everyone has gone back to work in my opinion.
The lifeguards, fire and police Personnel should be commended for doing an excellent job of maintaining Common Sense
distances on the sand.

Please consider joining HB and DP in their efforts to obtain a restraining order on the beach closures. The beaches
should be open for recreation only. Running/jogging/swimming etc. No sitting/chairs/umbrellas.
This is unfair and frankly so depressing. I run crystal cove every morning and generally don't come within 6 yards of
anyone! Even in hot weekends. At least open from 6-10am.

It appalls me that Newport Beach leadership would vote 5 to 2 to keep beaches open in a time of a pandemic. I moved
here in January from San Francisco, and if I had any idea the in leadership in this area was so weak in regards to keeping
their resident safe, I would never have left San Francisco. Keep beaches closed in the spread of COVID-19 down. Think of
the lives of those at risk, not of just yourself; the folks that are selfishly putting others are a risk not following distancing
orders. These are the same people not wearing masks, washing hands, and not following shelter in place initiatives. The
sooner we all stay home for 14 days and eradicate COVID-19, the better. Let's not undo all the progress we've may by

I am a Newport Beach resident writing to beg you to keep the beaches closed and to stop threatening to harass Gov.
Newsom for making crucial decisions that help protect us all, including healthcare workers. I am happy to give up beach
access temporarily in order to avoid having blood on my hands, and everyone I know feels the same way. I would expect
the same of our city's leadership, and have been disheartened and embarrassed to instead see them in the news making
Newport Beach look so backwards and dangerous.

Please consider supporting the compromise between the county and state officials to allow active use only on
the beaches. Please withdraw support of the litigation filed by Huntington Beach, Dana Point and business
owners seeking to reopen the beaches. I support beach closure but understand this can be a win
win. Newport Beach can be a good neighbor to surrounding cities and counties while supporting the stay-at-
home order to protect the health of all Californians and Americans - the virus does not respect county lines or
state borders. I love the beach, but this little slice of heaven is now at the center of ugliness and hate. I was
proud of how California was handling this crisis but now I am discouraged. This is a global health emergency;
we are all in this together. If we take appropriate actions to slow the spread of Covid-19, we will come out of
this sooner. Please rise above the politics, lead us in uniting Californians to facilitate compromise for the
greater good. Please take this opportunity to show the Nation the true beauty of Newport Beach, California.

I understand this is a crazy time right now. I just thought that I wanted to share my opinion on the beach closure. I have
been living on a boat in Newport harbor for the past three years and continue to coach the girls surf team for Newport
harbor high school. In my opinion I believe we should shut down the sand and sunbathing while it keeps the beach
population down and respects the residents that live in Newport. I believe we should keep the beach open for running,
walking, swimming, and surfing Surfing is my lifestyle and my form of exercise. I do want what is best for the community

Why does Newport Beach need a special meeting to decide if they should file legal action against
Governor Newsom? File it. What more proof do you need, than the article below to know the
Governor is playing politics, always has. Why didn't Newport Beach join Hungtingon Beach and Dana
Point last night in their suit? What is everyone afraid of? Quoting FDR after the attack on Peal
Harbor, "the only thing that we have to fear is fear itself'. Government and the media have certainly
worked over the fear factor.
While in the suing mode, why not file suit against the Coastal Commission for nonperformance and
negligence of their duty to keep Beachs open to all Citizens. A few years ago, this Commission went
ballistic over a few citizens in Newport Beach for planting flowers on the beach area in front of their
homes. Now a "rogue" Governor, has ignored this duly elected Commission, by the People of
California. It's goal is to protect one of California's most valuable assets, their Beaches. The Costal
Commission, like cancer, has continued to spread their authority, beyond the original intent. But now
they are silent???? Closing City Parking Lots and putting up signs on City streets, Resident Parking
Only, while might win votes, is illegal. You cannot have it both ways.
All of this become more in focus when you read Amendment 1 of the Bill of Rights.

