The process to fill the vacancies is provided in City Council Policy A-2 (Board, Commission, and Committee Appointments), City Charter Section 702, and the Maddy Act. RECOMMENDATION: a) Determine this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because this action will not result in a physical change to the environment, directly or indirectly; and b) Make appointments to the Boards and Commissions from the nominees listed below. All new terms will be effective on July 1, 2020, with an expiration date of June 30, 2024. Board of Library Trustees [1 vacancy] 1. Ash Kumra 2. DISCUSSION: The above nominees were confirmed by the City Council at the May 26, 2020 City Council meeting and were selected from applications received and on file in the City Clerk's Office. Copies of all the nominees' applications were included with the May 26, 2020 staff report and are also attached. All new terms will be effective on July 1, 2020, with an expiration date of June 30, 2024. Appointment Process Pursuant to City Council Policy A-2 (Boards, Commissions and Committees), appointments to the Boards and Commission will take place in the following manner: 16-2 Annual Appointments to Boards and Commissions June 9, 2020 Page 3 A. The City Council will vote on all appointments simultaneously via paper ballot. The City Clerk will tabulate and announce the results, including the vote tally. B. Each member of the City Council will cast the appropriate number of votes for Boards and Commissions on the paper ballot. To be appointed, an applicant must receive at least four votes. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. We lived in Long Beach for 35 years. During our time in Long Beach I was very Involved with three Arts organizations. I was a member of the Board of Directors and also served as President of International City Theatre (ICT), now in its 35`h year, a regional theatre offering productions similar to South Coast Rep. ICT is officially designated the resident professional theatre company of the City of Long Beach. During my service on this Board I was able to assist the organization in creating a more stable financial position as well as enhancing the organization's marketing strategy. I was a member of the Board and also served as President of the Public Corporation for the Arts (PCA) - now called Arts Council for Long Beach, (a private/public partnership with the City of Long Beach). This is Long Beach's version of an Arts Commission. The PCA was used to analyze and distribute the grants of the City's funding for the Arts to the five major and several other Arts organizations in the City as well as oversee and fund the City's Public Art projects. While serving on this Board I was able to enhance the City's understanding of the benefit and understanding of need for Public Art installations as well as secure more funding for Public Art. The third arts organization with which I am still involved is Musical Theater West (MTW), a 67 year old regional musical theater group that moved to Long Beach in the 90's. MTW produces 4-5 musicals each year which are staged at the Carpenter Center Theatre on the California State University Long Beach campus. I have been on an Advisory Committee and currently I am a member of the Audit Committee. Additionally, I was an appointed member of the City of Long Beach's Citizen Technology Advisory Committee (CTAC). This committee established by the City Council was formed to discuss and advise the City's Information Technology department on technology issues within the City of Long Beach. The committee consisted of eight members each with expansive experience in the Information Technology field. I believe that my experience on these boards and committees in non-profit and city government including my executive positions will be an asset to the City Arts Commission where I will be able to draw on those experiences to greatly contribute to the City Arts Commission. This invaluable experience has given me a sense of gratitude and pride. It has been a great pleasure working with various city council (CC) members, fellow city arts commissioners (CAC), Director Hetherton and his extremely helpful staff, other city staff, as well as the Newport Beach Arts Foundation (NBAF), while serving the Council in this capacity to help support the arts within our community. During this period, I've attended nearly every CAC meeting and fully engaged myself with familiarization of CAC issues, programs, policies and its challenges. These past two years, I have been assigned to numerous CAC Ad Hoc Subcommittees that have allowed me to express my creative and innovative thinking, as well as my insight to the needs and desires of our local citizens. I've proven that I am able to work alongside fellow commissioners and get the job done with notable success. As Vice Chair for 2019-20, 1 have demonstrated the ability to learn from and support Chair Greer in whatever capacity necessary. Whether