TITLE: Newport Island Park Enhancements — Notice of Completion for
Contract No. 7500-1 (191-01)
ABSTRACT:
On November 19, 2019, City Council awarded Contract No. 7500-1 for the Newport Island
Park Enhancements to Green Giant Landscape, Inc. The work is now complete and staff
requests City Council acceptance and close out of the contract.
RECOMMENDATION:
a) On November 19, 2019, the City Council found this project exempt from the California
Environmental Quality Act (CEQA) pursuant to Section 15302(c);
b) Accept the completed work and authorize the City Clerk to file a Notice of Completion
for the project; and
c) Authorize the City Clerk to release the Labor and Materials Bond 65 days after the
Notice of Completion has been recorded in accordance with applicable portions of
Civil Code, and release Faithful Performance Bond one year after acceptance by the
City Council.

This project originated from a Newport Island Homeowner Association (HOA) request to
rehabilitate landscape planters, repair and reconstruct a seat wall, replacement of sand
with rubberized surfacing and replacement/relocation of the HOA storage shed. The final
plans and specifications included the sand and rubberized surfacing option, along with some
hardscape, landscape, and railing, and bulkhead repair. In addition, the HOA requested to
install a small woodshed (approximately 4' deep x 10' wide x 6' tall) along the southerly
property line of the park adjacent to the wall at 3803 Marcus Avenue. The HOA plans to
install a shed in the near future upon approval of a Revocable License Agreement between
the HOA and City.
The work necessary to complete this contract consisted of removing and disposing of
existing concrete sidewalk, stone wall, resilient surfacing, drinking fountain, electrical
cabinet, guardrail and shed; relocating irrigation controller; replacing trash receptacles,
benches, picnic tables and BBQ grills; furnishing and installing resilient surfacing, drinking
fountain, steel railing and doggie waste dispenser; renovating existing walls; constructing
hardscape; installing landscape and other incidental items to complete the work in place
required by the Contract Documents.
The contracted work has been completed to the satisfaction of the Public Works
Department. A summary of the construction cost is as follows:

$316,594.63
During construction it was determined that there was no drainage system underneath the
existing resilient surfacing, which lowered the cost of the bid items constructed. Five
change orders totaling $28,844.63 were approved mostly due to unforeseen changes. It
was also discovered that there was no concrete sub -base underneath the existing
resilient surfacing which needed to be added, and some additional work was required for
proper installation of the drinking fountain. With the completion of the project, the final
contract cost is approximately 3.8 percent above the original bid amount.

The project was substantially complete on February 25, 2020 with all landscaping
improvements completed to the satisfaction of the Public Works Department. Due to the
added installation of the concrete sub -base under the resilient surfacing during the project
construction, the original contract completion date was extended to April 6, 2020.
ENVIRONMENTAL REVIEW:
On November 19, 2019, City Council found this project exempt from the California
Environmental Quality Act (CEQA) pursuant to Section 15302(c) Class 2 (reconstruction
of existing public facilities involving negligible or no expansion of capacity) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no
potential to have a significant effect on the environment.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).
