ACTION: If desired, approve attached Memorandum
of Agreement, authorize Mayor and City
Clerk to execute the Agreement, and appoint
Council Member to represent
the City on the Committee.
BACKGROUND: By action of July 8, 1985, the City Council
agreed in concept to joining other cities in the county
in selecting and funding a representative to the Board
of the Hazardous Materials Joint Power Authority. This
Board consists of representatives from eight counties,
the League of Cities in each of the eight counties, a
representative from the City of Los Angeles and the City
of San Diego, and a representative from Orange County
cities;. Eleven Orange County cities have tentatively
agreed to support an additional representative on the
Board. These cities are: Brea, Garden Grove, San Juan
Capistrano, Orange, Anaheim, Huntington Beach, Santa Ana,
Fountain Valley, Irvine, Fullerton and Newport Beach.
In effect, by participating in this Committee, the
City of Newport Beach will have one -eleventh of one
nineteenth of a vote on the regional authority. The
eleven cities would share the $10,000 annual cost which
computes to $909.10 for the City of Newport Beach. This
amount is included as a budget amendment in another
portion of this agenda.

The primary purpose of the regional board is to
support the establishment of hazardous waste treat-
ment facilities.

This is to inform you of the results of the meeting on August 8,
1985 concerning the Hazardous Waste Management JPA. Councilwoman
Ruth Finley distributed the enclosed memo concerning the results of
attending the Southern California Hazardous Waste Management
Authority meeting on July 25, 1985. The city representatives
attending decided to continue the effort of being recognized by the
Hazardous Waste Management Authority. The representatives elected
me as the chairman for 1985 and decided to establish a committee
which consists of Brea Councilwoman Norma Hicks, San Juan Capistrano
Councilman Phil Schwartze, Huntington Beach City Manager Charles
Thompson, Orange City Manager Bill Little and myself. This
committee will discuss the alternatives available to us in receiving
recognition from the Hazardous Waste Management Authority. We also
intend to prepare the rationale and reasons for allowing our
consortium to be a part of the Hazardous Waste Management Authority.
Once we have developed our strategy, we will report back to the city
representatives and receive the approval of that body before
requesting Supervisor Wieder to add our request to the agenda of the
Hazardous Waste Management Authority.

MEETING
Ruth Finley and I attended the Southern California Hazardous Waste Management Authority
meeting that was held on July 25, 1985, at the Southern California Association of Government's
office in Los Angeles.
At the meeting, Orange County Supervisor, Harriett Wieder, brought up the topic of expanding the
Southern California Hazardous Waste Joint Powers Authority (JPA) to include one additional
representative from Orange County. She indicated that eleven Orange County cities had expressed
an interest in coming together to select a representative to the Southern California Hazardous
Waste JPA because of the importance of the hazardous waste issue. Supervisor Wieder introduced
Huntington Beach Councilwoman, Ruth Finley, who was presented as the interim representative for
the eleven Orange County cities.
The points made by Supervisor Wieder, were first Orange County has the second largest population
base of the member JPA, with Los Angeles County having the largest, second that a substantial
amount of hazardous waste is generated by Orange County, and third the issue of Hazardous Waste
is very important to officials at the local level and the constituency they represent. For these
reasons, Supervisor Wieder requests that other members of the JPA put aside their regional and
parochial differences and allow the Orange County representative to be seated.
Discussion was held between the members of the JPA and some concern was expressed by JPA
members that the issue was coming to them as an off agenda item, and that sufficient time was not
given for them to study and consider this request. For this reason a motion was made and passed to
take Supervisor Wieder's request under submission and to agendize this item at the next JPA
meeting scheduled for August 29, 1985. The JPA requested that a report be prepared that
identifies the rationale and reasons pros -and -cons, for including one additional Orar1ge County
representative. It is important to keep in mind that a unanimous vote is required by JPA members

Later in the meeting, Dave Morrell, representing the Environmental Protection Agency spoke, and
while not directly referring to Supervisor Wieder's request, did state that the EPA believes that the
process should be open to all those who have an interest and desire to get involved in the issue of
hazardous waste. Mr. Morrell's comments were frank and to the point, which seemed to upset
some of the newer members of the JPA (particular representatives of San Diego County) who were
not familiar with Mr. Morrell. Mr. Morrell was mildly optimistic about the effectiveness of the
JPA and stressed the importance of identification of actual site locations for the disposal of
hazardous waste. I got the clear distinction that site location is of primary condern to the EPA.