it's simply my presence for her during a city council meeting, assisting with a particular matter, helping plan the details of programming or events as well as appearances for participation in the occasions; I've been available with full immersion. My contributions as a city arts commissioner have been abundant and productive; something I've done passionately with a great sense of purpose. Since 2018, 1 have taken a special interest in the NBAF by attending most of their monthly meetings, offering support and suggestions as they have recently moved forward with implementing reorganization efforts to increase their means of funding the CAC's various programs and events. I have fully engaged myself in several CAC Ad Hoc Subcommittees (acting as Chair and Co -Chair) to improve our existing programs and encourage greater community participation. I shared a strong role in the opening ceremony and festivities of 2019's Civic Center Sculpture Garden Phase IV, and am presently doing so for our upcoming Phase V. I also share in success credits for the 2019 Newport Beach Art Exhibition as well as the CAC's first ever Fall Concert at Marina Park funded through the Balboa Theater Performing Arts. I am again assigned to these two ad hoc subcommittees that we have been diligently planning. Though they and other events have been placed on pause due to the current COVID- 19 crisis, we hope to follow through with these two wonderful public events sometime this fall. While I remain interested in serving as an Arts Commissioner, I could not help but feel it necessary to share some of my thoughts and ideas through an Addendum to the Arts Commissioner Application I submitted last year. Over this past year, the biggest reason for my continued interest in becoming an Arts Commissioner has become my awareness that our Arts Foundation is under supported by the citizens of Newport Beach, to the point that it is largely reliant on funds from the City's budget. Deeply troubling to me, having lived and worked in Newport Beach for well over half my life, I don't recall ever hearing this. We have countless dedicated members of City leadership, past and present, responsible for the planning and development of excellence throughout our City, which we all greatly benefit from. When I first moved here from Anaheim in the mid -seventy's, I remember thinking, "this is where I want to live forever"...that thought has never changed. However, I believe we can make this an even more special community for residents and visitors alike, if we enhance our public funding for the arts. This is attainable through successfully tapping into our valuable volunteer as well as donor resources we have at our fingertips. This will assure the ability to continuously weave a methodical balance of the arts into future structural and cultural development of our city without overburdening the City's budget. It will also spark added township pride and sense of team impact. The Foundation Consultant would assist in laying out a "Revised Master Plan" with attainable short and long-term milestones for harvesting a robust and ongoing flow of funds for the Arts Foundation well into the future. Perhaps through corporate or individual philanthropy, we could eventually have a "Center for the Arts" building. Pick up any local magazine or newspaper to see ways in which the vast existence of wealth among Newport Beach residents and businesses alike here in Newport Beach are making a difference with their volunteer donations and endowments to certain charitable organizations. Chances are the Arts Foundation can more fully tap into this pool of citizen resources within the community, asking them to participate in the support of their own City's Arts Foundation. We all know the saying "ask and you shall receive". Include a brief survey and opportunity for specific comments/suggestions. • Hire a PR firm to put together a short film that talks about the Arks Commission and Arts Foundation, explaining how the growth and success of our Arts Programs are reliant on individual donations from our community members. This film would be presented just before the Concert on the Green performances and special guest speaker events. • Launch a useful Arts Commission 1 Arts Foundation website and include a page that allows on-line donations. • Become active with Social Media. • Ask local Prominent Businesses for endowment participation ... they expect this. • Ask residents to donate. Layout simple and convenient options for citizens to donate any amount, any time. Options could be to make Annual, Quarterly or Monthly Pledges; even simply donate on an unscheduled basis as they wish. • When was the last time the City of Newport Beach sent a mass mailer to all its residents, explaining how the many "free" arts events provided throughout the year is costly and cannot be solely supported through City funds, but rather must rely upon private donations? • The best time to ask