The proposal also includes a request to waive the location requirement of the Zoning Code that requires independent massage establishments to be at least 500 feet from other massage establishments. The facility w ill p rovide four m assage treatment rooms, a reception area, a manicure room, a conference room and a staff break room. The property is located in the PC (Newport Place Planned Community) District. Director's Action: Approved February 4, 2005 In approving this application, the Planning Director analyzed issues regarding compliance with Chapters 5.50 and 20.87 of the Newport Beach Municipal Code (Massage Establishments) and the parking requirements of Chapter 20.66 of the Newport Beach Municipal Code. The detailed discussion can be found in the attached appendix. In consideration of those aspects, the Planning Director determined i n t his c ase t hat t he proposal would not be detrimental to persons, property or improvements in the neighborhood. In addition, the Use Permit as approved would be consistent with the legislative intent of Title 20 of the Newport Beach Municipal Code based on the following findings: February 4, 2005 Page - 2 FINDINGS: • • 1. The Land Use Element of the General Plan designates the site for "Administrative, Professional and Financial Commercial" use. An independent massage establishment is a support use permitted within this designation. 2. This project has been reviewed, and it has been determined that it is categorically exempt from the requirements of the California Environmental Quality Act under Class 1 (Existing Facilities). 3. The Planning D irector's a pproval of U se P ermit N o. U P2005-002 (PA2005-005) will not, under the circumstances of this case, be detrimental to the health, safety, peace, morals, comfort, and general welfare of the City for the following reasons: • Adequate on -site parking is available for the existing and proposed uses since the adequate off-street parking spaces exist in the common lot for the proposed establishment. • The proposed use appears to be legitimate and the massage operation is located within a multi -building office complex and not a freestanding building or use. • The proposed use is located in a managed office and Tight industrial complex with coordinated tenant management, which is not a blighted area. • There are no urban renewal or n eighborhood c onservation p rograms i n effect in the area. • The proposed use is not within 500 feet of a place of religious worship, school or playground. • The proposed use will not create a concentration of massage uses in the neighborhood that would be detrimental to the neighborhood or create neighborhood blight. • Compliance with all other applicable regulations of the Municipal Code will be required and enforced. 4. The proposed waiver of the location requirement for the massage establishment will not be contrary to the public interest or injurious to nearby properties and, based on the use as proposed, is consistent with the legislative intent and the location requirements for massage establishments established in Chapter 20.87 of the Municipal Code for the following reasons: • The massage establishment is not within 500 feet of a public or private school, playground, civic center, cultural site or church site. • Although the massage establishment is within 500 feet of another independent massage establishment, this facility and the other facility within 500 feet both provide massage services as the primary use of the proposed personal service facility; however, it is anticipated that the use will not create any detrimental effect on persons working in the vicinity. • The massage establishment is part of a larger multi -building office and light industrial complex and not a freestanding single -use facility. • The proposed use will not be contrary to the public interest or injurious to nearby properties, and the spirit and intent of this Section will be observed. February 4, 2005 Page - 3 • • • The proposed use will not enlarge or encourage the development of an urban blight area since the proposed office complex location is not blighted. • The establishment of an additional regulated massage use in the area will not be contrary to any program of neighborhood conservation, nor will it interfere with any program of urban renewal since no such programs exist within the neighborhood that is the subject location of the proposed use. • The use at the proposed location will not adversely affect t he u se of a place used exclusively for religious worship, school, p ark o r playground since it is not located within 500 feet of such use. • All applicable regulations of the Municipal Code will be applied to the proposed facility and will be routinely observed and monitored by the Police Department. 5. The approval by the Planning Director of Use Permit No UP2005-002 will not, under the circumstances of the case be detrimental to the health, safety, peace, morals, comfort and general welfare of persons residing or working in the neighborhood or be detrimental or injurious to property or improvements in the neighborhood or the general welfare of the City for the following reasons: • The proposed operation of the massage establishment is an ancillary service use located within an office and light industrial complex and is consistent with the legislative intent of Chapter 20.87 of the Municipal Code. 6. The required number of off-street parking spaces exists in the common lot for the proposed establishment, as required by Zoning Code Regulations. CONDITIONS: 1. The development shall be in substantial conformance with the approved floor plan. 2. The project shall comply with State Disabled Access requirements. 3. Only four licensed massage technicians shall be permitted to operate within the facility at a ny o ne t ime, a nd t he a ddition o f a ny stations or rooms for massage technicians to the business shall be subject to an amendment to this Use Permit. No more than four treatment rooms shall be permitted to provide massage services at any one time within the facility. 4. Any changes to the existing parking lot configuration shall b e s ubject to further review by the City Traffic Engineer for the on -site parking, vehicular circulation and pedestrian circulation systems. 5. The daily hours of operation shall be limited to between 9:00 a.m. and 8:00 p.m., and shall also be subject to the operational requirements provided in Chapter 5.50 of the Municipal Code. 6. All applicable requirements of Chapter 5.50 of the Municipal Code shall be fulfilled. 7. At least one parking space for each 250 sq. ft. of gross floor area shall be provided on -site for the proposed facility. February 4, 2005 Page - 4 • • 8. Employees shall park on -site at all times. 