Dear Housing Element Update Advisory Committee:
In your July 15, 2020 Agenda you have an item entitled "Lessons Learned From Prior Outreach and
Discussion of Future Outreach" regarding the public participation in the General Plan Update of the City's
Housing Element. Though not directly generated by the Committee's outreach efforts, Still Protecting Our
Newport (SPON) would respectfully remind the Committee of the SPON RHNA Resolution sent to the City
Council for its January 28, 2020 meeting.
The attached Resolution was prepared by SPON to support the City's efforts to challenge the unfair
Southern California Association of Governments’ (SCAG) Regional Housing Needs Assessment (RHNA)
methodology used by it to allocate 4832 units to the City of Newport Beach. The Resolution should alert
you of the public's interest in General Plan and Housing issues facing this community. Further, the list of
439 Newport Beach resident endorsers might be of use as possible contact persons interested in the
Committee's outreach efforts.

include endorsements from 439 Newport Beach residents and an additional 94 endorsements from
residents in communities neighboring Newport Beach.
All duplicates that we found on the list were removed.

RHNA RESOLUTION – January 20, 2020
Whereas the undersigned residents of Newport Beach object to the Southern California Association of
Governments’ (SCAG) 6th Regional Housing Needs Assessment (RHNA) revised allocation (4,832) methodology
approved by SCAG on November 7, 2019 because of:
a. Insufficient opportunity for public review and comment, and;
b. Rejection of earlier allotment numbers generated and vetted over a long period of time; and;
c. Short time period for RHNA implementation, and;
Whereas the Chapman University forecast projects statewide permitting at 115,000 units in 2020, nowhere
near the statewide need of some 500,000 new units per year suggested by Governor Gavin Newsom,
concluding that the California Department of Housing and Community Development’s (HCD) 1.3 million
regional allocation “is illogical and would be impossible to pull off, even if it was plausible” due to a weak real
estate outlook tied to limited population growth, slower hiring pace, and aging owners, and;
Whereas Newport Beach should be considered unique in many ways including:
a. Newport Beach has an overall density of 3,600 persons per square mile with especially high
densities of dwelling units per acre in the beach communities, while still allowing access for
thousands of beachgoers and other visitors to the coastal amenities we provide,
b. Newport Beach residents have worked over the years to protect the unique coastal resources
which are enjoyed by and benefit statewide visitors which include wetlands, coastal bluffs, parks,
and important ecosystems such as the Upper Newport Bay, the Newport Coast, Crystal Cove, the
Banning Ranch, and;
c. Newport Beach sends funds for statewide purposes from income, sales and property taxes without
receiving enough back to clean and police the bay, beaches and parks used by statewide visitors,
and;

d. Newport Beach residents had the foresight to initiate a Parks Dedication Ordinance calling for five
acres per thousand new residents and this part of our infrastructure needs to be considered in
approving new housing, and;
e. Newport Beach residents had the foresight to initiate a Traffic Phasing Ordinance which calls for
development of our circulation infrastructure to accommodate new traffic and this part of our
infrastructure needs to be considered in approving new housing, and;
f. Newport Beach has essentially kept up (all but 1 very low cost unit) with its RHNA 5th cycle
mandates called for from 2013 ‐ 2020. Having fulfilled those goals, the City has also allowed 1,200
apartment units at Uptown Newport and recently entitled 270 more apartment units, including
affordable units, at Newport Crossings. Although these projects were entitled before the end of
the 5th RHNA cycle, they nevertheless showed Newport's efforts to provide housing for moderate
to low income families. Any of these units that were not required to fulfill the 5th cycle
requirements should be counted toward the upcoming 6th cycle.
Whereas, Newport Beach has taken steps already to provide for various types of needed housing, such as:
a. Newport Beach has already adopted zoning allowances for more accessory dwelling units on 5,000
properties, at least 25% of which should be counted toward new RHNA allocations, and;
b. Newport Beach has recently approved two new assisted living facilities accommodating over 200 of
our elderly population and many six‐unit assisted living homes, spread throughout our
neighborhoods and serving as a primary residence for many elderly people, which should be
counted toward new RHNA allocations, and;
c. Newport Beach has a significant number of undocumented rentals and low rent rooms in homes
throughout the City which are not accounted for and which should be considered in new RHNA
allocations because of their provision for low cost housing, and;
d. Newport Beach gives permits for 56 boat “live‐aboards” and could consider more to provide low‐
cost housing, and;
e. Residents of Newport have successfully opposed new luxury condos in favor of planning for more
affordable units, and;