This is to inform you of the results of the meeting of the
representatives for the cities interested in forming a consortium
and having their representative recognized by the Hazardous Waste
Management Authority. Councilwoman Ruth Finley informed us of the
results of attending the first JPA meeting of July 25, 1985. The
representatives selected me as their chairman for 1985 to represent
the consortium at the JPA. A committee was formed to determine the
approach that should be taken to have the Hazardous Waste Management
Authority recognize our consortium. The committee consists of Brea
Councilwoman Norma Hicks, San Juan Capistrano Councilman Phil
Schwartze, Huntington Beach City Manager Charles Thompson, Orange
City Manager Bill Little and myself.
Please do not include the issue of allowing the consortium to be
part of the JPA on the agenda for the meeting of August 29, 1985.
We appreciate your efforts and look forward to working with you to
resolve this matter.

The minutes of our committee meeting of the consortium cities on hazardous waste
management, held on July 18th in Santa Ana, are attached. We have also redrafted
an agreement form to formally establish the arrangements by which we can name our
representative to the J.P.A. and function as an active member of that authority. This
assumes, of course, that the signatories to the J.P.A. will agree to seat a city repre-
sentative from Orange County.
As you will recall, one of the decisions at the July 18th meeting was to have city coun-
cil designated representatives attend the Orange County League meeting prior to its
regular meeting time on August 8th. At that time (5:30 PM), a permanent representative
will be selected and such other business conducted to get the committee operating on
some standard basis. As your interim chairman, I would like to suggest that each city
be prepared to vote at such meeting for a permanent chairman, as well as a represent-
ative to the J.P.A. and, if possible, to have obtained their city council's authority to
sign the joint agreement. If there are modifications to make in the redraft agreement,
such changes can be discussed at the August 8th meeting.
If you have any questions, please call me or Charles Thompson, our City Administrator,
and we will be happy to help in any way possible.

HAZARDOUS WASTE COMMITTEE
JULY 18, 1985
On July 18th at 11:45 ASM at the Saddleback Inn in Santa Ana, a general meeting was held
of the interested cities who had responded to a letter inviting all cities to attend such
meeting. Cities in attendance were: Fullerton, Orange, Fountain Valley, Irvine, Santa Ana,
Garden Grove, San Juan Capistrano, Brea, Anaheim, Newport Beach, and Huntington Beach.
Charles Thompson, City Administrator 'of Huntington Beach, gave an explanation of the
background of the proposed joint powers agreement for hazardous waste management as
developed by the Southern California Hazardous Waste Management Project covering the
SCAG region. It was indicated that three major areas of consideration were before the
general committee for decision. First, a preliminary organization should be developed
to bring the committee together in order to conduct its business, and it was proposed that
a temporary chairman could be named for the committee for this purpose. Secondly, it was
necessary for the committee to develop a permanent organization with a permanent chair-
man and to select a representative of the group to act as their representative on the JPA.
Thirdly, the committee should decide the general parameters of their bylaws indicating the
voting strength of each city and the arrangement for payment of the $10,000 required for
initial membership.
It was decided that Ruth Finley, Councilwoman from Huntington Beach, would be named
the temporary chair and would also act as the interim representative to JPA to attend the
initial meeting at the SCAG offices on Commonwealth Avenue in Los Angeles on July 25th.
The next decision was that at the August League meeting, scheduled for August 8th, that
each of the member cities should send their representatives prepared to select a permanent
representative to the JPA.
It was also decided that the committee would need staff support, and that this staff support
would come from the city from which the representative to the JPA was named.
It was also requested that additional information be provided as to' on-going funding and how
each member should make its proportionate payments, as well as to whom such .payments should.
be paid. The general mechanics for handling these administrative items could be covered in
the bylaws.
It was also requested that a checklist of information required for the July 25th meeting be
prepared and forwarded to representative Ruth Finley.
In a general discussion relative to the format for the organization of the committee, it was
decided that the simplest form of organization required would be the best, and that a joint
powers agreement for such purpose did not appear necessary. There was a general decision
that each city on the committee would have one vote, and that the costs would be equally
shared among the member cities.
Another decision was made that new cities or additional cities would be allowed to join the
committee by a majority vote of the existing cities. A draft agreement accomplishing the
above decisions was requested to be prepared by Charles Thompson and submitted to the
member cities prior to the August 8th meeting.
