I support outdoor dining. It brings life to streets, contributes to walkability of the city, better health and cleaner air.
But I'm concerned about the trash, from local and upstream outdoor dining spaces. I have a quick suggestion that would bring
some relief to various stakeholders.
Add this section in NBMC chapter 6.05:
6.05.022 - Single Use Reduction
I. Food vendors shall only provide straws, stirrers, lids, lid plugs and cup sleeves to customers upon request.
2. For takeout orders, food vendors shall charge 25 cents for every utensils packet. In addition to section
6.o5.022.1, unpackaged utensils, chopsticks, condiment packets and napkins shall only be provided upon request.
This covers the new normal: more takeout orders and outdoor dining, and the elimination of self-service stations for fewer
touch points.
The water quality committee had looked into the trend of 25 cents fee for to -go ware, recommended it as one of the trash
reduction actions. Utensils package is unique in the group as it has several items. It's fair for those who can afford a restaurant
meal to pay 25 cents. Like the bag fee, the businesses shall keep it.
The pandemic has shown us other urgent needs of trash reduction at the source:
• The City has encountered increasing trash costs, even before the pandemic. On Mar. 24, the City added $224,925 to the
trash wheel's design cost. Coincidentally, the virus has created more trash as some believe single -use is safer, though
the theory isn't supported by scientists/health experts. Looking ahead, what would be the likely solution for upstream
agencies to share the costs of operation and maintenance of the trash wheel during the recession?
• Many trash workers got sick, as it's the 5th most dangerous job in the US.
I hope City Council sees my simple suggestion as a win-win, take a quick action before outdoor dining starts.

My name is George Leeper. I litre next door to the ARC restaurant.
I have been told by a neighbor the the City council will meet on Tuesday to vote on allowing The ARC to continue
operating in their parking spaces. Please confirm, I have not seen any notice of this from City Council.
The ARC parking has been open, no distancing, serving drinks in the parking lot. The ARC has been a poor neighbor for
the past four years.
As you know there are more than 25 restaurants within 500 yards of my home. The ARC is the only one that has
operated illegally.
This week, A policemen told my wife that "Newport Beach is open". An OC Sheriff told me this week that "nothing is
being enforced"
I have been waiting until the City does open to take any action.
I plan on insisting the city enforce it Business codes, Conditional use permits and that police enforce any parking or
alcohol infrations
I plan on contacting the Orange County Health Department, The Alcohol Beverage Control and the Federal Air Quality
management.
My Attorney is Jim Caviola and he will be seeking a meeting with CNB City Attorney

Why is the City council considering expanded restaurant use while everyone else must bear the Covid Burden.
I live in Cannery Village and the City has allowed More than 25 restaurants to operate within 500 yards of my
home.
Almost all have played by the Covid rules.
The ARC restaurant has been open for three weeks, serving alcohol, no distancing, eat in the parking lot. They
have no parking and the traffic
on 30th St is congested due to on street "city parking" and no off street parking for the ARC. The employee
parking in the rear of the area is designed for
four cars and as many as six are parked there during operating hours. Access to the trash receptacle is blocked
and garbage is left on the alley.

Committee on Local Business Advancement Recommendations
Dear Mayor O'Neill and City Council Members:
At a meeting of the Newport Beach Chamber of Commerce Board of Directors this morning, the
Board voted unanimously to urge the City Council to approve the proposed Emergency
Ordinance in Agenda Item No. 11 and the recommendations of the Ad Hoc Committee on Local
Business Advancement in Agenda Item No. 12.
It is the hope of the Board that the once approved, City Planning Staff will quickly implement
the approval of Temporary Use Permits that will allow local businesses to successfully reopen
without any major red tape or burdensome requirements on businesses that have been struggling
to survive. Being able to expand their footprint onto adjoining sidewalks, patios and parking lots
will help to offset some of the reduction in occupancy and the spacing requirements that come
with the need to maintain social distancing in workplaces and places of worship.
The Board is also encouraged to see the support of the local business community through the
provision of marketing and other funds to the Balboa Village Merchants Association (BVMA),
the Balboa Island Merchants Association (BIMA), the Corona del Mar BID and the Restaurant
Association BID (DineNB). Local business has been hard hit and we are already seeing some
merchants announce that they have closed their doors permanently. We expect that others will
follow. Anything that can be done to aid our restaurants and shopkeepers will go a long way
towards keeping our economy vibrant, our tax base solid and the fabric of our community strong.

Dear Mayor O'Neill and City Council Members:
As a group of former Newport Beach Mayors and Mayors Pro Tem concerned with the safe
recovery of Newport Beach, we have reviewed the proposed Emergency Ordinance in Agenda
Item No. 11 and the recommendations of the Ad Hoc Committee on Local Business
Advancement in Agenda Item No. 12 and urge the City Council to approve these two items.
We feel that a quick implementation of the ordinance for Temporary Use Permits will be most
beneficial for our local businesses. Allowing businesses to expand their operations onto
adjoining parking lots, patios, and public spaces such as sidewalks will be most beneficial to
these struggling businesses and religious entities. Being able to help offset some of the reduction
in occupancy and the spacing requirements that come with the need to maintain social distancing
in workplaces and places of worship will be most helpful. It is our hope that the once approved,
the approval of Temporary Use Permits will be quickly implemented by staff so that local
businesses can successfully reopen without any major obstacles or complicated requirements.
Supporting the local business community through the provision of marketing and other funds to
the Balboa Village Merchants Association (BVMA), the Balboa Island Merchants Association
Inc, Balboa Island Merchants Association, the Corona del Mar BID and the Restaurant
Association BID (DineNB) is also a positive step. Some merchants have announced that they are
closing their doors permanently while other have been hit hard and are close to closing.
Anything the city can do to support these very important business segments will only help assure
we continue to have a vibrant business community in Newport Beach.