anyone for a donation is when he or she is enjoying direct benefits of doing so. Junior and High School as well as College students would be eligible for membership, as long as they fulfilled a certain amount of volunteer work at arts events as well as direct participation with fund raising. • The focus of student participation would be those active or interested in the arts - music, dance, and all other forms of fine arts. • Engage leaders from The Newport Mesa Unified School District (NMUSD), to help develop a Program that would specifically put together fund raising performances and art fairs for community attendance. I believe I could actively enlist her to offer guidance as to the best means of presenting the Student Membership concept to Schools' faculty and students, in order to maximize interest and participation. • Student participation will instill in them, the importance and value of supporting the Arts Foundation of our city, and likely inspire parents to be volunteers and donors. The proceeds would go to the Arts Foundation. • Rather than pay for artists to lend their works of art to the City, allow artists to rent space from the City. After all, when an artist's work is displayed in a City Park or a wall within the Library or City Hall, it is no different than a Billboard Advertisement for the Artist to attract business. The proceeds of this would be turned over to the Arts Foundation. • Ask local Artists to hold fund raising events at their Galleries to benefit the Arts Foundation. It would focus on corporate, private wealth endowments, and any other outstanding donors. A Dinner and Dance event, with donated Silent and Live Auction items that are created by local artisans only and open for all citizens to attend. • Give Annual Awards recognizing outstanding local artists, students, volunteers and donors. • Send a letter of thanks for every donation made ... let them know how much it means. I am just completing my first four-year term and would like to continue for a second term on the Civil Service Board. During my tenure I have forged important relationships with City staff including fire and police personnel at every level. Especially relevant is representing the City at the many promotion and recognition events to honor our first responders and City employees. I served on the Board of Library Trustees including acting as Chair and Vice Chair from 2012 to 2016. 1 appreciated the opportunity to work closely with City officials, citizens and other community volunteers to assist in the administration of the library system in Newport Beach. While on the Board, we dealt efficiently with all matters of library operation, including policy, budget, programming and construction. We are fortunate to have an incredible library staff and director - resulting in one of the finest library systems in the country. I also served the City Arts Commission from 2005 to 2012, as Chair for four years, Vice Chair for two years, and Secretary for one year. During my term, the Commission achieved a number of accomplishments. We regularly experienced record program attendance at the Annual Juried Art Show, Concerts in the Park, Shakespeare by the Sea, and lectures, and launched a thriving museum tour series. I also took a lead role in the development of "McFadden Centennial Legacy Square," the City's largest community -funded public art project (650+ donors,) to commemorate the 100 -year anniversary of the City of Newport Beach, coordinated a collaboration with Orange County Museum of Art to curate an outdoor sculpture collection for the Civic Center, and secured for the City a collection of watercolors by a longtime Newport Beach resident along with a cash bequest of $50,000. For many years I have also been fortunate to volunteer for a number of civic, philanthropic, and charitable organizations - developing business strategies assisting communities in need. The projects have been varied, including spearheading capital campaigns to fund the arts, providing pro bono legal services to non -profits, and hands on volunteer activities with local organizations. I am on the Board of Directors for Friends of Newport Beach Animal Shelter (FONBAS,) assisting with a capital campaign dedicated to purchase real property for a permanent animal shelter in the City. In 2015, 1 worked closely with the Newport Harbor Elks Lodge to raise over $40,000 for the City to replace Elko and Jardo, two Newport Beach Police dogs. I also worked closely with Council Member Diane Dixon and others to create WiNN - an organization dedicated to facilitating residents in applying for civic and charitable positions in the City. The proposed project included refinery modifications to optimize operations, comply with regulations, and improve operating efficiency. Major issues included air quality, greenhouse gas emissions, hazards, hydrology/water quality, noise, solid/hazardous waste, and transportation/traffic. Also completed an HRA under