Whereas, the RHNA allocations called for by the State would seriously destabilize other parts of our previously
well‐planned infrastructure including schools, and;
Whereas, Newport Beach is currently undertaking a complete General Plan Update to include a focus on
sustainability and reducing vehicle miles traveled (VMT), and;
Whereas, Newport Beach should not have to sacrifice the long standing values and programs established in our
General Plan, including pending successful efforts to preserve the Banning Ranch, and;
Whereas, Newport Beach has a health and safety challenge of serious consequences:
a. in planning for potential emergency evacuations, and;
b. in managing on a daily basis the timely and effective response for emergency vehicles due to
overcrowded roads and arterials, and;
Whereas, the RHNA allocations and schedule being placed on SCAG cities, including Newport Beach, create a
chaos and turmoil for citizens and officials who have worked for and relied upon the many values, unique
circumstances and related local ordinances stated above;
Therefore be it resolved that the organizations and individuals below request that the City of Newport Beach
convey to the State that the City cannot meet the schedule that is currently demanded and the State’s RHNA
allocation is not acceptable unless and until the City has negotiated and agreed to the resolution of the issues
and numbers given above and the City is able to show that any new zoning can be consistent with our General
Plan.

Over the last 22 years that I have been a resident of
CDM, the traffic congestion has increased many fold.
What was a once a 5 min ride down PCH from Cameo
Highlands to Mac Arthur (2miles), now can take up to 20
minutes. Not only is it an annoyance of daily life, but it
significantly increases pollution with all of the idling cars.
The quality of life from the traffic and housing density
with not enough garage parking (e.g. new condos that
don’t require two parking spots/unit) has had a direct
negative impact on the quality of life in this beautiful
community.

The prospect of adding another 4,832 new houses to
Newport Beach is unrealistic and unfounded. There
simply is no room to add this many new houses in our
city and the infrastructure is presently inadequate to
handle the growth that has already occurred in Newport.
It is unrealistic and operationally unfathomable that the
city can absorb another 4,832 houses and serve the
increased population that will result. The city currently
lacks the resources to support our present population
and our roads, schools, social and city services are
already overburdened. I am STRONGLY opposed to this
and will do whatever I can to defeat it.

Since they fit the city's definition of a dwelling (a kitchen,
a restroom, and a place to sleep), they should be

We support SPON's resolution, and ask you to do the
same. The RNHA numbers are grossly miscalculated, as
they appear to not take into account several economic
factors. I respectfully suggest you reference Jim Dotti's
(Chapman University) recent Economic & Business
Review, in which he discusses this (Volume 38 Number 1
December 2019, page 24 "A Faulty Report Leads to
Faulty State Policy"). Or better yet, call on him.
Additionally, Newport Beach area is a beach community,
serving a tourist trade and supporting recreational
activities. This niche is not suited for cramming in more
housing, more traffic, and more strains on the eco
system.

We already have too many residences which cause
traffic gridlock and significant demands on our water
supply. Also negatively impacted are local public schools
and other facilities and events. Even a small number of
additional homes will escalate these problems and
negatively effect the quality of life in Newport Beach.
This will drive down property values and cause tax‐
paying residence to leave the area, as well as reducing
the tourism attraction to Newport. The 4,832 required
new residences in Newport Beach will ruin this city.

