City Authority for School Projects

building permit requirements

and building code regulation constitutes a conflict with the general laws

Ensign School Project
The City of Newport Beach
has responsibility for the
Public Right -of -Way. For the
Ensign Project., the Public
Right -of -Way extends to the
School's fence. The fence
and concrete footing are on
School property governed
by the State of California.
City Discussions with School District on
Ensign School Project

Discussions began between District and City staff on the Ensign
School Project. 3 meetings held between Nov 2018 - Sept 2019

District provided preliminary design, requested input. City
provided comments related to removal of median on Cliff Drive

Regular correspondence between District and City staff
regarding proposed improvements to the public right-of-way
design

Encroachment Permit No. N2020-0366
❖ Two curb cuts and installation of two one-way driveways
(CNB Standard Drawing 161-L, and approved as modified);
❖ Installation of a parkway drain (CNB Standard Plan 319-L);
❖ Removal of the existing small median in Cliff Drive, replaced with
asphalt concrete;
❖ Removal of two standard street trees;
❖ Sawcut existing widened sidewalk to match adjacent sidewalk
width;
❖ Installation of street trees to match existing species and spacing;
and
❖ Adjustment of the striping in the middle of the street where the
median is removed.
Encroachment Permit Findings - Municipal Code 13.06
✓ The work conforms to the requirements set forth in the driveway
approach policy adopted by the City Council (L-2), as well as the
Standard Specifications of the City for public work of like
character;
✓ The project as proposed will not unreasonably interfere with
vehicular and pedestrian traffic, the demand and necessity for
parking spaces, and the means of ingress and egress to and from
the property affected and adjacent properties; and
✓ The health, welfare and safety of the public will not be
unreasonably impaired.
