The existing structures will be demolished prior to recordation of the Lot Line Adjustment. The property is located in the R-1 District. On January 24, 2005, the Zoning Administrator approved the application request based on the following findings and subject to the following procedural requirements. FINDINGS: The Zoning Administrator determined in this case that the proposal would not be detrimental to persons, property or improvements in the neighborhood. In addition, the approved Lot Line Adjustment would be consistent with the legislative intent of Title 19 and Title 20 of the Newport Beach Municipal Code based on the following findings: 1. The proposal is consistent with the General Plan and the Local Coastal Program Land Use Plan since the Tots are for single-family development, a permitted use in this area. • • January 24, 2005 Page 2 2. The project is categorically exempt from the requirements of the California Environmental Quality Act under Class 15 (Minor Land Divisions) and Class 5 (Minor Alterations in Land Use Limitations). 3. In accordance with Section 19.68.040 of the Newport Beach Municipal Code, the Planning Director has deemed the lot line adjustment application as appropriate to combine the two lots into a single parcel, based on the following: • Voluntary mergers of contiguous lots under a single ownership may be initiated by the lot owner. • The Newport Beach Municipal Code requires the combining of the lots prior to construction of the new single-family residence that would otherwise cross an interior property line. 4. The proposal will not be detrimental to persons, property or improvements in neighborhood. The approved Lot Line Adjustment would be consistent with the legislative intent of Title 19 and Title 20 of the Newport Beach Municipal Code for the following reasons: • The project is a minor lot line adjustment that does not create any new parcels. • The project is in an area with an average slope less than 20%. • The project will not result in a change in land use or density, since no additional lots are created and the single-family residential use will be maintained. • The general exception to the Class exemptions is not applicable in this case, since no significant environmental effects will result from this project because the traffic and parking impacts will not change from that which would result from the use of the original subdivision. • The project site described in the proposal consists of legal building sites. • The lot line adjustment, in and of itself, will not result in the need for additional improvements and/or facilities because public improvements and infrastructure currently exist. • The proposed lot width and lot size are consistent with the zoning regulation requirements of Title 20 of the Newport Beach Municipal Code. 5. Based on the information of this particular case, the Zoning Administrator waives the requirement of a parcel map for the following criteria and reasons: • The proposed lot line adjustment combines the property into a single parcel of land and does not result in the elimination of more than one lot. January 24, 2005 Page 3 • The proposed division of land complies with requirements as to area, improvement and design, floodwater drainage control, appropriate improved public roads, sanitary disposal facilities, water supply availability, environmental protection and other applicable requirements of Title 19 and Title 20 of the Newport Beach Municipal Code and the General Plan. PROCEDURAL REQUIREMENTS: 1. All applicable Public Works Department plan check fees shall be paid prior to review of the lot line adjustment and grant deeds. 2. Prior to recordation of the lot line adjustment, grant deeds indicating the changes in titles of ownership should be submitted to the Public Works Department for review and approval. 3. All vehicular access shall be from the adjacent alley, unless otherwise approved by the Public Works Department. 4. The Lot Line Adjustment and grant deeds reviewed and approved by the Public Works Department should be filed concurrently with the County Recorder and County Assessor's Offices. 5. In conformance with the California Coastal Act, the Coastal Commission approval shall be obtained prior to the recordation of the lot line adjustment. 6. No building permits may be issued until the appeal period has expired, unless otherwise approved by the Planning Department. 7. Prior to final of the building permit for the new single-family dwelling under construction, the Planning Department shall verify Coastal Commission approval of the lot line adjustment and recordation of the document with the County Recorder. 8. This approval shall expire unless exercised within 24 months from the date of approval as specified in Section 20.93.055 of the Newport Beach Municipal Code. The decision of the Zoning Administrator may be appealed to the Planning Commission within 14 days of the date of the decision. Obviously larger houses are becoming a reality in Corona Del Mar, however I feel there needs to be more consideration for maintaining the open space dictated by existing set backs and square foot limitations. The two existing 30' lots (width) require four 3 foot side setbacks — two on each side of the two houses. This guarantees a total width of 12 feet of open space (cumulative width of the setbacks) faces the street. And this also imposes, I am told, specific limits on the available square footage of the 2 houses. When the two lots are combined into one 60' wide lot, 1 