First of all, I would like to thank those of you that voted to keep the beaches open. I have an oceanfront house and I
have seen small groups of people exercising and families spending quality time durning this crazy period. Every day I see
people social distancing first hand. There are very few behaving badly and those people would not social distance
where ever they are. The beach didn't make them do it. To punish all for the few you can never control is so un-
American. It is healthy to be outside both physically and emotionally . With is quarantine lasting so much longer than
anyone expected, I'm worried about both. Walking on sidewalks and paths is far more difficult to distance from others
as opposed to the expansive beach.
Please do what ever is necessary to push back on Gov. Newsome's hard closure of our beaches. You managed to get us
out of his sanctuary state order. Can we go that route again?
Also, Please open up the short term rental and small businesses as well. We need the revenue.

A quick note to say THANK YOU!
Thank you for immediately and publicly pushing back on the beach closure order from the
Governor. We are adults and can make informed decisions regarding distancing ourselves from
others to help prevent spread of disease. Obviously there are some that lack common sense and
need to be reminded of why they need to keep their distance and clearly, the Newport Beach Police,
Fire, and Lifeguards are going about this in a measured and proportional way, unlike LA and San
Diego. The reason we had any number of folks at our beaches this past weekend is because people
from LA and SD traveled to go to the beach, but this is completely lost on the Governor.
The Governors beach closure order is a huge overreach of power, but what else should we expect
from another far left governor that has, like many of his predecessors, routinely violated his
Constitutional Oath and signs reams of unconstitutional legislation into law.

As a resident, I would like the city to fight the governor's targeted OC beach closure order. Please join the city of

1) The picture that led the governor to close the beaches was misleading and taken at an angle to make it appear that
everyone was bunched up. They were not.
2) The beach is our local place to walk, swim and relax. Other cities have big parks with grass. We have a beach with
sand and are being singled out.
3) The Covid19 infections and deaths are very very low compared to LA, San Diego and many parts of California. We are
not the problem.
4) The governor has overstepped his authority. We have a right to assemble.

As 35 year residents of Corona del Mar, we are absolutely opposed to you spending city resources on filing or joining any
litigation against the state in order to re -open our city beaches at this time. We are in the midst of a public health
emergency, and it is the City Council's responsibility to protect the health and safety of our community, first and
foremost. The crowds at Corona del Mar beach last weekend were not practicing physical distancing and they put the
health of city residents, police, and lifeguards at risk. That was unacceptable behavior and needs to be stopped

representatives to put politics aside and use your positions to educate the public that while we all love our beaches, we

Thank you Mayor 0 Neill for standing up to Governor Newsom's unconstitutional attempt to infringe on
our rights & take away our freedoms. I am considered one of the most vulnerable to Covid19. I'm a 66
yr old female with some under lying health problems. The Newport peninsula has been my home since I
was 10. 1 have always felt blessed to live here especially since my annual income is only $27k .... I'm not
your typical residentQ. In the last 2 months since restrictions started being placed on our
community... I've been denied the right to see & spend time with my family & 7 grandchildren whom I
helped care for. I've been denied the right to see my 90 year old mom with altzheimers that I have spent
every Friday with for the last 7 years, I've been denied the right to go to church or meet with my Bible
study group or my friends. I've lost my part time job as well as been denied the ability to rent a room in
my home ...my monthly room rental accounts for half my income. I've been forced to isolate on my own
& life has gotten much more difficult, I can't run to the store and pick up things I need ... like toilet
tissue ... 4 weeks without because all this craziness! The only thing I've had to look forward to is daily
walking the boardwalk (with mask) or sitting out on the beach I love and reading a book. Now that has
also been taken from me. I know I'm not alone, there are many people in our community suffering and
having their families & livelihood torn apart ...some may not be able to recover. I understand
people have died from this awful virus and I pray for those that have lost loved ones, no one wants
that -and most of us have given up much to try to part of the solution. However it's time to stop hiding
in fear an get back to living. At this point I would risk my health, to live free & have access to what
makes life worth living. Honestly, I feel the governments over reach has caused more damage &
suffering than the the virus to our community. The virus isn't doing me in ... the response to it is. I
understand due to COVID-19 we have lost 55-60 lives in OC, and it's awful ..that said, for the last 4 years
I've worked as a volunteer in the local homeless community ....in this country we lose 300+ lives every
week to drug & alcohol abuse.... nothing is said or done to help save those lives & help these people get
clean/sober... so forgive me if I find it difficult to believe that the loss of human life is really what's
behind the state governments reaction to this virus. I could go on and unload a whole list of problems I
feel are more important but I won't... Im sure you are already getting an ear full '.I really just wanted
to share my story and perspective but also to thank you for standing strong at a time when it's not so
easy to do. Im grateful when I see a leader do what's right and exhibit wisdom & courage ... you have my

