NEWPORT BEACH ZONING ADMINISTRATOR MINUTES

REGULAR MEETING – 10:00 A.M.
I. CALL TO ORDER – The meeting was called to order at 10:02 a.m.

II. REQUEST FOR CONTINUANCES
The Zoning Administrator reported that staff requested Item Number 3 to be removed from calendar and will
be re-noticed appropriately.
III. APPROVAL OF MINUTES
ITEM NO. 1 MINUTES OF JUNE 11, 2020

IV. PUBLIC HEARING ITEMS
ITEM NO. 2 712 Iris LLC Condominiums Tentative Parcel Map No. NP2020-004 (PA2020-059)
Site Location: 712 and 712 1/2 Iris Avenue Council District 6
The Zoning Administrator introduced the project explaining request for a tentative parcel map for two-unit
condominium purposes. A duplex will be demolished and a new duplex is currently in the building permit
review process. No waivers of Title 19 (Subdivisions) are proposed. The Tentative Parcel Map would allow
each unit to be sold individually. He mentioned he recieved advanced notice that the applicant, Glen
Gwatney of Anacal Engineering, on behalf of the 712 Iris, LLC, had reviewed the draft resolution and agreed
with all of the required conditions.
The Zoning Administrator explained that written comments were received from Mr. Jim Mosher. The following
edits will be made to the resolution: update reference to the meeting location, update Condition No. 12 to clarify
that the easement is existing and the existing easement will be maintained and widened, and add a condition
stating that that prior to recordation of the parcel map, the existing duplex shall be demolished.
The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment,
the public hearing was closed.
Action: Approved as amended
ITEM NO. 3 AT&T Small Cell SLC4735 Minor Use Permit No. UP2019-027 (PA2019-108)
Site Location: Public right-of-way, City streetlight number SLC4735, center median of
Avocado Avenue at the intersection of Kewamee Drive and Avocado Avenue

ITEM NO. 4 Faerber Residence Coastal Development Permit No. CD2020-013 (PA2020-029)
Site Location: 405 Cortes Circle
Council District 6
Liane Schuller, Planning Consultant, provided a brief project description stating that the property is currently
developed with an existing single-family residence and attached 2-car garage. The property is located at
the end of a cul-de-sac, which places the existing residence forward of the adjacent properties on either
side. For this reason, the stringline does not represent the predominate line of development and almost
bisects the existing residence, as illustrated on handwritten page 3 of the staff report, rendering the existing
structure non-conforming.
The applicant requests approval to enclose two existing 65-square-foot decks on the main and lower floor
levels to enlarge the existing adjacent bedrooms, and also to construct a 210-square-foot multi-purpose room
at the upper level. The Coastal Implementation Plan (Section 21.38.040(C) allows modification of
nonconforming portions of a structure provided the degree of non-conformity is not increased. The proposed
deck enclosure will occur within the existing structural envelope/footprint above the ground level, in line with
the existing degree of stringline encroachment. The proposed upper level addition complies with all
development standards, including the canyon stringline.
Staff received correspondence from two property owners on Hazel Drive expressing concerns about the
large, unpermitted metal gazebo on the rooftop and potential visual impacts from the proposed upper level
addition. Ms. Schuller explained that the upper level addition meets all development standards, is
approximately 4 feet below the maximum height limit, and would normally have been exempt from a coastal
development permit except for the variance request for the deck enclosures. Ms. Schuller also addressed
a comment letter from community member Jim Moser.
Applicant Cynthia Faerber, accompanied by architect Mark Dwyer, stated that she had reviewed the draft
resolution and agrees with all of the required conditions, including an additional condition requested by the
Zoning Administrator to remove the unpermitted roof top gazebo.
The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment,
the public hearing was closed.
Action: Approved as amended

VI. ADJOURNMENT
The hearing was adjourned at 10:25 a.m.