the SCAQMD Rule 1401 requirements for the modifications to stationary sources at the Chevron Refinery. Prepared an EIR for the Chevron El Segundo Refinery Coke Drum Replacement Project. The proposed project included replacement of the existing coke drums with new coke drums. Major issues include construction (including LST analysis) and operational air quality impacts, GHG emissions impacts and mitigation measures, construction noise, and construction traffic impacts. Prepared the EIR for the BP Safety, Compliance and Optimization Project at the BP Carson Refinery. The proposed project included modifications to a number of refinery units, including calculation of emissions from mobile sources. Also prepared a health risk assessment to address the health impacts of toxic air contaminants. Prepared an EIR for the ConocoPhillips PM10 and NOx Reduction Project. The proposed project included modifications to comply with SCAQMD Rule 1105.1 - PM10 and Ammonia Emissions from Fluid Catalytic Cracking, SCAQMD Regulation XX — RECLAIM, and further reduce emissions of ammonia and sulfur oxides at the ConocoPhillips Los Angeles Refinery. Provided consulting services to Alt Air for the preparation of a Negative Declaration and air quality permitting for modifications to existing refinery structures to produce renewable jet fuel and renewable diesel fuel from non -edible vegetable oil and high- quality technical beef tallow. Prepared a Negative Declaration, addendum, and Subsequent Negative Declaration, for the ConocoPhillips Ultra Low Sulfur Diesel Project at its Wilmington Plant, in Los Angeles, California. The proposed project included modifications to several refinery units. An HRA under the SCAQMD Rule 1401 requirements for the modifications to stationary sources at the ConocoPhillips Refinery. Prepared an EIR for the Paramount Clean Fuels Project which included refinery modifications to produce cleaner -burning gasoline and ultra low sulfur diesel (ULSD) fuels. The proposed project included modifications to a number of refinery units. An HRA was also prepared for the proposed project. Prepared the EIR and Subsequent EIR for the Ultramar Reformulated Fuels Program at the Wilmington Refinery. This project included new units and refinery modifications to produce fuels in compliance with state and federal Clean Air Act requirements. The project included modifications to the Ultramar Refinery, Olympic Tank Farm, and pipelines connecting the two facilities, as well as to the larger California oil and petroleum products distribution system. Prepared an addendum to the Negative Declaration for the Air Liquide Hydrogen Plant at the Chevron Refinery. The project involved the creation of a consolidated oil well and separations facility, which was comprised of up to 202 oil and gas production and injection wells, separation equipment to produce up to 6,000 barrels per day of oil and three million cubic feet of natural gas. Cogeneration Unit at the Wilmington Refinery. The project included the installation of a Cogeneration Unit to minimize the potential for power outages at the Refinery. The environmental resources that required more extensive analysis included air quality, GHG emissions, and health risk assessment. Prepared the EIR for the issuance of a RCRA Part B Hazardous Waste Facility Operation Permit for the Exide Technologies facility, Vernon, California. Exide is a secondary lead smelter where used batteries and other lead products are recycled into lead ingots. The lead agency for this project was the DTSC. Major issues included air quality, earth resources, water quality, risk of upset, noise, traffic/circulation, and human health. Also prepared a health risk assessment to address the health impacts of toxic air contaminants. Assisted the SCAQMD and the Joint Powers Authority in the preparation of an EIR for the Intermodal Container Terminal Facility (ICTF) EIR. The project would expand and modernize the existing ICTF facility to allow the increased handling of container traffic from the Ports of Los Angeles and Long Beach onto rail for transport out of the Los Angeles region. Responsibilities include: preparing the Initial Study; preparing a construction emission inventory and analyzing construction air quality impacts; preparing environmental setting, project impacts, and mitigation measures for aesthetics, hazards, hydrology/water quality, land use, noise, and utilities and service system impacts. Prepared a Mitigated Negative Declaration for the Hixson Metal Finishing Risk Reduction Project, in Newport Beach, California. The proposed project consisted of on- site tank, spray booth, and oven relocation; installation of additional air pollution control systems; construction of permanent total enclosures; installation of covers on wastewater treatment tanks, preparation and implementation of an improved housekeeping and dust minimization plan, and improvements to the Facility's electrical system.