I know having the national spotlight is not an easy thing, but you must asses the local situation and do

I've taken my family to the beach a handful of times during the quarantine and everytime we leave we

Hi members of City of Council,
I am a proponent for keeping our beaches open but really am asking you to open the City back up as
soon as possible.
I am a born and raised NB resident and current business operator in the city. I grew up in the best of
times when blue collar workers were able to afford homes almost everywhere in the city. My friends'
parents were teachers, roofers, department store managers, landscape architects, carpet cleaners,
etc. I worked as a lifeguard for the city of Newport Beach for 5 years as did my brothers and friends. My
brother and I now own and operate a small real estate firm, Balboa Realty, in the nearly extinct Balboa
Village. Balboa Realty does vacation rentals, yearly rentals, and sales. We have no income from
Vacation rentals, most people are paying their rents on the yearly side (but for how long?), and sales are
on hold.
Before Coronavirus, Balboa was a dying community of seasonal businesses and derelict or vacant
buildings. With the current draconian shutdowns, every business but Great Mex and the liquor store are
not open even if they could be due to the lack of patrons. The City's shutdown of vacation rentals did
not only NOT keep anyone safer (See any facts about the "numbers"), but ruined people's vacations,
nearly devastated our business and forced owners to make tough decisions.
Meanwhile hotels IN RESIDENTIAL neighborhoods with properties 3 feet away continue to operate. In
fact, our linen delivery company says they are actually busy. This includes Balboa Inn with residential
properties on all sides (one of which we manage), the Peninsula Hotel with Residential properties to the
side and behind it, the Little Inn by the Bay, on the middle of the peninsula, the LIDO hotel, and so on ... I
could keep going on but I think you get it.
If you could explain to me how cars coming and going with people from out of town to these hotels for
nightly stays is somehow ok but vacation rentals aren't, I would love to understand. Are vacation rental
guests more likely to dance around in the front yard of their neighbors and "spread"
coronavirus? Excuse my sarcasm but the lack of logic in the government's decisions thus far has forced
me to be bitter, cynical, stressed and depressed. All of which before this nonsense were not a part of
my daily life.
It has forced property owners to make tough decisions. Decision 1: Wait until the overreaching
government "allows" American free citizens to make their own decisions like go outside, travel, or play
in a park while being "safe"
Decision 2: Rent to a yearly tenant.
Decision 3: Sell their property to cover expenses.
Today, we were just FIRED by an owner of a Balboa Island Bayfront property for whom we have
managed their vacation property for the past 5 years. Why? Because they feel very uncertain about the
summer bookings happening due to the City's decision to shut them down, coupled with the fact that
they have made ZERO income since March and will continue to do so since no one is booking properties
for the summer due to the uncertainty and their own loss of income.
With just that one property, we lost a good amount of potential gross income not to mention the July
bookings we already had booked that we now have to move. We can survive for maybe one more
month before we have to fire our staff and potentially shutdown our vacation business entirely, severely
crippling my livelihood. By the way, just in January, we were in the exact opposite position, on track for
a record year, moving our business, and high fiving all around. What a 180. ALL OF THIS ENTIRELY
caused by poor decision making based on FEAR.
For GOODNESS SAKE. OPEN UP so every resident can make their own decision. If you want to stay in
your home and complain about the people walking around outside, please be my guest. I will not stop
you. Just as you should not be able to stop me from making a living and putting food on my family's
table. The danger is over and it turns out there never was any.
If you made it this far, thank you for reading and I hope you consider all of those citizens, travelers to
our wonderful city, and business owners that put money in the city's coffers and contribute to our great
society. This is still America and it's not too late to save it.

Dear Newport Beach City Council,
Nearly forty years ago I moved to Newport Beach from the frozen tundra of central Wisconsin, so I could
play Frisbee, surf and get sunburned on a California Beach. But today, because of a few,
unrepresentative news images taken with a telephoto lens, I can't step foot on the sand.
We have a pusillanimous Governor who treats us like kindergartners and chooses rumor over facts,
publicity over duty, welfare over work and fear over freedom. Instead of offering reasonable adult-
oriented guidelines, he shuts all beaches in one of the healthiest, least -sick countries in the country. it
defies logic.
Please, dear Members, be bold, be united, be audacious. This opportunity to bring our community
together behind your leadership comes along once every twenty or so years. So be leaders.
Take Governor Newsom to court.

