Mr. Letterman:
Thank you for your time on February 5", 2018 to discuss the fire alarm replacement project at 100
Bayview with Raymi Wun, Deana Marquis and Scott McLeran in attendance.
Due to ongoing system issues with the existing Simplex fire alarm and the subsequent parts availability
issues, Ownership has elected to replace the existing fire alarm system. Under HCI's current contractual
scope of work is to provide a one for one device replacement of the existing Simplex fire alarm system to
a new EST system. HCI has submitted the fire alarm drawings with this scope as of October 18, 2017
under Permit Number: F2017-0571 & Plan Check Number: 2336-2017. Per the plan check comments
provided, the Ownership is being requested to provide a complete ADA upgrade of the building to meet
current CBC and NFPA standards set forth.
Being that this request of full upgrade in the facility is a financial hardship, Ownership is requesting a
Memorandum of Understanding to allow some concessions from the City of Newport Beach Fire
Department plan check request. Per the meeting held on February 5'", Ownership would like to request
that all tenant spaces that are considered "core and shell' be provided with minimal strobe coverage, ie
the main entry doors and exit doors only. These spaces are as follows: Suite 100 & 400. The basis for this
request is that these tenant suites are not being used as public assembly of which Ownership has
confirmed that they do not have a potential to be occupied. Once these suites are built for the incoming
tenants, they will be upgraded to meet current Code requirements as required per CBC and NFPA
standards.
Ownership would also request that all tenant spaces that are not currently occupied be allowed to remain
at current fire alarm installation until the next tenant occupies the tenant space. These tenant spaces are as
follows: 230, 320, 350, 360, 560, 2060, 3600 & 4000. Once these suites are built for the incoming
tenants, they will be upgraded to meet current Code requirements as required per CBC and NFPA
standards.

As part of this agreement, all common corridors, public bathrooms and currently occupied tenant spaces
shall be upgraded to current ADA strobe coverage under the fire alarm upgrade project. Should the core
and shell tenant spaces and non -occupied tenant spaces not be occupied by a new incoming tenant by
December of 2019, Ownership agrees to upgrade these areas with full ADA strobe coverage.