understand that only 4 foot setbacks are required on each side of the nuw combined properties. So this totals only 8 foot of open space facing the street -- a 33% reduction in open space from the perspective on the street for the two lots. And the total volume or square footage of the house is also increased proportionately. It is my perspective that the 12' of front facing open space width dictated by the existing setbacks and lot lines should be maintained in any iuc line adjus merc. ►: am simply asking that the current amount of open space facing my home and Marigold be maintained by having 6' side set backs on the combined lot. In case of a claim under this Guarantee, the Company shall have the following additional options: (a) To Pay or Tender Payment of the Amount of Liability or to Purchase the Indebtedness_ The Company shall have the option to pay or settle or compromise for or in the name of the Assured any ctaim which could result in kiss to the Assured within the coverage of this Guarantee, or to pay the full amount of this Guarantee or, if this Guarantee is issued for the benefit of a holder of a mortgage or a Iienh0lder, the Company shall have the option to purchase the indebt- edness secured by said mortgage or said Hen for the amount owing thereon, together with any costs, reason- able attorneys' fees and expenses incurred by the Assured claimant which were authorized by the Company up to the time of purchase. Such purchase, payment or tender of payment of the full amount of the Guarantee shall terminate all lia- bility of the Company hereunder, In the event after notice of claim has been given to the Company by the Assured the Company offers to purchase said indebted- ness, the owner of such Indebtedness shalt transfer and assign said Indebtedness, together with any collateral security, to the Company upon payment of the purchase price. Determinafian and Extent of Liability. This Guarantee Is a contract of Indemnity against actual monetary Ioss or damage sustained or Incurred by the Assured claimant who has suffered loss or dam- age by reason of reliance upon the assurances set forth in this Guarantee and only to the extent herein described, and subject to the Exclusions From Coverage of This Guarantee. The liability of the Company under brie Guarantee to the Assured shall not exceed the least of: (a} the amount of liability stated In Schedule A or rt2; (b) the amount of the unpaid principal indebted- ness secured by the mortgage of an Assured mortgagee, as limited or provided under Section 6 of these Conditions and Stipulations or as reduced under Section 9 of these Conditions and Stipulations, at the time the loss or damage assured against by this Guarantee occurs, together with interest theron; or (c) the difference between the value of the estate or Interest covered hereby as stated herein and the value of the estate or Interest subject to any defect, Iten or encumbrance assured against by this Guarantee. S. Limitation of Liability. (a) If the Company establishes the title. or removes the alleged defect, lien or encumbrance. or cures eny other matter assured against by this Guarantee in a reasonably diligent manner by any method, including litigation and the completion of any appeals therefrom, it shall have fully performed its obligations with respect to that matter and shall not be liable for any loss or damage caused thereby (b) In the event of any iltigabon by the Company or with the Company's consent the Company shall have no liability for loss or damage until there has been a final determination by a court of competent jurisdiction, and disposition of all appeals therefrom, adverse to the title, as stated herein. (c) The Company shalt not be habte for loss or damage to any Assured for liability voluntarily assumed by the Assured in settling any claim or suit without the prior written consent of the Company. 9. Reduction al Liability or Termination of Liability. Al! payments under this Guarantee, except pay- ments made far costs, attorneys' fees and expense$ pursuant to Paragraph 4 shall reduce the amount of liability pm lento. 10. Payment of Loss. (a) No payment shall he made without prOdUcing this Guarantee for endorsement of the payment unless the Guarantee has been lost or destroyed, in which case proof of Ioss or destruction sha_ ll be furnished to the satisfaction of the Company. (b) When liability and the extent of lass ar damage has been definitely feud in accordance with these Conditions and Stipulations, the loss or damage shall be payable within thirty (30) days thereafter. 11. Subrogation Upon Payment or Settlement. Whenever the Company shall have settled and paid a claim under this Guarantee, all right of subroga- tion shall vest In the Company unaffected by any act of the Assured claimant: The Company shall be subrogated to and be entitled to all rights and remedies which the Assured would have had against any person or property In respect to the claim had this Guarantee nat been Issued. If requested by the Company, the Assured shall transfer to the Company at rights and remedies against any per- son or property necessary in order to perfect this right of subrogation. The Assured shalt permit the Company to sue, compromise or settle in the name of the Assured and to use the name of the Assured in arty transaction or litigation Involving these rights or remedies. At arhitra- bie matters when the Amount of liability is $1,000.000 or less shal be arbitrated at the option of either the Company or the Assured.