Thank you for taking the correct stand on keeping our beaches open. If it's OK for us to shop in Costco or
a supermarket it's far more safer to be on the beach in the sun. I'm 72 years old and it's important for
people like myself to be outside getting exercise and fresh air. I see some of my friends just rotting away
staying indoors. They will never be the same after this. If the governor gives you any crap, just tell him
Newport is now a sanctuary city.

Item V. PUBLIC COMMENTS ON AGENDA ITEMS
As indicated in the additional comment below, I was startled and dismayed to learn the Council held
an emergency meeting on April 30 (likely one of the very few in the City's long history), and I am
equally perplexed to discover it is planning a special meeting on May 2 to consider suing the
California Governor.
First, I am perplexed by the procedure by which the May 2 special meeting was called.
Special meetings are supposed to be special. While it is true Gov. Code Sec. 54956(a) allows that
"A special meeting may be called at any time by the presiding officer of the legislative body of a local
agency, or by a majority of the members of the legislative body," Newport Beach has a more
restrictive procedure adopted by the Council in Policy A-1, and per Gov. Code Sec. 54953.7, the
more restrictive provision (giving the public the most access and notice) is supposed to prevail.
Per City Council Policy A-1, for Newport Beach Council members to have an item placed on any
Council agenda (regular or special), the request has to first appear on an agenda under ""Matters
which Council Members have asked to be placed on a Future Agenda," at which time at least three
Council members have to vote to put it on a future agenda.
At the Council's hastily -called April 30 "emergency" meeting, Council member Muldoon inquired
about discussing the City's legal options with regard to the Governor's order(s). The City Attorney
indicated that if four or more Council members contacted his office with similar requests, he could
schedule the item. While this may be permissible in other jurisdictions, it is a violation of our Policy
A-1. In effect, the City Attorney invited the Council to take the policy -required A-1 vote outside a
public meeting, something prohibited by the Brown Act. Among other problems, the public did not
get to see which four or more Council members tasked staff with preparing the agenda item.
Second, I am perplexed by the announced purpose of the meeting, which is to consider suing the
Governor and various state officials over emergency orders they have issued. At a time when the
City expects to be strapped for funds, this seems like a pointless and wasteful use of resources. In a
best case scenario, I can imagine the City being granted a restraining order by a sympathetic judge
only to have that quickly stayed, leading to lengthy and costly litigation whose resolution would come
long after it would have any meaningful effect.
In addition, I suspect the City would ultimately lose, because (even if the City has standing to sue,
which at least one of our County Supervisors doubts) it seems unlikely to me the Governor and his
subordinates have done anything illegal. While we may feel they have acted "unconstitutionally," our
legislature, over many years, has given California governors broad emergency powers which have
likely survived challenge before. I share the concern about possible overreach, but the solution
would seem to be legislative not judicial. If the laws are not working as the people intended, the
solution should be to correct the laws, not to ask to have them modified by unelected judges.
Third, I am perplexed by the recommendation that the discussion of this matter take place behind
closed doors, out of public view.