A previous RHNA number that the City of Newport Beach
was given was 5. The City of Newport Beach permitted
over 1,700 units. I believe that alone should warrant a
large reduction in the number of units the City of
Newport Beach now must provide.

The amount of natural open space in San Diego, Orange,
Riverside and San Bernardino Counties is rapidly
disappearing. Los Angeles County has virtually no natural
open space. Orange County is rapidly becoming another
Los Angeles as most cities approve new high density
residential developments. Our roads and freeways
cannot handle traffic from the ever growing influx of
more residents. Yet the State Government offers no
solution to mitigate traffic gridlock and continue to
allow, and now force cities to add more residents? This is
absurd. Let the cities and state FIRST plan and develop
new high speed transportation systems to ease current
gridlock BEFORE talking adding more traffic.

Resolution reflects major concerns. Access to many
parts of Newport Beach is limited by being bordered by
the ocean and that limitation creates a major safety
hazard to the community. Just on a Sunday afternoon
not only in the summer but other times as well the back
up on the roadway to leave the Peninsula can be up to

Newport Beach, where we pay exorbitant taxes do not
want Projects popping up, which Gavin Newsome is
proposing! Our Govt officials need to get to the bottom
of this crisis and simply putting ‘projects’ up in our
community is unacceptable. Newsome is proposing a
band‐aid on an issue that requires a tourniquet. Build
these Projects where open space is readily available! We
have a mental illness/drug and alcohol crisis happening

property. The government is by the people snd for the
people. This is not a dictatorship. The government
should protect us from this kind of problem not mandate
that we ruin our families, lives, homes, property &
families by dictating how we should live because a
different population of people have abused their
existence through ignorance, bad parenting, alcohol or
drug abuse, entering the USA illegally, by not studying in
school or learning a trade, or mental problems. These
are people the government & it’s services is obligated to
take care of. Those in government must balance the
budget & provide education, temporary housing on State
run properties, job placement, physical & mental

The City of Newport Beach offers, for its residents and
public visitors, a distinctive and finite menu of Natural
Resources‐‐ocean, bay, hills,wetlands . These are finite
and need to be preserved at all cost. The General Plan
needs to protect these areas in perpetuity‐‐‐they cannot
be recovered. Futhermore, these resources are delicate,
and are vulnerable to natural disasters if they are over‐
intensified, particularly with development that stresses
integrity and creates life safety threats with
ingress/egress.( floods, landslides, liquifaction).
Residential development should be ONLY in the context
of where it does not over‐burden and increase life safety
risk. A sound, realistic Land Use Plan, developed through
adequate vision , evaluation and public process, is critical

put our citizens and the public at risk.
Sound Housing development decisions must flow from a
well thought out Land Use Element of the General Plan‐‐
definitely not vice versa. There are definitely some areas
that could be intensified‐‐‐where additional
intensification is appropriate. There are others where
intensification is counterproductive.Our thoroughfares
across Newport Beach also are inherently limited, and so
should residential development needs to be carefully
considered. We need to ,through careful process,
"inventory" our assets with legitimate potential for reuse
and see what makes sense. Right now, staff appears to
be making knee‐jerk recommendations. Real estate
development has long term and some irrevocable
implications, and should not be taken lightly. Thank you.

Just because the City neglected to build low income housing
over the years and took funds instead, they should not be
allowed to build on Banning Ranch or other precious habitats
as a default. I've been around long enough to know the City
had many chances to build low income but repeatedly choose
to take money from developers instead of making them build
the units that were required. That is not our problem ‐ it was
the City problem and they need to make it right!!

