Hello I am a current resident of Newport Beach. I understand that the Council is considering an
amendment to the zoning code in the City to allow wine tasting rooms to operate in the Industrial
Zone off of 16th Street and Placentia. I kindly request that you pass this amendment allowing wine
tasting rooms to operate in this area.
The Industrial Zone area is a part of the City that would certainly benefit from this improved use!
Allowing this type of social setting to open and thrive is exactly what the City needs. As a local, I
would love to see this part of town zoned so that I can gather with friends and enjoy some local wine
in such a social setting. Further, this would be a fantastic way to support local, small businesses. We
need to do all we can to support small businesses, especially given the current pandemic.

My name is Matthew Parisi and my wife and I are homeowners in Newport Beach. We have lived in the City for the past
eight years and consider it our home. I also own a small business as well as run a national non-profit organization, both
based here in Newport Beach.
I am writing to you today to voice my full support for the zoning amendment that you are considering at your next
Council meeting on August 25th. As it is spelled out on the agenda, the zoning code amendment will allow for wine
tasting rooms to operate in the Industrial Zone of Newport Beach near 16th Street/Placentia/Monrovia. I urge you to
support this zoning amendment as well!
As a peninsula resident, I still view this City as a small town. Part of the 'small town feel' includes visiting an area that is
geared more toward locals rather than our City's visitors. If the Industrial Zone were to have this improved use to allow
for wine tasting rooms, it would provide exactly the social opportunity that locals, like myself, are looking for!
Further, as a small business supporter, I believe this zoning amendment will allow for small business owners to grow
their businesses. We all know how important it is to give every small business an opportunity to grow, especially given
this terrible pandemic,
I kindly and respectfully ask you to support the zoning code amendment and allow wine tasting rooms in the Industrial
Zone of Newport Beach!

My name is Shauna Parisi and I am a homeowner and business owner in Newport Beach. My husband and I
have lived on the Peninsula for a number of years and I started my own small consulting business based here
in Newport as well. With this in mind, I urge you to support the zoning code amendment which would allow
wine tasting rooms in the Industrial Zone off of Placentia & 16th Street.
As a resident, I have long enjoyed the opportunity to meet with friends away from some of the hot spots where
tourists visit regularly. The social opportunity that re -envisioning this neighborhood will bring to the community
is certainly a benefit. That part of Newport Beach has so much potential and can be a wonderful place for all of
us to enjoy some local wine with friends and family. Approving this zoning code amendment would be of
outstanding social benefit for our community.
In addition, supporting this amendment will help support small, local, family owned businesses. This terrible
pandemic and the accompanying shut down of cities and businesses has brought so much hardship on many
small businesses. What better way to support a sub -group (wine tasting rooms) of small businesses than to
open up a new zone for them to start or establish business locations.

My name is Jim Walker and as you may know, I am the owner of the Bungalow restaurant in Corona del Mar. I am also
pass President of the Newport Beach Restaurant Association.

areas that have been converted to other uses. One example is Chicago's meatpacking district which was converted to

I am a first responder and support the amendment to change zoning in the City to allow wine tasting rooms to operate
in the Industrial Zone off of 16th Street and Placentia.
I grew up in Newport, graduated from Newport Harbor, am a Registered Nurse, a Newport business owner, and a youth
beach volleyball coach. I have previously worked at Hoag Newport and many Hoag surgery centers on Hospital
avenue. I am currently working long shifts doing drive -up COVID testing in full hazmat PPE, Monday through Friday. It is
outside under a tent in the heat. It is extraordinarily difficult and dangerous nursing. Please consider what I have to say.
I am aware that the Council is considering an amendment to the zoning code. I kindly request that you PASS THIS AMENDMENT
allowing wine tasting rooms to operate in the Industrial Zone off of 16th Street and Placentia.
This area of the city could really use something nice. Most of the places are car shops, although there is a great coffee shop in the
area (Daydream) and having that coffee shop there actually made it a better area. It would be nice to see something where I could go
wine tasting after a long shift. I am sure there are many other medical professionals who work at or near Hoag who would appreciate it
too.

I am writing this to ask you to PLEASE SUPPORT changing the zoning ordinance to allow for WINE TASTING
ROOMS. Newport is a city of people who enjoy wine and tasting experiences; however, we often have to drive to
Temecula for that purpose. I think our city would benefit from wine tasting rooms, especially because:
• They attract affluent and classy customers. Newport needs more of this.
• They promote responsible appreciation of wine and attract additional business towards our city.
• Wine Tasting Rooms offer a more intelligent choice for evenings than the "Peninsula Bar Scene" that is often
rowdy, rude, and overcrowded.
• Newport has been unfortunately developing a bad reputation as a summer party town, and it is not a good
thing. Local residents are tired of trashy dive bars.
• We want something nice that is primarily wine focused. The existing options of our amazing restaurants are
only food -focused that offer wine as a secondary thought.
Wine tasting rooms are classy, and Newport is classy. As a resident I really don't want to drive to another city or area. I
want to enjoy wine tasting where I live. Please SUPPORT changing the zoning ordinance to allow for wine tasting rooms
in the city of Newport Beach in the Industrial Zone off of 16th Street and Placentia.