Under Gov. Code Sec. 54956.9(a), the code being used to justify that choice, closed session
discussion is appropriate only "when discussion in open session concerning those matters would
prejudice the position of the local agency in the litigation." In potential litigation between public
agencies it is particularly difficult to understand the public interest in not knowing what public officials
are thinking. The only ones left in the dark are the public, who are paying the bills for both sides.
In my view, it is much better to know what our officials are thinking and why, so we can seek to
correct them as needed.
Additional Comments Regarding the April 30 Emergency Meeting
On April 30 at 5:15 p.m., the City Council held an emergency meeting by regarding an anticipated
state emergency order' closing Orange County beaches. The present meeting is a follow-on to that,
seeking to initiate litigation regarding that same order.
Given the roughly two-hour notice with which the April 30 meeting was held, I, and much of the
public, was completely unaware it happened.
I think that's a problem.
Starting at 41 minutes into the recording of the April 30 meeting, the City Attorney and then the
Mayor misinformed the Council about the requirements for holding an emergency meeting. In that
dialog, Council member Brenner asked if to hold a meeting on such short notice the Council had to
make a determination that the Governor's order had created an emergency threatening public health
and safety. The City Attorney had said emergency meetings are possible when the Council saw "a
threat to public access," and the Mayor assured Ms. Brenner that this was "not a very complicated
hurdle" to cross and there was "a remarkably low bar" for holding an emergency meeting. You didn't
have to express an opinion as to whether the Governor's order was right or wrong, but simply that it
threatened access to a public facility (beaches) and that the immediacy of the loss of access made it
an emergency.
This is a misreading of the Brown Act.
Emergency meetings are most definitely not supposed to be easy to call. The bar is not supposed to
be "remarkably low." And nothing in the section allowing emergency meetings (Gov. Code Section
54956.5) cites the threatened loss of access to public facilities as an always sufficient justification, or
even mentions it.
To the contrary, Section 54956.5 specifies that an emergency meeting can be held on one-hour
notice only if a majority of the council finds that it needs to respond to an "activity that severely
impairs public health, safety, or both" (or on even shorter notice in the event of "a crippling disaster,
mass destruction, terrorist act, or threatened terrorist activity that poses peril so immediate and
significant that requiring a legislative body to provide one-hour notice before holding an emergency
meeting under this section may endanger the public health, safety, or both").
In other words, under even the first standard, before holding an emergency meeting, the Council had
to find not only that the Governor's order would prevent access to public beaches, but that
preventing access "severely impairs public health, safety, or both."

Contrary to what the Mayor said, that is very much a judgment on the validity of the Governor's
order, and a statement that the Council majority thinks the order was dangerously misguided — that
is, the Council thinks the order impairs the public's safety rather than improving it (as the Governor
evidently thought it would do).
Having incorrectly crossed the "uncomplicated" procedural hurdle of whether it was appropriate to
hold an emergency meeting (which in my view it was not), the next question was whether it was
appropriate to conduct the Council discussions in closed session, out of public view, with an
understanding that closed sessions are appropriate only when the public's interest in the discussions
not being heard outweighs their interest in hearing them.
The Mayor and City Attorney cited Gov. Code Section 54957 which indeed allows (but does not
require) closed session discussion with certain public safety officers (not seeming to include fire
chiefs) "on matters posing a threat to the security of public buildings, a threat to the security of
essential public services, including water, drinking water, wastewater treatment, natural gas service,
and electric service, or a threat to the public's right of access to public services or public
facilities."
The presumed intent of the highlighted words was allow confidential discussion of the city's
response to a terrorist threat to public access, where public knowledge of the discussions would
work to the terrorist's advantage. It is hard to see how that applies here, although based one phoned
in comment, the Mayor and Council member Muldoon suggested closing the beaches would lead to
civil unrest and it would be dangerous to clue the potential insurrectionists into the city's plans.
This is a rather remarkable assertion to make given the Council had met two days before, on April
28, to consider a City staff suggestion to close beaches on weekends, quite similar to what the
Governor ultimately ordered, and accompanied by a resolution setting forth the reasons this was a
wise and proper thing to do. There was no suggestion on April 28 that staff thought beach closures
would be an impossible thing to implement, or that they would give rise to a security threat.
How beach closures became a matter requiring closed session consultation with staff two days later
is a mystery to me.
Finally, I believe the City Attorney misinformed the Council as to the applicability of the state order to
Newport Harbor. The order closes Orange County beaches as well as parking for recreational boats.
The City Attorney, in skimming the notice, told the Council it mentioned "beaches" but not the
"harbor," so it probably didn't apply there. This overlooks the fact it says "beaches" and not "ocean
beaches." Newport Beach has both ocean -facing and harbor -facing beaches and it calls both
"beaches." Since they are both popular and attract crowds, one has to assume the order prohibits
activity (including watersports and recreational boats) on all those beaches, not just the ocean
beaches.

