Garcia, 644-3206 Appeal Period: 14 days after decision date Modification Permit No. MD2005-001 (PA2005-002) Architectural Design & Signs 4695 MacArthur Court Parcel 2 PM-196140-43 Request as Modified and Approved: The Zoning Administrator approved the applicant's request to allow the installation of two wall signs that will serve as building identification for a major tenant at the top of a 214- foot-tall, 16-story office building. The signage consist of a text sign of approximately 300 square feet and a logo sign of approximately 90 square feet. The planned community limits the site to one sign per building facade; up to two building facades only; and a maximum area of 200 square feet. Staff determined that the proportion of sign area on the building facade is consistent with the intent of the Code. The property is located in the PC (Koll Center Planned Community) District. On January 18, 2005, the Zoning Administrator approved the application request as modified based on the following findings and subject to the following conditions. FINDINGS: The Zoning Administrator determined in this case that the proposal would not be detrimental to persons, property or improvements in the neighborhood and that the modification as approved would be consistent with the legislative intent of Title 20 of the Newport Beach Municipal Code, and made the following findings: 1. The Land Use Element of the General Plan designates the site for "Administrative, Professional and Financial Commercial" use and the existing January 18, 2005 Page - 2 • • commercial structure is consistent with this designation. The wall signs are accessory to the primary use. 2. This project has been reviewed, and it has been determined that it is categorically exempt from the requirements of the California Environmental Quality Act under Class 11 (Accessory Structures). 3. The modification to the Koll Center Newport Planned Community development standards, as proposed, would be consistent with the legislative intent of Title 20 of the Newport Beach Municipal Code. The proposed signage is a logical use of the property that would be precluded by strict application of the zoning requirements for this District for the following reasons: • The site is comprised of a 214-feet-tall office tower building that is occupied by multiple tenants. The planned community development regulations limit signage to a single entity on two facades. The placement of two signs on a single facade to identify the major building tenant is a logical use the building fascia. • The proposed signage will allow drivers coming from the direction of the primary arterial (405 Freeway) to easily identify and locate the major tenant of the site. • The number of signs is consistent with the regulations but is located on one facade and does not exceed the overall 400-square-foot area allowed for two signs (200 square feet each_) 4. In accordance with the provisions of Chapter 20.93, the granting of this application is necessary due to practical difficulties associated with the property, and the strict application of the Zoning Code results in physical hardships that are inconsistent with the purpose and intent of the Zoning Code for the following reasons: • The building facade on which the signage is proposed to be located is 214 feet tall and consists of 143.33 lineal feet of frontage, or a total of 30,672 square feet in area on the subject facade. The logo sign and letter text sign will consist of approximately 385 square feet in area, which is proportionally small in comparison to the overall building facade (approximately 2.05%) • The practical difficulties of limiting the overall size of the signage to 200 square feet, maximum, in area would prevent adequate identification of the major tenant of the building. It is staffs determination that such limitation on sign area was not intended for buildings of this height and size. • The building facade has defined articulation, resulting in a physical hardship which dictates the spacing of the letter text signage and adds to the overall length of the lettering. 5. In accordance with the provisions of Chapter 20.93, the requested modification will be compatible with existing developments in the neighborhood for the following reasons: January 18, 2005 Page - 3 • • The size of the signage is appropriate to the scale of the subject office tower building and is consistent with other signage in the vicinity. • The granting of the size and number of the signage for the subject property is consistent with modified and conditioned approvals granted by the Modifications Committee and the Planning Commission on appeal for similar signage in this Planned Community District. 6. In accordance with the provisions of Chapter 20.93, the granting of this modification permit will not adversely affect the health or safety of persons residing or working in the neighborhood of the property and shall not be detrimental to the general welfare or injurious to property or improvements in the neighborhood based on the following: • The logo sign is proposed to be 9-feet 3-inches high and the letter text sign is proposed be 5-feet 6-inches high, which is proportionally small when compared to the overall height of the building. In addition, the two signs would be located on the upper 10 percent of the building and would cover approximately 2 percent of the overall building facade. • The size of the signage is appropriate to the scale of the building, and allowing two signs on a single facade will not be detrimental or injurious to property or improvements in the area. • Any proposal for future additional signage for the building shall require the review and approval of a separate Modification Permit. 7. The proposed signage will not affect the flow of air or light to adjoining residential properties because there are no residential properties in the area. 8. The proposed signage will not obstruct public views from adjacent public roadways or parks because there are no public views through or across the subject property that are affected by the proposed project. CONDITIONS: 1. The development shall be in substantial conformance with the approved plot plan and elevations, except as noted in the following conditions. 2. Anything not specifically approved by this Modification Permit is not permitted and must be addressed in a separate and subsequent Modification Permit review. 3. This approval was based on the particulars of the individual case and does not in and of itself or in combination with other approvals in the vicinity or Citywide constitute a precedent for future approvals or decisions. 4. The logo sign shall measure 9-feet 3-inches high by 9-feet 4-inches wide and shall not exceed 87 square feet in area, as depicted on the approved plans. • i January 18, 2005 Page - 4 5. The letter text sign shall measure 5-feet 8-inches high by 50-feet 3-inches wide and shall not exceed 285 square feet in area, as depicted on the approved plans, with the exception that the drop portion of the letter "Y" is not included in this calculation and is permitted as depicted on the approved plan. 6. The placement of the logo sign and letter text sign shall be consistent with that which is depicted on the plans submitted with the application and approved by the Zoning Administrator. 7. The logo sign and letter text sign shall be installed on a single building facade and any future signage on a different facade shall require the submittal and approval of a separate Modification Permit. 8. A building permit shall be obtained prior to commencement of the construction. 9. This approval shall expire unless exercised within 24 months from the date of approval as specified in Section 20.93.055 of the Newport Beach Municipal Code, unless an extension is approved prior to the expiration date of this approval, in accordance with Section 20.93.055 (B) of the Newport Beach Municipal Code. The Zoning Administrator's decision may be appealed to the Planning Commission within 14 days of the action date. A $975.00 filing fee shall accompany any appeal filed. No building permits may be issued until the appeal period has expired. A copy of the approval letter shall be incorporated into the Building Department and Contractor's Field sets of plans prior to issuance of the building permits or issuance of revised plans. Drawing A shows overall sign at 200 square feet and is far too small for any visible impact. By increasing the size to the optimum size shown on drawing C, we are only utilizing 2.05% of the overall building area.