My name is Sherrie Palmer, I live and work in the city of Newport Beach. I recently heard that the Council is considering

Placentia and 16th street South in the industrial area. I highly request to pass this amendment to allow this type of
business to operate in this area.
This is exactly what the City needs! The Industrial Zone area is part of the City that would be perfect and benefit from

business, to allow the community a place to go to meet with their friends and family, and enjoy some local wine in a
social setting. This is a great time and a fabulous way to support small local businesses. The pandemic has hurt so many

Item 15. Ordinance No. 2020-20: Non -Exclusive Commercial Solid Waste

The staff report (page 15-3) that "some edits" have been made to the very lengthy attached
Agreement compared to the version previously reviewed and adopted by the Council. What those
changes may have been seems to be left as an exercise for the reader.
That does not, to me, seem to promote efficient oversight on the part of the Council members who
may have diligently reviewed the previous version.
Item 16. Ordinance No. 2020-21: Zoning Code Amendment to Allow Wine
Tasting Room Uses within the Industrial Zoning District (PA2020-042)
In theory, this is just the introduction of an ordinance, and the real debate as to its merits would
come two weeks (or more) from now, after its text has been published and the public and Council
have had time to evaluate it.
But of course, that's not how things are done in Newport Beach, so it appears the time to present
arguments is now or never.
The principal argument against adopting this measure is that, despite City staff's protestations to
the contrary, amending the Zoning Code as proposed is, quite simply, incompatible with the
IG land use designation approved by voters in 2006 (see Resolution No. 2006-77, page 5), and
assigned by them to this (and to the best of my knowledge, only this) as the one small exclusively
industrial area of the city.
As the staff report correctly observes, the voter approved General Plan definition is "The IG
designation is intended to provide for a wide range of moderate to low intensity industrial uses,
such as light manufacturing and research and development, and limited ancillary commercial and
office uses."
Our General Plan does not define "ancillary uses," but the common understanding would be uses
subordinate to and serving the primary uses.
The non -voter -approved text and policies of the General Plan support that interpretation. They
express a wish to improve the appearance of the area (Goal LU 5.5), but not to change its use.
Indeed, Goal LU 6.7 identifies the IG area of West Newport Mesa as "providing opportunities for
needed uses that cannot be accommodated elsewhere in Newport Beach").
Yet staff report says the amendment is intended to accommodate a particular and quite
unexpected use: a wine tasting room. That use is not light manufacturing and research and
development nor is it ancillary to them. It is, instead, a sales showroom for products manufactured
elsewhere (apparently outside the city). And the audience for the products it is promoting is not
primarily the true IG tenants, but rather an audience drawn from outside the IG district by
advertising. Indeed, to avoid parking and traffic conflicts, we are told the wine tasting customers
will be present primarily when the IG uses are closed and their tenants not there.
A wine tasting room is most definitely not among the "needed uses that cannot be
accommodated elsewhere in Newport Beach."

Moreover, as I tried without much success to inform the Planning Commission,' the way our
Zoning Code is written, doing staff's bidding of defining "wine tasting rooms" as a new
category of land use and designating them as an allowed use in the IG zoning district
prevents their approval in any other zoning district — that is, anywhere else in the city.2
Indeed, the planner presenting this indicated there were other tasting rooms operating under the
Type 2 ABC license elsewhere in the city. If they fit the new definition of "Wine Tasting Room" they
will presumably become non -conforming and have to relocate to the IG area.
The Council may legitimately question if the IG area of West Newport Mesa has panned out as
hoped in 2006 (it was specifically expected to attract marine -serving industries that did not need to
be located on the water). But before approving a new use that is neither light manufacturing nor
research and development nor directly serving those uses, it needs to amend the definition of IG in
the General Plan and through that, the people's vision for this area. Staff has not asked it to do
that, and in view of the omission of that larger question I believe this ordinance has to be denied.
Item 17. Resolution No. 2020-76: Appeal of Planning Commission's
Decision of an AT&T Small Cell Installation (PA2019-111)
The grounds for this appeal seem quite tenuous to me.
However, appeals in Newport Beach are heard "de novo," so issues not raised by the appellant
can be brought up and considered.
An issue I tried to raise before the Planning Commission was why higher priority locations on
commercial rooftops were not considered?
My understanding is the City granted the master license for use of City street light poles to address
situations in which higher priority locations were not available.
But here, there is a commercial shopping center nearby.
The response from AT&T's experts has been their small cell antennas work only on poles away
from buildings.
But as a physicist (as well as a licensed radio amateur), that seems a lame excuse to me.
I hope the Council will ask why AT&T does not have small cell transmitters that work from rooftops
— obviating the need to put them in very visible 6 -foot tall cans on top of street lights in places
where commercial rooftops are available.
' The correspondence received by the Planning Commission on July 23, including mine, does not seem to
have been shared with the Council.
2 This is because the Zoning Code allows the Community Development Director to add unlisted uses to a
district if he or she deems them similar to the uses listed, but only if they are not listed as an allowed use in
any other district.

Hello - My name is Cameron Crowner and a lifelong resident of Newport Beach. Even though I live on the east side of
the bay, I have always had an affinity for West Newport and what it has by way of its businesses & residential character
and personality. Whereas The Irvine Company governs most of the businesses as a landlord and dictate the look of their
commercial product, the Westside has a combination of old -school product as well as relevant housing that fits today's
demographics. And mixed in with that is zoning which allows for a variety of business uses and their respective owners.
I support the change of the zoning ordinance that will allows "front of house" that blends to a business' "back of house"
for industries like apparel, maritime, furniture, etc. by maintaining more of an industrial zone so a business' production
and design can blend with it's up -zoned end product that the public can experience in a showroom, design center,
tasting room, etc. This provides an all-inclusive and unique setting for Newport Beach's business community.