To members of the Newport Beach City Council,
First of all, a big thank you to council members Herdman and Brenner for voting to close the beaches.
They certainly have our best interests in mind.
Now, my comments on the City Council's forthcoming meeting on possibly fighting the Governor's
order to close all state beaches.
For those of you opposed to the mandate to close all the beaches .... who the heck do you think you are?
Why do you think it is ok to ignore an order from our Governor? Do you not read the figures that show
that the number of Covid cases in Orange County is increasing? Why do you think that Newport Beach is
entitled to keep its beaches open when others are closing?
Yesterday I received Mr. Herdman's email about the city budget and the financial reductions that must
be made in all departments. If money is so tight, why are you wasting it fighting the Governor's order?
Our Governor has been praised for his foresight in issuing restrictions on movements.
Why do you five consider yourselves more knowledgeable than our Governor?
Yesterday afternoon I drove by Big Corona Beach. The streets were loaded with cars, people were
crossing Ocean Blvd wherever they pleased, ignoring crosswalks, and certainly not social distancing.
As the vast majority of cities are complying with the order to close beaches, people will naturally go to
those that are open .... thus, our beaches are going to be even more crowded.
It is certainlyprudent to err on the side of caution, not to make a decision to get into a legal battle over
the edict to close all the beaches. Please rethink your decision on keeping the beaches open.

As a resident of Newport Beach Peninsula, a healthcare worker at Hoag and a recovering Covid Patient.
I can't hold my tongue any longer.
I am begging you to keep the beach closed until all beaches are allowed to open. I also feel like this
wasn't an attack on Orange County, that's a ridiculous assumption and the protesters and not making us
look any smarter.
San Diego and Los Angeles beaches are already closed. So it really makes sense that everyone from
everywhere will come here. So we must close or limit access. Since we can't find a way to limit access
in a way everyone can agree on, then we must close.
Please understand, when people come here they don't respect the neighborhood or the residents.
With no parking and no bathrooms and no boardwalk access the streets and alleys are inundated with
people, cars and bicycles. We also have a lot of people using yards, alleys and the beach as a restroom.
Which not only spreads Covid 19 but other diseases.
I would love nothing more to be able to use and share the beach I live at. We live in a tourist area and
we love it, but this is an emergency situation. How do you all not see that?
I wish the city would have blocked the peninsula to traffic on the weekends, then maybe we could still
be enjoying the beaches, but being one of only a few beaches open doesn't work safely.
My Husband and I have been isolated and actively sick with Covid 19 for 8 weeks and have finally tested
negative, but a few more weeks isn't the end of the world. I don't wish this disease on anyone, my
husband and I are both healthy active people with no health issues and both middle aged. I was
hospitalized from this which was completely unexpected and my husband wasn't hit as hard.
I don't know how many people you know with COVID-19, but it's no joke. We have friends in NYC,
Texas, Ohio, Florida, China, South Korea, France, Italy, Singapore and several here in Ca who have all
contracted this awful disease all in different ways. I have also lost my 84 yr old Mother to Covid-19, she
was in assisted living, here in Orange County!!! Do you know you die alone and cannot have a proper
burial at this time?
There are so many reasons to stay home right now. I'm seeing numbers on the rise and I know for a fact
testing in Orange County is not easily available, and a large majority of the tests available are not
reliable. If we keep pushing back and deciding we know better then the virus we will loose. The only
reason the numbers are so low is because we have all been staying home.
The restraining order has been rejected. It's time to call it!!! Just let it go and let's all work on finding
ways to move forward slow but steady in anew way. So everything can reopen.
I also feel a lawsuit against the Governor is a waste of city resources that could be better allocated to
help struggling businesses and residents.

To whom is may concern,
Where do I begin... first off I'd like to thank those who voted to keep the beach open. During this
devastating time, the beach has been a sweet escape from everyday struggles. The moment I step onto
the sand for my daily walk, I am instantly at peace.
I've gone on a beach walk almost every day of quarantine. I can testify that mostly everyone (with the
exception of a small group of people) have been extremely careful about social distancing and spacing
out nicely on the beach. It is so sweet to see young families playing together and couples enjoying some
sunshine and fresh air. I was very disappointed to see the photo that went viral of Newport Beach. You
could tell the way the river jetties lined up so closely together that the photo was manipulated - possibly
a certain lens was used on the camera?
With that said, please do what you can to open the beaches.
I would also like to ask that you please open back up weekly vacation rentals. My parents own a beach
house that has been in the family for generations. The only way we could keep it in the family was to
open it up to others and rent it. Keeping the VRBO and Airbnb's closed for daily/weekly use has been a
financial burden on my family.
Thank you for listening. I am a proud Newport Beach resident and I have so much love for my
community.