9. No temporary "sandwich" signs, balloons or similar temporary signs shall be permitted, either on -site or off -site, to advertise the proposed food establishment, unless specifically permitted in accordance with the Sign Ordinance of the Municipal Code. Temporary signs shall be prohibited in the public right-of-way, unless otherwise approved by the Public Works Department in conjunction with the issuance of an encroachment permit or encroachment agreement. Standard City Requirements: 1. All signs shall conform to the provisions of Chapter 20.67 of the Newport Beach Municipal Code. 2. The Planning Director or the Planning Commission may add to or modify conditions of approval of this Use Permit, or revoke this Permit upon a determination that the operation that is the subject of this approval causes injury, or is detrimental to the health, safety, peace, morals, comfort, or general welfare of the community. 3. This approval shall expire unless exercised within 24 months from the end of the appeal period, in accordance with Section 20.91.050 of the Newport Beach Municipal Code. The decision of the Planning Director may be appealed by the applicant or any interested party to the Planning Commission within 14 days of the date of the decision. The subject business is not located within 500 feet of any public park, public or private school, playground, church or civic cultural site. However, it is within 500 feet of an existing independent massage establishment. The applicant is requesting t hat t he r equirement for s aid location b e w aived since the other facility is located on Birch Street which is 200 feet down and across Birch Street from the subject property. The proposed facility mainly provides massage as the primary service. The applicant believes that the location requirement should be waived since the facility provides services other than solely massage services, and massage rooms comprise less than 27% of the facility square footage. Based on the information provided by the applicant with regard to the proposed operations, staff is in agreement that the waiver of the location requirement is appropriate in this particular case. As shown on the attached floor plan, the overall square footage of the personal service facility i s a pproximately 9 50 square feet, with the square footage devoted to massage activity limited to two rooms containing approximately 160 square feet of floor area (designated as Treatment Rooms 1 and 2 on the floor plan). The daily hours of operation of the facility vary but range between 9:00 a.m. and 8:00 p.m. The massage service will be available by appointment during regular business hours only. Section 20.87 Compliance Section 20.87 of the Municipal Code sets forth the provisions that govern the establishment and location of massage services within the City. It is intended to allow and promote the operation of legitimate massage services and to prevent problems of blight and deterioration that might accompany or be brought about by large numbers of massage establishments. The spirit and intent of Chapter 20.87 seeks to prevent the establishment of uses that may act as fronts for illegal activity by dispersing the location of massage establishments, preventing their concentration within certain noncommercial areas of the city, and by establishing specific Zoning Districts in which the use is permitted. In t his c ase, t he p roposed m assage e stablishment a cts as an a ncillary u se or service incidental to a personal service establishment. The amount of floor area dedicated to massage is minimal in comparison to the total floor area of the existing facility (approximately 27% of the total square footage of t he f acility), a nd i s located within a multi -building office complex as typically found in commercial districts. Request for Waiver of Location Restrictions Chapter 20.87 of the Municipal Code also establishes specific location requirements for independent massage establishments. Chapter 20.87.025 (A) states that, notwithstanding February 4, 2005 Page - 6 • • any other provision of the Municipal Code, no use permit shall be approved for any massage establishment if the proposed site is located: 1. Within 500 feet of any public or private school, park or playground, civic center, cultural site or church site; or 2. Within 500 feet of any other massage establishment site. Note: The proposed massage use is located within 500 feet of another independent massage establishment located at 4063 Birch Street. Therefore, a waiver of location restrictions [as specified in Chapter 20.87.025 (A) of the Municipal Code] must be granted for the Use Permit to be approved. in order to waive any location restriction the Planning Director must make all of the following findings: 3. The proposed use will not be contrary to the public interest or injurious to nearby properties, and that the spirit and intent of this Section will be observed; and 4. The proposed use will not enlarge or encourage the development of an urban blight area; and 5. The establishment of an a dditional regulated use i n the area w ill not be contrary to any program of neighborhood conservation nor will it interfere with any program of urban renewal; and 6. The use at the proposed location will not adversely affect the use of a place used exclusively for religious worship, school, park or playground; and 7. All applicable regulations of this Municipal Code will be observed. Staff is of the opinion that the use will not add to any detrimental affect related to the close proximity of the massage establishment to another massage establishment and that the waiver of location restrictions is appropriate in this case for the following reasons: • The proposed use appears to be legitimate and the massage operation is located in a larger multi -building office complex and not a freestanding building containing only the massage facility. • The proposed use is located in a managed office complex with coordinated tenant management, which is not a blighted area. • There are no urban renewal or neighborhood conservation programs in effect in the area. • The proposed use is not within 500 feet of a place of religious worship, public park, school or playground. • The proposed use is by definition within 500 feet of another independent massage establishment. However, the other facility that is within 500 feet is a February 4, 2005 Page - 7 • small facility that also provides solely massage services as its primary use and is located on Birch Street. • The proposed use will not create a concentration of massage uses in the neighborhood that would be detrimental to the neighborhood since the two facilities are 250 feet distant from each other. • Compliance with all other applicable regulations of the Municipal Code will be required. Title 5 Compliance In addition to the Title 20 requirements mentioned above, Title 5 of the Municipal Code (Business Licenses and Regulations) also includes provisions for the review and approval of operator permits, massage technician permits, and requirements of operation for massage establishments. The applicable permits and necessary business license as required by the Municipal Code must be secured before the operation of the massage establishment. Parking Requirement Since the subject use is a personal service use, the parking demand for the use is not any greater than that for a general office or an ancillary retail use that is permitted by right without approval of a Use Permit within the subject commercial district.