The number of new housing units required for the city
of Newport Beach is not reasonable and definitely not
sustainable. The environmental impact of such a mass
development requirement will be devastating to our
oceans and coastal landscape. We need to look at
converting existing housing to address the homeless
and affordable housing crisis and not mandate a
number of new construction units per city.
Coastal/beach areas are a lot more vulnerable and

Preserving open space protects our local
natural resources and the humans living
around them. The planet is already threatened
by overdevelopment. Increasing the number
of buildings makes housing costs HIGHER while
destroying natural resources and damaging our

Ranch protects the habitat and breeding

I reject high density building in Newport
and Costa Mesa. This includes any future
development on banning ranch. The state
has overstepped its boundary with regard
to housing at this point. I am 37 years old
and am happy in a 1100 sq. Ft. House on a
8000 sq. Ft. Lot, which I purchased in 2015.
I have no interest in living in a crowded
area, which much of Ca is already. I have no
interest in fighting for parking or driving on
crowded roads, or sitting in a crowded bus.
The beach is already too crowded in the
Summer. I am certain my children will not
have the same great beach experience I
had growing up, and I hate to say it, but it’s
only getting worse. There is limited beach
space and the whole USA will not fit onto

The Banning Ranch Conservancy, including
many Costa Mesa Residents, fought long and
hard to preserve Banning Ranch as an open
space and, hopefully one day, a Nature
Preserve. The Ranch property contains
threatened and endangered plants and
animals that are protected by the
Endangered Species Act. The Coastal
Commission ruled in our favor after an 11‐
hour hearing with presentations by both
sides. Banning Ranch Conservancy recently
received a donation of $50,000,000 from a
local supporter to purchase the property

We need to protect what little open space we
have left. More housing, "affordable" or
otherwise, does not solve the underlying issues
and additional coastal development is certainly
not the answer.

The Banning Ranch Conservancy, including
many Costa Mesa Residents, fought long and
hard to preserve Banning Ranch as an open
space and, hopefully one day, a Nature
Preserve. The Ranch property contains
threatened and endangered plants and animals
that are protected by the Endangered Species
Act. The Coastal Commission ruled in our favor
after an 11‐hour hearing with presentations by
both sides. Banning Ranch Conservancy
recently received a donation of $50,000,000
from a local supporter to purchase the
property and restore/maintain it as a natural

I appreciate Governor Newsom's efforts to increase
affordable housing for those who need it. My wife,
daughter and I had to leave our rental home of 9
years because our landlord raised the rent after
observing higher monthly rates of a nearby AirBnB
property. However, I am concerned that the state
may be forcing counties and cities to build more
affordable housing when the amount of existing
empty housing units (single‐family homes,
apartments, condos, trailer homes, etc.) outnumbers
the homeless population. For example, "At least
36,000 homeless people live in the city of Los
Angeles, but L.A. potentially has more than 41,000
empty housing units, according to a report released
Tuesday by UCLA law students and a coalition of
economic justice organizations."

the significant negative impacts of urban sprawl,
which has increased traffic congestion, air pollution,
noise pollution and water pollution. Sprawl has also
destroyed habitat for theatened wildlife species and
removed valuable open space/natural area for
human benefit. Please consider creative strategies
that make existing housing units more
affordable/accessible versus destroying our
remaining open spaces/natural areas. Many private
developers are already taking advantage of the
statewide pressure and proposing new high‐density
housing units in inappropriate locations, including
congested urban areas and irreplaceable, fire‐proned

Item V.b. LESSONS LEARNED FROM PRIOR OUTREACH AND
DISCUSSION OF FUTURE OUTREACH
The “Overview” on page 1 says a major goal of the effort was to “assess the current General
Plan Vision.” I am unable to find any conclusion regarding that.
The other major goal was to “provide recommendations for a future General Plan Update.” The
recommendation seems to be limited to the “heat map” of future housing sites provided on page
10. Having attended two, possibly three, of the workshops that generated this, I place little value
on it. Not only does it represent the opinions of a very tiny segment of the public, but the few
who participated did so out of context (including without explanation of constraints that might
exist), and with little conclusion other than they, generally, did not want more housing near
where they live.
It might also be noted that the Newport, Together website continues to exist, but it does not
appear to have been updated to inform the folks who stumble onto it as to that effort’s current
status (or the existence of the new committee).
