SUBJECT: Amendment to the Lincoln School Lease Agreement
Recommendation:
Authorize the Mayor and City Clerk to execute an Amendment to the Lease Agreement
with the Newport -Mesa Unified School District for the City's use of the athletic
facilities at Lincoln Intermediate School.
Background:
On September 22, 1986, the City Council adopted Resolution 86-86 approving the
City's application for grant funding for improvements to Lincoln School under the
1984 California Park and Recreation Facilities Act. The application materials
were forwarded to the State Department of Parks and Recreation on September 30, 1986
and have received favorable review from the Office of Grants Administration.
However, the State notified the City on October 8, 1986 that continued consideration
depended upon assurances from the District that the Lincoln facility would continue
to be available for community recreation purposes should the existing Lease be
terminated. Despite the existence of the Joint Powers Agreement, the State desired
an "ironclad" extension specific to the Lincoln facility as a means of justifying
the potential investment of grant funds.
On October 14, the City requested than an Amendment be drafted to address long term
community recreation use for a period of twenty (20) years. After careful con-
sideration of our request, the School Board approved Amendment No. 1 with the
desired language for a period of ten (10) years. The Amendment references the
appropriate Section of the Lease and has already been executed by the District.
